Litigation is facilitated by the government(judiciary) within federal,state & municipal courts,The proceedings are very formal & are governed by rules,such as rules of evidence and procedures which are established by the customs & tradition of the people.Outcome are decided by an impartial Judge/jury based on the factual questions of the case and the verdict of the court is binding on both chieftaincy parties.
EXTRA JUDICIAL RESOLUTION METHOD:The alternative dispute resolution(ADR) which is the extrajudicial processess such as Arbitration,Mediaton & collaborative law are mathod of resolving chieftaincy matters outside the court,here the chieftancy institution hire a retired judges & private lawyers to become Arbitrators or Mediators.
It is believed that the Oyo state judiciary have a significant role to play in the resolution of chieftaincy disputes/matters,in order to help promote development,chieftaincy disputes rates higher than many other form of disputes and it if not properly controlled could result in war & their attendant effects such as fear, insecurity and eventually retard progress & development.
