Court strikes out suit seeking to stop ministers’

The Federal High Court Abuja, on Monday, refused to grant a request stopping President Muhammadu Buhari from inaugurating the 43 ministerial nominees over the exclusion of a Federal Capital Territory indigene from his cabinet list.

The applicant, Mr Musa Baba-panya, who was also the counsel in the case, had, on Thursday, approached the court with an e xparte motion, asking the court to stop the president from going ahead on the inauguration.

In suit number: number: FHC/ABJ/CS/878/19, Baba-panya, who is also an indigene of Karu in the Federal Capital Territory, said the president’s action was contrary to an Appeal Court’s judgment delivered on March 15, 2018.

President Buhari is the first defendant while the Attorney General of the Federation is the second defendant in the case.

News Agency of Nigeria reports that the president would be inaugurating the 43 ministers designate earlier confirmed by the Senate on August 21 at the Federal Executive Council Chamber, Presidential Villa, Abuja.

Baba-panya, who argued that the Appeal Court’s ruling was a compelling order, said it was served on the president through the AGF.


The lawyer, in an originating summon dated August 7 and filed August 8, said that “The 43 confirmed ministerial appointees now awaiting swearing-in or inauguration as the Federal Executive Council is incomplete, illegal, unconstitutional, null, void and of no effect whatsoever.”

Justice Taiwo Taiwo, however, noted that the suit was coming rather too late and therefore there might be no reason to stop the inauguration.

The judge asked that President Buhari is personally served with the motion notice.

Dismissed as expected. No be APC/Buhari court we get now? Plus FCT residents/indigenes are necessary evil according to Buhari because they did not give him majority votes during elections. He is now just tolerating the FCT and sees no need to be more inclusive, same applies to all Southern regions...

Am sure you believed that atiku won buhari contrary to your stance on wauting for the ruling.but can you remind me when a minister of fct extraction has ever been appointed

So you expect the court to stop the inauguration of ministers because of FCT people? Which law mandates the president to appoint a minister from FCT? You guys are the ones crying that the president is killing the economy by not inaugurating the federal cabinet but you’re sad the stop won’t stop the inauguration. What exactly do you wailers want?

There might be no statute now but there is a subsisting court judgment that requires the president to include an FCT indigene in the cabinet. I hope you are aware that valid, subsisting judgments of courts also form part of our laws? Did you read that part of my post that talked of inclusion? When Lagos was FCT which persons were in charge? Even if an FCT indigene is not appointed minister, why can't an FCT indigene be a member of the cabinet with another portfolio? There are 43 ministerial appointees while there are 36 states. Rather than give the NW 2 extra slots, why wasn't one allocated to the FCT especially on the strength of the 2018 court of appeal judgment in question?
