The Court of Appeal sitting in Akure, Ondo, on Saturday, April 6, ruled that the candidate of the Peoples Democratic Party (PDP), Ademola Adeleke, is qualified to contest as governor of Osun state.
The ruling thus nullified an earlier judgement of a lower court which disqualified the governorship candidate of the PDP in the 2018 election in Osun on the basis of his certificates.
Television Continental reports that the ruling of the appeal court reaffirmed Adeleke’s qualification and eligibility to contest the office of the governor of the state as earlier delivered by a high court in Osogbo.
According to the report, the high court in Osogbo had ruled that the governor is qualified having been educated up to secondary school level.
Not satisfied with the ruling, the petitioners had headed to the appeal.
It was learnt that the appeal court dismissed the petitioners’ claim on three grounds including that the court had no jurisdiction to hear the case.
The second ground on which the case was dismissed was that the petitioner has no locus standi to file the case and third was that the matter was brought to court outside the stipulated 14 days after the conduct of the primary.
Legit.ng earlier reported that a high court sitting in Abuja reportedly
nullified the nomination of Senator Ademola Adeleke as the candidate of the PDP, in the September 2018 governorship election in Osun state.
Recall that two chieftains of the All Progressives Congress (APC), Wahab Raheem and Adam Habeeb, had in 2018 dragged Adeleke to court accusing him of not possessing the requisite educational qualification (secondary school certificate) to contest for the office of governor.
It was also reported that the Independent National Electoral Commission (INEC) said it can issue a certificate of return to Senator Ademola Adeleke of the Peoples Democratic Party (PDP) only if Governor Gboyega Oyetola of Osun state fails to appeal the judgment of the tribunal that sacked him within 21 days.
The commission, on Monday, March 25, debunked rumours that Adeleke had been issued a certificate of return.
Legit.ng further reported how following the recent ruling of a court against the candidacy of Ademola Adeleke, the PDP
vowed to sanction members with cases against him.

Osun : Ademola Adeleke is Qualified to Contest for Governorship-Court of Appeal

The controversy over the eligibility of Senator Ademola Adeleke to contest the Osun governorship election has been put to rest as an Akure Federal Court of Appeal has by 11 AM today reaffirmed his qualification and eligibility to contest the office.

The Akure Court of Appeal dismissed an appeal against the judgement of Osogbo High court which had confirmed the eligibility of Senator Ademola Adeleke to contest for the governorship of Osun state.The Osogbo High Court had earlier ruled that Senator Adeleke is qualified to contest for the governorship having been educated up to secondary school level.

The petitioners however proceeded to appeal against the ruling ,insisting that the Senator is not qualified and therefore Dr Akin Ogunbiyi who is the second runner up at the governorship primary should be declared the winner of the primary.

The Akure Appeal court in its ruling dismissed the appeal on three grounds ,affirming the judgement of the lower court that confirmed the eligibility of Senator Adeleke.

The first ground was that the court has no jurisdiction to hear the case .The second was that the petitioner has no locus standi to file the case and third was that the matter was brought to court outside the stipulated 14 days after the conduct of the primary.

Osogbo high court did not consider forgery of results and whether Adeleke completed secondary school.It only considered whether Adeleke entered secondary school or not.....The Akure appeal court struck it out on technical ground. However Abuja high court examined forgery issue and completion of secondary school...In the Abuja high court judgment. Adeleke was found ineligible for the election....Appeal court and supreme courts will decide on it. Additionally the tribunal matter is still 50 50 the appeal and supreme will decide on it.....

The Nigerian judiciary is a disgrace. Gone are the days when Nigerian judges were like the gods - forthright, fearless, principled, impartial, blameless. Today, most of the people on the bench are rouges. Shame on them all.

It was this morning exactly 11.35 a.m while in House On The Rock Church, Lekki that I posted on my WhatsApp status that APC is set to fall in Osun. A court of appeal in Akure my hometown in the afternoon declared Adeleke eligible against earlier court rule in Abuja that he is not eligible. We are expecting the judgement of court of appeal regarding tribunal that removed Oyetola as governor. Is APC in Osun not starting to be shamed?

I've said it repeatedly that Oyetola should have just humbly vacate the governor house instead of these useless display of power and pride. I'm concerned about Osun because I lived in Osogbo for about five(5) years. #PEACE

You go de alright las las.This judgment from the appeal court renders the bwari kangaroo judgement null and void.BTW Adeleke has not been convicted by any court in Nigeria for forgery.

The appeal court judgment clearly stated that Adeleke was educated up to secondary school certificate level and thus is eligible to run for Governor

The appeal court judgment clearly stated that Adeleke was educated up to secondary school certificate level and thus is eligible to run for Governor
. The Akure appeal court struck Olagoke case out for the following reasons....one. it was filed after the fourteen days stipulated on the law...two. the Akure appeal court has no jurisdiction to hear the matter...Are they not technical grounds..... The Bwari judgement is still being appealed in Abuja appeal court.Judgement later.....That is the situation for now...no sting attached.

What is going on in Nigerian courts sef, with all these counter/conflicting judgements. I won't be surprised if a lot of judges collect bribes to deliver judgements.

As if those judges have different constitution using to judge case.
