Court Stops Efcc From Arresting Okereke-onyiuke by Pukkah: 10:00am On Aug 13, 2010
A Lagos high court yesterday restrained the Economic and Financial Crimes Commission (EFCC) from further harassing, embarrassing, intimidating or threatening to arrest and detain the sacked Director-General of the Nigerian Stock Exchange (NSE), Professor Ndi Okereke-Onyiuke.

The judicial pronouncement by Justice Morenike Obadina, followed an ex-parte motion brought on behalf of the embattled NSE ex-Director General and argued by Chief Robert Clarke (SAN). Others named in the application, as defendants were, Inspector General of Police, the Commissioner of Police Lagos State and the Securities and Exchange Commission (SEC).

Restraining the defendants from taking any action to arrest the plaintiff, Justice Obadina said: After hearing Chief Robert Clarke (SAN) with I.B. Mohammed Esq. and O.J. Sodipo Esq. of counsel to the applicant, order is hereby made that the status quo ante be maintained by the respondents pending the hearing of the motion on notice.” In addition, the judge ordered the applicant’s counsel to serve the originating motion forthwith on all the respondents, who have five days under the rules after service to file a response.

She later adjourned the matter to August 19, 2010 for hearing of the motion on notice. Okereke-Onyiuke, had in the motion ex-parte brought under the Fundamental Rights (Enforcement Procedure) Rules 2009 and under the Inherent Jurisdiction of the court, prayed for an order of interim injunction restraining the respondents from violating any of her rights pending the hearing and determination of the substantive application.

She averred among others in the 18-paragraphs affidavit filed in support of the motion that since her removal on August 5, 2010, through a letter to her residence, series of strange faces both in mufti and uniform, strange vehicles, either of the EFCC or police had been parading her residence. She deposed further that, “two black unregistered Highlander Toyota SUV paraded my street repeatedly with their mission unknown to me.”

The plaintiff stated that the immediate intervention of the court was required to protect her fundamental rights to life, movement and properties and more importantly, from being intimidated, arrested and detained since she has not been charged of any offence before a court of competent jurisdiction. Prior to this, the sacked Director-General had instituted a suit at the Federal High Court seeking for N3 billion damages.

She prayed the court to declare her sack as null and void arguing that the purported removal was in utter violation and breach of the provisions of Investments and Securities Act (ISA), which spelt out the terms of her appointment.

NIGERIA WHICH WAY? when it comes to the rich and famous, courts never hesitate to grant restraining order. But when it comes to the poor and downtrodding, restraining order never becomes an option! Na wa o!!! oga Judge, vacate that order and let the law take it's course, whether EFCC is witch-hunting or not, corruption is corruption, God bless naija!

i just don't geddit!. . . is the court tryna say EFCC shouldn't put the fat woman to trial despite the many allegations leveled against her and if evidence was made available to back up such allegations?

Many folks lose money during the stock market crash, many of em are old and retired, only feeding off on capital gains that stock markets provided, someone ought to take the blame for all the money losses, especially if it has been alleged and proven that the crash was largely due to financial misappropriation carried out within the NSE to which Mrs Onyiuke was privy to, and also benefited from.

When a purse snatcher gets caught, if he's lucky enough to escape the death blows of an angry mob, his face will be all over the dailies with some handcuffs and chained to some ugly looking shackles.
The NSE woman bled Nigerians of billions and she gets a court restraint preventing her arrest. . . .talk about double standards!

What kind of order is this for goodness sake, why not allow the EFCC arrest her and if she is not charged to court within 24 hours, her lawyer should bring a motion asking for her release or for her to be charged to court.

You re right she remains innocent until proven guilty, but ow do we prove her guilt if she can't be arrested and charged to court?

She has a defence here, that she was not responsible for the global financial crisis. She, together with heads of other institutions like the SEC, CBN and Finance ministry - may have failed in the discharge of their oversight functions. That does not constitute a criminal offence.

While they gather evidence, EFCC should pursue those where there is a preponderance of evidence - IBB, Atiku, Kalu, Odilli, Bankole etc. EFCC has become increasingly cowardly in their pursuit of high profile corporate titans with uncustomary zeal, those with no political constituencies to fight their corners.

Let them prove they are serious (as they did under Ribadu) and confront the rogues responsible for despoiling of our nation. Politicians! Past and Present. They have all the evidence they need to do that!!


However, I fully support the wide-ranging investigations into NSE accounts. She should be held to account for any malpractice discovered to have been perpertuated under her watch,  for which she had knowledge of. If she is found cupable of perpertruating fraud herself, then I say she deserves significant jail time.

If you call it "failure in discharge of oversight function" it wouldn't constitute a criminal offence,

If i call it "failure to report criminal and fraudulent activities committed under her watch and in her ministry,one to which she's privy of" then she becomes an accomplice.

She didn't quite cause the global financial crisis, but in many ways, she breached her oath of office in a reckless abuse that saw investors lose millions, while she shamelessly sought after political gains.

Add Aliko Dangote to this list please. He manipulated Ap share price and must have manipulated other company prices that he has interest in, doesn't this mean anything to anybody please? this is a crime to be punished.

At last, somebody is not a paid agent in this forum/site, somebody is seeing reason with us here.
Nigerians don't tackle their problems until it has corrupted the whole body.
At this point, nobody wants to comment on Dangote's corruptions until it has eaten deep and has become cancerous. African Petroleum's share price was N300 and because of Dangote's share price manipulations, it has gotten down to N27 naira or thereabout, and this is the case with all the companies where he has interest in.

people must understand that the crash of the NSE had little to do with the global economic meltdown. The crash here was due largely to roundtripping, artificial inflation of share prices and other inane myriad sharp practices perpetrated by cheap crooks here. Nigerians must understand that you cannot abuse a system for ever: it crumbles at some point. This is the same sense in which we point to the international market in our bid to increase the pump price of fuel. But when the global price drops, our price remains constant and NEVER drops. Methinks our local economy defies the standard economics logic of demand and supply.

In saner climes, the lady in question'd resign honourably in deference to the millions of people whose investments she wasted (poster inclusive) and submit herself for investigation especially if she's convinced of her innocence. At the least, she'd tender a public apology to those whose money went up in smoke as a result of her ineptitude. We must face the consequence of our (in)actions.
