Now that Goodluck Jonathan has been confirmed as acting President, is he required to appoint an acting Vice President?

Even though Nigerians have been expressing mix-feelings on the constitutionality/legality of the emergence of Dr Goodluck Jonathan as acting President, can he appoint someone as acting Vice President? or he's require to combine the duties of acting President with that of Vice president?

Just read in The Guardian that Chief Richard Akinjide (SAN) is calling for the appointment of a Vice President.

Akinjide seeks appointment of Vice President

LEGAL luminary and former Attorney-General of the Federation and Minister of Justice, Chief Richard Osunolale Akinjide (SAN), has called for the immediate appointment of a vice president for the country.

The appointment of Vice President (VP), which he said would be in acting capacity, he noted was logically and factually necessary to complete the institutions of governance and put the country in line with the civilised members of the international community.

Speaking in an interview with The Guardian in Lagos, Akinjide said that appointing a Vice President was legal and constitutional.

According to him, Acting President Jonathan Goodluck could not be the executive president and also be the VP at the same time.

In his view, the constitution never envisaged this situation of vacuum, adding that the situation must never be allowed to sustain, adding: "The post of the vice president is vacant now because Jonathan cannot wear the cap of the president and that of vice president at the same time. So legally and factually, the office of the vice president is vacant because he has moved from that office to the office of that of the Acting President. He cannot be acting president and vice president at the same time. Therefore it would be constitutionally valid for a vice president to be appointed. To make the appointment is now so that governance would be seen to be operating from a well footed position."

The legal icon was of the view that appointing a VP does not require amendment of the constitution or invocation of the doctrine of necessity, because according to him, "the office of the president and the VP is a joint ticket."

The former Justice Minister counselled that the National Assembly should engage in creating convention rather than amending the constitution, when emergencies arose. He commended efforts of the National Assembly in carefully rising to the challenges posed by the ailment of President Umaru Musa Yar'Adua, especially his continued failure to transmit a letter to the Senate informing the legislators about his ill-health and his inability to perform functions of his office.

While urging the National Assembly to continue to act thus in the overall national interest until the whole crisis is resolved, Akinjide warned against the subversion of the decisions of the National Assembly aimed at promoting peace and stability in the country.

why dont he clamour for the removal of the tag "acting" by impeaching yaradua in line with
the dictates of the constitution before appoint an executive VP?

There is no provision in the constitution for appointing an acting vice president. Jonathan is still the vice-president and has only 'temporarily' assumed the authority and responsibility of the president. If you want a more permanent change, they should impeach yar'adua, though I doubt such a move will work out well on the long run.

Jonathan has the full authority needed to do the job and they should simply let him do it, and not try to stir up unnecessary political discord.
