ailehwise: If you don't want to loose your money pack-in into the apartment and claim possession. Pay him the balance of #80,000. Follow it up with a gentle man written agreement so as to complete the repair and make the apartment comfortable for you. The money spent should be used as rent payment for the period the amount can cover. If you don't apply wisdom you will get your money in piece mill and another person will be the beneficiary of the initial investment and patience. Whether you contact SARS or whoever it will amount to nothing this is pure rent affair and as long as the apartment is yet to be occupied the best you can is wait till a new tenant comes forward and your money shall be refunded. They know how to make statements when you get to police station or even court. SARS men not even answer you for now going by the recent crisis they are still facing based on their actions. I learnt a long time ago in Nigeria pay and park in or at least collect key and change the lock immediately. Once house isn't complete don't bother yourself. You're in for a long tin. What are you people talking about? He should use the remaing balance to renovate the house himself, make sure he kept receipt of all expenses, then park into the house. He should not pay the landlord a single dime until he feels he has lived out his expenses. Let the landlord be the one to call police. Na small case be this. 1 Like 1 Share |

Its very simple base on this conditions If you have know the agent that introduced you to the house,he will settle the matter in an real Estate way You can palley with the land Lord by getting another client that will rent the place If you know any mediation centre around you eg in the local govt area close to the place ,they will help you |

Nigerians think they are over smart, u want to enter into a contract, u didn't think u need a lawyer then, then kasala burst, u are looking 4 charge and bail to give u advise. nonsense. not that u deserve it, go to police station and make a complaint of obtaining by false pretence, make sure u see the DPO and show him the video. just be prepared to buy beer for them or fuel their car to make the arrest , u will get @ least 80 percent of your money. |

Dear Nairalander, Sorry that you have experienced such a traumatic experience but firstly may I ask did your landlord sign any agreement with you be it on a sheet of paper of any kind with regards to the 70k you paid him. If your answer to the above question is NO, then there is still a way out. You mentioned you recorded the process of you making the payment. The video evidence can be and would be tendered as an exhibit in court when your case is being heard against your landlord. Section 84 of the Evidence Act 2011 makes this possible In the meantime, can you trick your landlord into acknowledging that you had initially paid him 70k before. You will tell him you don't mind paying him the remaining 80k balance but he should please help you sign any agreement stating that you have paid him 70k before and would still pay him another 80k in the future. Also from now henceforth try and make silent recordings (video or audio) of the conversations you have with your landlord on this particular matter, it would be good evidence in court. Depending on how experienced your lawyer is taking into account the legal advice I have indicated above, you would get your 70k back and even substantial damages by way of special damages ( your legal fees, Court costs) E.T.C I sincerely hope the legal advice above is sufficient for you at this point in time Feel free to contact me should you require any further information Regards Akinola Samuel Eluyefa Esq Barrister and Solicitor of the Supreme Court of Nigeria 1 Like |

ailehwise: Your situation is not dire at all. All you need to do is pack your belongings very early one morning and move into the room as is. Remove and replace any keys/locks on the door. Do not fight him. Let him know that a new person has moved into your former apartment and you have nowhere else to go. Tell him you do not mind the renovations going on whilst you are in residence. alternatively, tell him you will carry out the renovations from the balance of N80K and give him whatever is left. If he threatens you in any way, report a case of threat to life to the nearest Police Station. Ask for the fundamental Human Rights Officer and repeat your story above. Ensure the Landlord signs an undertaking not to threaten your life again. KPELE.

You sign an agreement with a crook of a Landlord then go ahead to pay him money in advance of getting the house in order, shit happens and now you wanna get a lawyer to redeem your 80k? Brother why didnt you get a lawyer in the first place? How can you trust a man you have never met in your life with money your hard-earned money? Are you even sure he is the owner of the place or just another agent fronting for the owner? Even with your video evidence, you will still loose the case in court because you never got a legal person involved in the first place. |
