Hon.Justice Adewale Thompson’s 1969 Judgment on Open Cattle Grazing – Suit no AB/26/66.

Suit no AB/26/66 at Abeokuta Division of the High Court.

“I do not accept the contention of Defendants that a custom exists which imposes an obligation on the owner of farm to fence his farm whilst the owner of cattle allows his cattle to wander like pests and cause damage. Such a custom if it exists, is unreasonable and I hold that it is repugnant to natural justice, equity and good conscience and therefore unenforceable…in that it is highly unreasonable to impose the burden of fencing a farm on the farmer without the corresponding obligation on the cattle owner to fence in his cattle.” Sequence to that I banned open grazing for it is inimical to peace and tranquillity and the cattle owners must fence or ranch their animals for peace to reign in these communities.”

Open grazing is a crime. It is a sin.


"If an animal is grazing in a field or vineyard and the owner lets it stray into someone else's field to graze, then the animal's owner must pay compensation from the best of his own grain or grapes."
Exodus 22:5


"Allah, The Most High, has prohibited usurping other people's property and has imposed liability for whatever is damaged of the property taken without right even if it was by mistake. Whoever damages another person's property - that is considerable - without its owner's permission, is financially liable to make up for it.

Imaam Al-Muwaffaq may Allah have mercy upon him said: “There is no juristic disagreement in this regard, whether or not the damage is intentional, and whether or not the one causing it is legally accountable.”

Similarly, whoever causes the damage of another person's wealth is financially liable for it."

Open grazing tramples on the rights of farmers and when Nigeria government is ready they will end this problem

Moving cows from point A to point C if you do not own B should only be done in the back of a truck. Open grazing and wandering should be a criminal offence. The Government should simply enforce the law!


Cattle farmers should go and obtain loans from Agricultural Banks and build private Ranches and pay back the loan over time. State Governments that wish to provide low cost land for lease for Ranches can be encourage to do so. It is not up to FG to impose this on all 36 states of Nigeria. It should be the choice of each individual state through policy making and appropriation by the state assembly.


When Government is ready they will take this matter seriously and resolve it rather than acting like advocates of Miyetti Allah!

Simple! Spot on.Cattle breeding is private business but Buhari government is trying to imposed same on the Nigeria nation while acting as surrogates for his killer Miyetti Allah Fulani brothers.
