similar thing happened with my mum.. she went to police station and was just wasting money on lawyer ....go to a reliable police station(only do this if u have money cos dem go bill u)... or use the craze man mode!!! padlock him door if dem born am well make he break am.... sort like 5 boys make them drill am

Stories like this is discouraging me in building for rent in this lagos state, I've also had similar experience with my dad's property, took us a year and half to evict a stubborn tenant.

Best advice brother is ... my uncle did it..it works like magic.. go to ur property and remove 2 doors or just get a truck 20tons of sand and offload it there. Tell them building sold already

Good day all.

Please, I need your advice on one wicked stubborn tenant. My family gave this our tenant a quick notice since February this year 2019. As a matter of fact, the tenant and our family went to Lagos Arbitration and Mediation Centre. It was at the Mediation Centre that we both reached an agreement that he should leave our apartment.

So, we gave him 6 months quit notice in February, 2019. His previous house rent elapsed that same February, 2019. So, for the 6 months quit notice we gave him, he didn't pay any money. He actually said he would need 6 months to search for another apartment at that meeting we had with him at the Mediation Centre in February. So, we gave him the 6 months for free.

The 6 months we gave him elapsed at the end of August, 2019. When the 6 months elapsed, he refused to vacate the apartment. So, my family went back to the Lagos Mediation Centre to complain. The Mediation Centre sent him (the tenant) a letter giving him 7 days ultimatum to vacate the apartment. At the end of the 7 days, this man refused to leave. My family complained again to the Mediation Centre and they said they would look into it.

After another 3 months again by last November, 2019, this tenant refused to leave the apartment. My family went back again to the Lagos Mediation Centre and one of the officials there said "So, the man has not left the house since?". We responded yes. At the Mediation Centre there, they said something like they are incapacitated by the law to take any action.

This is December now going to an end. The tenant is still in the house. He has refused to vacate the apartment. It's about 10 months now living in our apartment without any payment. He has refused to leave.

The apartment is a 2 bedroom flat in Aguda Surulere, Lagos. The tenant's name is Mr Chigozie Okongwu James.

We don't want to take law into our hands as it seems there is no solution to the problem through the Lagos Mediation Centre. It's about 10 months now!

What can my family do to get the man ejected from the apartment? Your advice are welcomed.



They are everywhere.. Such wicked tenants. That's why they can never build their houses. Not a curse.

Going to court will take you like 6 months to obtain judgement from the court and money. Please, do not lock his door or remove his roof, but make the place uncomfortable for him, like, cutting his electrical wire, blocking his chamber, blocking his access to water, even arrest him with police for threatening your life and for him to sign undertaking.

So because he hasn't gotten money to rent a "new" apartment another person's investment should suffer? What happens if he goes back to his home town?
Since you supporting such, may your investment be taken by those who wont pay you.

I will tell you to just use traditional means... We had some tenants like that In which they owe 1,3 and 4yrs rents. We employ Jide Taiwo Property agent to manage the house (Total waste of time and money) they didnt do Jack... We Employ a lawyer Paid 80k and the lawyer collect cash still was unable to do nothing... You cant remove the roof cos if the tenants proceeds to sue you, you will suffer more than what u bargained for.. Only few people use that Jungle means and succeed with it and those are the connected and rich.

So we went Traditional as we are local and Ijebu's Ourself..with Just 15k all the tenant left the house within 72hrs of application... The whole house emptied. Till 2mrw; Traditional means is still the best to deal with any crazy person as long as you are being sincere with the whole events...

(Just incase anyone here wants to say rubbish about traditional means or Preach Gospel, Pls feel to add that sermon to your worship manuals to members who also who rents and refuse to pay nor leave the house.)

After 10 months? What if the landlord depend on the house to takecare of himself?
If he cannot keep up with city life then he should quietly go to his village.

Firstly, I wish to congratulate you for not falling into your tenant's trap. He would have just claimed you destroyed something his livelihood depends on or you stole a 45 million His office gave to him. There is a due process under the law and I will explain it to you now.

Rent court is faster in these cases than magistrate as magistrate court handles all types of cases. So, go to your local govt office to asked for the location if the rent court and liase with any court clerk there. For rent court, I am not sure but I believe you don't need a lawyer to file your cade but to be sure, the clerk will out you through. If a lawyer is required, they can also give you a lawyer's contact.

If it is magistrate court, you will be needing a lawyer and the rest if the process is about the same.

For an owing tenant, you didn't even need to give a six months quit notice only the seven days notice. However, some states like in my Oyo state requires a one month quit notice before the seven days quit notice. Either way, you've more than compensated for it with the six months and then the seven days notices. Now you go to court. (Had to explain this much due to other readers).

Your lawyer or you (if rent court) files the case and a court notice is sent to the tenant. If he is seen, whether he accepts the notice or not, as long as the bailiff tells him and throws down the paper or gives it to him, it is as good ad served and he has no excuse whatsoever as kind as the bailiff lays eyes on him.

The process at court is

Mention, hearing, judgement.

The other parts could be skipped if he accepts to actually owing on the first day and sometimes the judge could just wrap everything up and deliver judgement right away saving everyone time. The judge would never say he must move instantly but will still give him time to move but the good thing is the judge will will acceed to your prayers.

Prayers in court terms means request. While discussing with your lawyer, list it all. It should include

That he leaves,
That he pays up all outstanding rent covering all the period he is owing till now (the 10 months)
That he pays all potential rent from now till when court asks him to leave (called mense profits)
That he pays for the court case (the son of a wonderful creature of God has to be taught a lesson)

Now the court might not grant the last one unless you prove you indeed had enough patience with him (in my case, the female judge said she didn't want to lay too much financial burden on her being a student. I've seen another judgement where it was approved). A statement from the resolution centre and/or copies of those quit notices will nail his coffin. The court will certainly ask him to move as well as pay all monies till he leaves.

It might take time but you will have your wish done. The lady I got a court judgement against packed out and even locked the door but we kept pasting all notices on her door. When she knew we did not break the door open and falling into her trap, she came back to open it herself after a week. The court processes still went on till judgement was made even in her absence.

What if he does not leave even after the judgement was said to his ears or posted on his door and he does not leave?

You still go back to court and the court gives you a registrar and police escort to evict him and also a garnishee order to his banh to have the money transferred to you. (Thank God for BVN). As long as he makes money in this Nigeria, you will have your money back. Just find his account details and he is toast.

There is a process and the law works.

Probably due to lots of cases. First thing is to find out the location of a rent court in the local government. It's faster

It's seems he has been bribing some of the officials there.

We actually gave him a grace of extra two to three months because of COVID-19 issues. Even with that, he doesn't want to leave.

Our tenant Mr Chigozie Okongwu James has refused to vacate our apartment for close to two years now!

He was given a quit notice since February 2019 at the Lagos Mediation Centre. His house rent had expired before he was given the quit notice.

Up till now, he has refused to leave the house! This December 2020!

Lagos State needs to do something about stubborn tenants like this man. This is one of the things causing crises in the society. When cases like this degenerate into violence, Lagos State would want to absolve itself from the crisis.

Lagos State needs to be more proactive to avoid breakdown of law and order.

its through, when landlord kill tenants or cause alot of trouble. Lagos State officials would start talking trash. while will someone stay in your house and not pay rent? i have them in my house in ikorodu. staying like three years now no payment. they have even kept nepa bill for me self. 850 nepa bill is what they left for me. This is what you should do, first make sure the whole house is using prepaid meter. if they dont have give every apartment prepaid, but for the tenant that is owing, dont give him prepaid. tackle him with the light first, you know if he by pass the light, just do a video and send the video to nepa, trust me, nepa would be happy to Bleep him up. then if the house has water running in the whole house, disconnect his water. make sure the house dey pay service charge ohh. you know service charge is payment used to run the house, so since he is not paying service charge, make sure he doesnot enjoy the facility. then involve area boys for the area to dey monitor am. i have lots of them owing me money, the first thing i did was to install prepaid meter, those owing me, i know give them prepaid meter. after like three weeks one of them parked out. the jest plan i have is, i will block there water, once i block there water, if them know park, i go involve one deadly cult boy for the area. but i know getthere time yet because there rent na small money. if like say na the place where them dey pay me 500k, i swear, i go Bleep the tenant up. i will disconnect his water, retrieve my prepaid meter or make the prepaid meter enter tamper mode. then with that would not be able to recharge. so he would be frustrated to leave.... that is while i tell people, try and make your house expensive, so if one tenant dey mess up, you fit use another tenant rent take fight case. if you need better help or advice. let me know... i go dey gist you coded ways to Bleep those stupid tenants up
