Man Charged to Court for Carrying Charm

LAGOS - A 25-year-old mechanic, Damilare Oyenuga, appeared in an Ikeja Magistrates’ Court on Tuesday for allegedly being in possession of charms.

Oyenuga, a resident of No. 21, Ogunbiyi Str., Ipaja, Lagos, is being tried for breach of peace, intent to commit felony and being in possession of charms.


The prosecutor, Insp. George Nwosu, told the court that the accused committed the offences on July 20 at block 204 Flat 4, Abesan Housing Estate, Ipaja, Lagos.

He said that the accused had in his possession criminal charms and other dangerous weapons, in an attempt to use them to commit crime.

“The accused attempted to commit felony by unlawful entering into a house to steal,” he said.
Nwosu said that the accused entered into a compound with a bag that contained various charms, and tied all over his body.

“The accused was about to break into a flat when a neighbour sighted him and raised alarm.

“He ran down the stair to escape, but unfortunately for him, the security guard apprehended him.

“When his bag was searched, hammer, iron rod, pliers and various charms were found,” he said.
The offences, Nwosu said, contravened sections 166 and 133 of the Criminal Law of Lagos State, 2011, which on conviction attracts two-year imprisonment.

The accused pleaded innocence of the offences and was granted bail in the sum of N50,000 bail with two sureties in like sum.

The Magistrate, Mr A.A. Adesanya, adjourned the case till Aug. 24 for mention.

So we learned two things here today.

(1)Juju do not work.

(2)It is actually an offence to possess juju in Nigeria.

Now my question is,why are the Herbalist preparing the Juju not been arrested?or should Government make Juju illegal.

207. (1) The trial by the ordeal of sasswood, esere-bean, or other poison, boiling oil, fire, immersion in water or exposure to the attacks of crocodiles or other wild animals, or by any ordeal which is likely to result in the death of or bodily injury to any party to the proceeding is unlawful.

(2) The State Commissioner may by order prohibit the worship or invocation of any juju which may appear to him to involve, or tend towards the commission of any crime or breach of peace, or to the spread of any infectious or contagious disease.

208. Any person who directs or controls or presides at any trial by ordeal which is unlawful is guilty of a felony, and is liable, when the trial which such person directs, controls or presides at results in the death of any party to the proceeding, to the punishment of death, and in every other case to imprisonment for ten years.

209. Any person who-

(a) is present at or takes part in any trial by ordeal which is unlawful; or

(b) makes, sells or assists or takes part in making or selling, or has in his possession for sale or use any poison or thing which is intended to be used for the purpose of any trial by ordeal which is unlawful;

is guilty of a misdemeanour, and is liable to imprisonment for one year.

210. Any person who-

(a) by his statements or actions represents himself to be a witch or to have the power of witchcraft; or

(b) accuses or threatens to accuse any person with being a witch or with having the power of witchcraft; or

(c) makes or sells or uses, or assists or takes part in making or selling or using, or has in his possession or represents himself to be in possession of any juju, drug or charm which is intended to be used or reported to possess the power to prevent or delay any person from doing an act which such person has a legal right to do, or to compel any person to do an act which such person has a legal right to refrain from doing, or which is alleged or reported to possess the power of causing any natural phenomenon or any disease or epidemic; or

(d) directs or controls or presides at or is present at or takes part in the worship or invocation of any juju which is prohibited by an order of the State Commissioner; or

(e) is in possession of or has control over any human remains which are used or are intended to be used in connection with the worship of invocation of any juju; or

(f) makes or uses or assists in making or using, or has in his possession anything whatsoever the making, use or possession of which has been prohibited by an order as being or believed to be associated with human sacrifice or other unlawful practice;

is guilty of a misdemeanour, and is liable to imprisonment for two years.

I am writing to express my outrage over the conviction of two people for witchcraft in Bauchi state, Nigeria. Sadly, this misjudgment by a court of law has not received the opprobrium and condemnation it deserves. In August, it was reported that two persons, Adama Mamuda and Ibrahim Shehu Ganye, were sentenced to two years imprisonment by a magistrate court in Warji over their alleged involvement in witchcraft. They were ordered to pay the sum of a hundred thousand naira (around $700) to the so-called ‘betwitched’ woman, Hafsatu Sani, as damages for the suffering and trauma she went through. In July, a police inspector, Mato Albasu, had arraigned the two for conspiring and imprisoning Sani through witchcraft for four years. According to the police prosecutor, this was contrary to Section 216 of the Penal Code. He claimed that the two accused persons confessed to the crime. He told the court that one of the accused persons, Adama, took away the spirit of Hafsatu and gave it to the co-accused, Ibrahim. Since then, the spirit of Hafsatu had supposedly been in the custody of Ibrahim.

The accused persons were compelled by the court to "return" the spirit of the victim. They were made to walk over her body in the courtroom, and later went to the bush and got some traditional medicine for her. The chief magistrate, Ahmed Shuaibu, sentenced the two accused persons and ordered that they be remanded in prison custody until Hafsatu Sani fully recovered

u are somehow right, but I believe customary courts are the same but, the law varies due to the peoples tradition where it's been stationed..
