Fed Poly Offa, others affected in land takeover bid as Erin-Ile wins boundary dispute

Federal Polytechnic Offa, a PHCN sub-station and other important property hitherto belonging in Offa communities may be ceded to Erin-Ile community as the Supreme Court ratified a 45-year-old judgment in favour of the latter.

The age-long boundary dispute, which had led to communal clashes and loss of lives between Offa and Erin-Ile communities in Kwara State, may be renewed as Erin-Ile community vows to implement the newly confirmed judgement of the Supreme Court.

The latest action of the Erin-Ile community followed the recent judgement of the Supreme Court on December 14, 2018, which affirmed the same court’s decision of December 10, 1973 that the parcel of land that formed the boundary between the two communities belongs to Erin-Ile.

The judgement, if executed, will lead to the takeover of lands on which the multimillion naira Offa Descendants Union Secretariat, Avalon Hotels, buildings and some Federal Government institutions such as the Federal Polytechnic, Offa and PHCN substation are sited.

But Offa Descendants Union has appealed to the Kwara State Government to “call the people of Erin-Ile to order,” alleging that the latter only wants to execute what ODU described as “fake judgement.”

In the suit number SC. 516/2012 between Mr. Abdulganiyu Adeniran, Mr. Abdulateef Aroyehun Lawal (for Adeniyi Apata Family of Offa) vs HRH Oba Abdulganiyu Ajibola Olusookun II Elerin of Erin-Ile, five justices of the court affirmed the report of the 1973 administrative judicial panel headed by Justice Daramola.

The lead judgement was read by Justice Mary Ukaego Peter-Odili.

Other justices included Olabode Rhodes-Vivour, Ejembi Eko, Paul Adamu Galumje and Sidi Dauda Bage.

Addressing a Press Conference, the National President of Erin-Ile Progressive Union, Samuel Olu Alabi, said, “We got a Supreme Court judgement December 10th that same

year confirming the boundary of Erin-Ile as far as NEPA office — the present Offa Descendants Union and several other places — as belonging to Erin-Ile.

“But, unlike in 1973 that we did not take steps, this time around, we will take necessary steps in accordance with the judgement. When and how we are going to do it is not yet determined.

Special status?

Do you think Erin-ile people will subscrib to that after court has given judgement on the true owner of the land.

Transferring the land to the rightful owner (Erin-ile) won't be easy cos Offa may not want to accept defeat easily. But the fact still remains that Erin-ile owns that land any attempt by government to give a special status to the land will be regarded as cheating and government may be accused of taking side since supreme court which is the highest court has given it verdict on the matter.

In other to prevent further clash, the traditional rulers and some important personalities in both communities should be invited for a round table discussion on how the land will be transferred peacefully.

The law has taken it course and the ruling of the court should be obeyed strictly.

I believed that kwara state government will do the needful this time because I still don't know why justice is being compromised while lives and prosperities were wasted all because of the the government nonchalant attitude.

I came across the presentations made to the tribunal then by the Alaafin of Oyo and the late Emir of Ilorin, Sulu Gambari which indicates that the land originally belonged to Offa. A particular point was noted as the boundary but of course politics is playing a huge role in all these.

Like the Ife/Modakeke issue, the matter will be resolved not in court nor by war but by the true law of nature in due season.

If I get you well, you mean the court comprised due to the fact it did not favour Offa people?

The case has passed through different courts from high court to court of appeal and finally to supreme court and with the report I have, Erin-ile won all.

This same case that favours Erin-ile in 2018 also favoured Erin-ile in 1973 when the matter was first taken to Court.

For peace to reign, I think its high time you obeyed the ruling of the court.

This land had led to loss of lives, properties and increasingly affecting relationships among the love ones. Truth is bitter but it would be better to accept the Supreme Court judgement to allow peace and unity to reign. I believe lives are more valuable than this parcel of land.

Offa should comply with the judgement and stop its overbearing attitude for peace to reign.
