Senate To AGF: You Lack The Power To Prosecute Saraki, Ekweremadu


SENATE FORGERY –

At the eventual encounter between the Senate Committee on Judiciary and the Attorney General of the Federation, Abubakar Malami, members of the Nigerian Senate have elucidated reasons why the affairs of the legislature shouldn’t be overtaken by the Executive reacting to the forgery case instituted against Senate President Bukola Saraki and Senator Ike Ekweremadu, his deputy.

Saraki and Ekweremadu, alongside 2 other staff of the National Assembly, are facing forgery and conspiracy charge before Abuja High Court.

In a motion by Senator Dino Melaye (Kogi West) the Senate had raised an alarm: “The Senate notes that it’s principal officers are being accused of a fraud that doesn’t exist. This emerging trend poses a threat to security and Nigeria’s unity. The Executive has decided to be chasing rats when the Economy is gradually falling into recession.”

Chairman of the Senate Committee on Judiciary, Human Rights and Legal Matters, Senator David Umaru pronounced the Senate’s stand today saying, “We are not disputing the fact that the AGF holds the power to institute or discontinue any criminal proceeding but the section that states that the AGF should act in consonance with public interest is the bottom line.”

Although the AGF excused that the forgery case is an inherited matter that was (4-month) instituted before his appointment, the Senate countered his constitutional and legal arguments on the legality of the prosecution.

The Senate emphasized the separation of power and independence of the legislature as enshrined in the constitution.

“Our concern is regards to the powers conferred on this committee in Section 88 and 89 and provision of the Senate rules – order 97 and 37 –together with section 62 of the 1999 constitution as amended which offers the Senate the power to regulate its own proceedings and to set up its committees.

“Order 97 specifies the powers of the committees that have been set up pursuance to the provision of section 52 which includes judicial matters, constitutional matters, administration of justice etc,” David Umar said.

Speaking vehemently, Senator Chukwuka Utazi argued that, “The senate has taken a resolution on the issue of its rules. This is our decision to make. This is our house and we are working with it. We have already considered and agreed that this is our resolution.”

Mr. Utazi recapped by quoting the constitution where it says:

“Neither the President or Speaker as the case may be of a legislative house nor any officer of a legislative house shall be subject to the jurisdiction of any court in respect of the exercise of any power conferred on or vested in him by this Act or the standing order of the legislative house or by the constitution”

According to him, this particular section guarantees that the private activities of the legislature should not be dabbled into by other arms of the government.

Utazi speaks further that the Senate has taken a resolution on matters revolving its Standing Orders. He said, “It is our decision and we say we are okay with it.”

nonsense wether or not they are principal or principalities officer's forgery is forgery. impunity must stop SARAKI and ekweremadu are fraud and dis must stop. wether it is Senate private matter or not, it is now a public knowledge and we say let them face d music. WAILERS u can cry me a RIVER.

My dear honourable Senators, please go and tell the Federal High Court these stories about how a few Senators have the right to change the Senate rules overnight. The Attorney General of the Federation is the wrong person to talk to, harass or intimidate. You should be doing all these at the Federal High Court. Very soon, I know that very very soon, you will invite the Chief Justice of Nigeria just as you invited the CCT Chairman to explain why Oshiomhole and Tinubu's wives are more beautiful than Mama Piss imPatience Jonathan.

I know that one day, one very day, in the very near future, we Nigerians will wake up to read from the papers that EFCC has locked up all the 109 Senators of the Federal Republic of Nigeria. You can all then go and show your punching, slapping and shouting skills at EFCC detention. IDIIOOOTS

See how these people are playing politics with the destiny of 180 million people.

They should stop this madness and focus on governance.

APC should put their house in order. they have tried many things on Saraki but its not working for over a year now. rather his popularity amongst his colleagues is growing.

PMB will continue this fight or pretend not to be interested till they bring up his certificate issue.

impeaching him will be so easy cos we all know he doesn't have.

they were able to quiet the Igbo boy that started that case but if Saraki picks up that card. it will be last card for Buhari.

he should face governance. they have just 3 years to go.

Indeed. Up till now u still think buhari is not corrupt. Incase u don't know, not presenting a waec certificate n holding office is corruption, tribalistic appointment witout fairness to other parts of d country buhari rules is corruption, keeping silent over allegations of corruption against ur appointees is corruption (dambazzau, buratai, etc), encouraging wanton killings of a segment of d country (fulani herdsmen case) is corruption, abuse of executive powers is corruption , shld I go on? If the Artoney General lacks power to prosecute Saraki, then why is Saraki and Ekwerensomething running around seeking for immunity? Immunity from whom or from what again. Eediots in the hallowed chamber!

Let's unite and fight this Executive recklessness.

Defend democracy, protect the independence of the National Assembly from interference by the Executive.

The NASS has the mechanism to regulate its internal workings hence does not need Executive order to right their wrongs (if any).

The truth is this : Buhari is fighting Saraki through the AGF and wants to bring him down by every possible means.why? Because Saraki is nt His choice for senate presidency. Am nt against dat. we called Gej Clueless,bt i can officially tell u dat Buhari is a dummy. He is nt aware of wat will happen to him in 2019 if he succeeds in making Saraki and Ekweremadu to step down.
