Nigeria's anti-graft body the Economic and Financial Crimes Commission has opened up why the account of Buhari's fiery critic was frozen.

Although section 308 of the 1999 constitution gives immunity to serving governors, the EFCC spokesperson Mr. Wilson Uwujaren says such immunity does not stop a sitting governor from being investigated.

The EFCC says it decided to freeze Gov. Fayose account because it has sufficient evidence that some suspicious lodgments were traced to the account
His words: “It is true that we have frozen Governor Fayose’s account in connection with an ongoing investigation. We will soon release the details of our findings to the public.

“We froze the account because Fayose has no immunity against investigations.

“Let me clarify that the 1999 Constitution does not grant immunity to governors or public officers against investigation.

“The governors and others enjoying the immunity clause in Section 308 cannot be prosecuted. Therefore, Fayose cannot stop EFCC from doing its job.”


Asked if the amount in the Post No Bill ( PNB ) account was up to N1.3billion as being speculated, Uwujaren said: “Certainly, some amount was frozen in Fayose’s account but I cannot say the exact amount till tomorrow (today).”

A top official, who spoke in confidence, said: “It became necessary to freeze the account following clues on alleged suspicious lodgments.

“We will release the facts soon to Nigerians to appreciate the extent of our investigation.”

Governor Fayose has been having a running battle with the Federal Government over his anti-Buhari stance.

Recently, the governor was placed under security watch by the Federal Government and told point blank that he could not travel out of the country unless he seeks a clearance from the Department of State Security.

Many see this latest incident - freezing a sitting governor's account as one of the moves to muzzle the dissenting voices - a said pointer to the fact that Buhari is running a dictatorial government.

The EFCC position was affirmed by Chairman, Presidential Advisory Committee on Corruption, Prof Itse Sagay, SAN, who said the commission had been empowered to freeze accounts or assets of anyone under investigation.

Sagay, who hinged his assertion on a Supreme Court verdict to buttress his point, said: “If the EFCC is investigating anybody and they have reasons to believe that somebody has acquired state assets for himself, they are empowered by the law to apply to a court to freeze those assets, including banking assets, pending the enquiry and possible trial. So, they have that power.

“For a governor, it is a unique situation, but the Supreme Court has already held that even if you enjoy immunity, you are also subject to being investigated. So, that would be one of the consequences of that investigation.”

Also throwing his weight behind Sagay’s submission, Chief Emeka Ngige, SAN, said: “If during an investigation the EFCC discovers that a particular account has been used for money laundering, the commission has the right to freeze the account pending the outcome of the investigation. It is not touching the account but just suspending the usage of the account.

“It does not matter whether the account belongs to a governor or not. I have said in the past that the Supreme Court had ruled in a past case that immunity shields governors from arrest and prosecution but not from an investigation.

“The apex court ruled that the governors have no immunity against investigation. The commission is empowered by the law to investigate governors and if in the course of their investigation, they find that an account has been used for money laundering they can freeze it.”

Lawyer and human rights activist - Tokunbo Mumuni, said:

“The fact that the governor is in power does not mean he cannot be investigated. This has been settled in the case of Fawehinmi vs. Tinubu. However, he has immunity from any prosecution. On the issue of his frozen account, if it is true, that means the anti-graft agency must have secured a valid court order. If this is not done, the exercise remains invalid and illegal.

“If the court feels that, indeed, there is a commission of a crime relating to the account or the owner of the account, the court has the power to freeze the account pending investigation. Like I said, there must be a valid order of the court, which must be the instrument to be executed.”

No big deal on frozen account —Chukwuma

Lagos lawyer, Nnamdi Chukwuma, said: “There is nothing big or serious about the freezing of an account belonging to a state governor. If it is his personal account, he is like any other bank customer, whose transaction is subject to extant laws. However, what is big is that the account cannot be validly frozen except there is an existing court order.

“The governor cannot claim political victimization, if the EFCC got a valid court order which will be based on the averment canvassed before the court. There is no court that can grant an order without being convinced of the facts presented before it.”

It’s illegal — Ozekhome

It is illegal and unconstitutional for the account of a sitting governor to be frozen while in office. The governor enjoys immunity under Section 308 of the 1999 Constitution and for whatever purpose, his account cannot be frozen. Section 308 of the Constitution grants immunity to the governor and his deputy just as it grants immunity to the President and his vice-president.

“You cannot freeze the account of a President while he is still in office just like you cannot freeze the account of a governor while he is still in office. You can wait till he leaves office. Since he enjoys immunity, the same thing applies to his finances and all his property.

“My take on this matter is that we should be very careful so that we don’t over-stretch our democracy or overheat the polity. The last time I checked, we are supposed to be operating a constitutional democracy that thrives on the rule of law as observers of human rights and not military dictatorship. I plead with President Muhammadu Buhari to call the EFCC to order as they are making Nigeria a laughing stock in the eyes of the international community "

Lawful freeze of a business or personal account or an instrument of operating such an an account is in itself not an end but a means to achieving an end.

There have been various suspicious activities but no action, supposedly, in Ekiti State and surrounding Dr Ayodele Fayose which the resident DSS and EFCC officers in that state must have taken note of and he reported to their superior office, which prompted the first action.

We need to remember the poultry house/factory incident during the first reign of Ayodele Fayose and that this second tenure is running out while elections is approaching and no sufficient infrastructure to justify expenditures from govt purse? This might be a pointer to him that his finances are being watched against graft or laundering.

No one is above mistake nor failure. It's good to have good watchmen.
Let him that think he stand take heed o...

When will EFCC freeze Amaechi,Fashola and Fayemi's accounts or even investigate them?
Are there not numerous petitions against those ppl?
We're slowly sliding into a dictatorship where all opposition are viciously silenced.

It will be extremely difficult for this country to move forward. I lost all hope since 2002.

Is it not this same Fayose that is forcing banks to leave ekiti if the fail to pay arbitrary levies.

Ok. If i understand what really is happening, he is only being investigated and his bank account has been listed among the evidences of the investigation which requires them securing it! Since he is not being prosecuted yet which is virtually impossible for an incubent/sitting governor, and is just an investigation process, his account will be feleased to him after the whole exercise. But lest i forget, thought some set of people said, Buhari doesnt care about Fayose......lol..... What a nation!
No government will ever stir or drive their administration properly without constructive criticism. Thats what keeps them in line from swaying

Why freeze his account when you can't prosecute him because of his immunity as a Governor?

Buhari's Government is setting a lot of very bad precedents and hardly follow the Rule of Law.

WHY SHOULD A SITTING GOVERNOR STEAL UNDER D PRETEXT OF HAVING IMMUNITY if ds steps are not taking, all we will be seeing is dem running to Dubai and UK after their tenors in office.

its was said to be illegal too to detain FFK, OLISA METUH, but till date, dey still can't defend demselves. let the FREEZING continue.
