4.28 pm: Under these issues, the petitioners alleged the election was marred by irregularities, misuse of scarce resources, manipulation of result sheets, overvoting, wrongful recording of results, intimidation of voters among others in 11 “focal states”.

The petitioners’ 11 focal states are, Borno, Gombe, Jigawa, Kaduna, Kano, Katsina, Kebbi, Niger, Yobe and Zamfara States.

The tribunal says the allegations levelled under issues 4 and 5 are criminal in nature and must be proved beyond reasonable doubt.

4.25 pm Issues 4 and 5 are now being resolved together. The issues are whether or not the election was marred by corrupt practices and non-compliance with the provisions of Electoral Act.

4.23 pm: The tribunal says the petitioners failed to discharge the burden of proof that Buhari was not elected by a majority of lawful votes.

4: 21 pm: Issue 3 resolved against petitioners.

Lawyers have started arriving the Court of Appeal in Abuja, venue of the Presidential Election Petitions Tribunal, as the tribunal set to deliver judgment today, Igbere TV reports.

Our correspondent at the venue observed that several journalists and supporters of both parties involved (APC and PDP), have equally gathered at the door of the court hall, waiting for staff to open it.

There is heavy security presence (comprising of army, police, NSCDC) at the court premises, even as security operatives are taking their time to screen people seeking access to the court.

The tribunal is expected to resume at 9am as they decide the fate of PDP and its candidate Atiku Abubakar and President Muhammadu Buhari of the APC over the February 23 presidential election.

Igbere TV recalls that INEC had declared Buhari and the APC as winner of the election, having polled a total of 15,191,847 votes to defeat his closest rival, Atiku, who it said polled a total of 11,262,978 votes.

The five-man panel of justices of the Presidential Election Petitions Tribunal, is headed by Justice Mohammed Garba, as Chairman.

My friend, take correction.
Judges don't go out of their way to investigate in order to establish or verify the truth about a case brought before them. That is tantamount to delving into the arena to make a case for one of the parties before them. If there is anything worthy of investigation or confirmation, it comes by way of application from a party that feels it will help their case.

The party that needs it makes application for an order of the court and the court can grant it. That's why an expert can be subpoenaed to come before the court to either throw more light on an issue or tender a document before the court.

It is at the instance of the party that feels the need for it. It is not for the court to do for any party on it's own, else the court will be making a case for a party against the other party before it.

Yes, the court will not 'write' Cambridge, WAEC or any Institution to come before it for any confirmation, if no party moves the court to do it.
This is the place u will knw those that can not handle a family misunderstanding or crisis, they always think within their own brain

The Judge in dismissing Atiku's petition just said the classmates of Buhari that testified in his favour cannot not lie or twist the truth by virtue of their age.

He said 'Because they are old men, they cannot lie'.

4.57 pm: Tribunal says none of the documents tendered by the petitioners was utilised to prove the allegations, such as overvoting.

“In the final result, and I have come to the conclusion which is inevitable and unavoidable, that the petitioners have not proved any of the grounds of the petition in paragraph 15 of the petition.

“This petition is accordingly and hereby dismissed in its entirety,” says Justice Garba.

Parties are to bear their costs.
