The CJN can simply recluse himself from the process of investigation partaining to his case once the matter is referred to the NJC. By this reclusion he doesn't need to step down as CJN as he can continue to perform other duties of his office except that relating to his case once instituted.

As a lawyer, am sure you would have know this.

By the way, the CJN lack of immunity only relates to his prosecution not to the procedure for this removal or suspension - that procedure has alreadybeen outlined clearly by the constitution and is sacrosanct


The aspect where he recuses himself is working perfectly in the manner he suspended NJC's meetings indefinitely.

Has the issue been formally referred to the NJC as a petition?

Am not aware that this has been done. If it has not bee done, how does the NJC deliberate on it?

Onnoghen is the chairman of NJC so how can the same NJC treat his case when he's the man in the middle if he's allowed to remain?

That's why I said the CJN enjoys a form of immunity so that he can be truly independent.

Blame the system.

Had he been an aboooki dancing to the tune of the president, there would have been no case at all!

He does not enjoy any immunity. No law in our land support that.

The truth is bitter.

The FG should have first towed the honourable path by petitioning the NJC. Win or lose, Nigerians would have been holding the NJC responsible for the current impasse.

But as usual Buhari couldn't hide his distrust for a mostly southerner populated NJC hence deciding to tow the path of shame and anarchy.

Like I said in previous threads, no lawyer (whether in Buhari Govt or close to it) has nor would ever support the clear assault to constitutionality and the judiciary as Buhari has clearly done.

Go through all the reactions so far by lawyers and you find no lawyer supporting this(except the musings of Sagay who was very half hearted in his response). No lawyer in this Govt not even the VP or Keyamo will do so. They know they implication .

We are not interested in this cos of partisan politics but what it portake for the judiciary and democracy.

Let Buhari follow the due process: send a petition to the NJC and the NJC should investigate and deliberate whilst the CJN recluse himself. The finding from such investigation should then be forwarded to the Senate for a decision to be made. Only then can the President remove him from office.

Any other path is an illegality which is null as it is utterly void.
