In case the very strange language that was used in the first post seems strange and confusing (is that English Language? ), all that he is trying to say is that Zakzakky is being tried by the Kaduna State Government, not by the Federal Government, therefore, it is that Kaduna State Government that will decide if it wants to release him or not. That's no longer within the power of the Federal Government.

Here is a summary of what has happened in the El Zakzaky case.

1) There was a conflict between supporters of Zakzaky and the Nigerian Army in which many people died. It occurred in Kaduna.

2) The Federal Government subsequently arrested Zakzaky and he was detained by the DSS.

3) The Kaduna State Government set up a panel of enquiry into the conflict.

4) Zakzaky’s lawyers filed several lawsuits against the Federal Government because the government was detaining him illegally. They even filed a suit at the ECOWAS Court of Justice. The judges in these cases ordered the Federal Government to release Zakzaky, but the government did not.

5) The panel of enquiry set up by the Kaduna State Government submitted its report and the Kaduna State Government subsequently charged Zakzaky with murder. The Kaduna High Court judge ordered that Zakzaky should be kept in the custody of the DSS.

6) The Federal Government said that Zakzaky was not under arrest; rather he was in protective custody.

7) The pressure on the Federal Government eventually became too much and it could not ignore it, so it washed its hands off Zakzaky.

8 ) Zakzaky’s lawyer, Femi Falana, filed bail applications on 3 occasions. The first two were rejected because the court ruled that Zakzaky was standing trial for murder, which carries a death sentence and so he is likely to flee if he is granted bail. The third was rejected because Falana did not include a medical certificate in his application.

9) The court eventually granted bail to Zakzaky so that he could be treated in India. His lawyers had presented evidence that Zakzaky and his wife were in a very bad condition and they could die if they were not flown abroad. The Kaduna State Government opposed the bail application, stating that Zakzaky could be treated in Nigeria.

10) Zakzaky was flown to India in accordance with the court order. However, problems arose when he got to India. The Indian Government said that Zakzaky tried to have meetings with people that he was not supposed to meet with (including Iranians). Zakzaky said that he had more freedom when he was in Nigeria and that being in DSS custody was like being in a hotel, while the Indians were treating him as if he was in prison. He also wanted to change hospitals at the last minute but the Indian Government refused. Zakzaky then said that he would prefer to return to Nigeria.

11) Zakzaky was returned to Nigeria.


12) The Nigerian Government apologised to the Indian Government for Zakzaky's behaviour.

The war is a proxy war between Saudi Arabia and Iran; Nigeria is the battle ground. Saudi Arabia is using the federal government while Iran is using El-zakzaky. Do you think the non-muslim will not be affected in the course of their fight?

This is selective justice system Buharis Government is practicing. If not for the US intervention, i am very sure sowore and Dasuki would still be in jail and they will give one foolish excuse like "we can't release them, what If as he is coming out a car knocks him down" SMH.

The likes of BBQ sellers are adamantly supportive of this government. Makes me to wonder if
1)they are just that stupid,

Just imagine! No even the courts should determine El-Zakzaky's case as done in the case of Dasuki & Sowore but now a midget governor?

The release of Colonel Sambo Dasuki who has been in detention for about four years, and Omoyele Sowore, who has been detained since August, 2019 by the Nigerian Government is salubrious for democracy.

The recent decision of the Government to comply with the orders of some municipal and regional courts for the release the above mentioned personalities is good for the stability of the Nigerian Democracy.

Every responsible Government will respect the fundamental rights of all citizens and will adhere to the rule of law.

No country can survive in isolation;all Democratic Governments must not forget the International standards on freedom of religion or belief.

The primary sources of law underpinning the mandate of the Special Rapporteur on freedom of religion or belief are article 18 of the Universal Declaration of Human Rights, article 18 of the International Covenant on Civil and Political Rights and the Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief.

Again, Sections 38 and 42 of the Constitution of the Federal Republic of Nigeria, 1999 (2011 as amended) are very clear on aspects of right to freedom of religion and freedom from discrimination.

No doubt that the Constitution is the grundnorm and makes those rights inalienable and non- derogable, except and unless on constitutional grounds.

The leader of the Islamic Movement in Nigeria Sheikh Ibraheem El- Zakzaky, and his wife, Hajiya Zeenat Ibraheem who were arrested since December 2015 during a military operation in Zaria, Kaduna State are still in detention and are yet to be freed.

Government should also comply with this court order, release them and stay clean from selective justice. As the saying that goes, we are all are to be subjected to law not slavished to it and to be ruled by law not ruined by it.
