The Governor of Central Bank of Nigeria, Mr. Godwin I. Emefiele risks being committed to prison for failing to honour a Garnishee Order Absolute to pay the balance of $53m due and payable under the said Order to Mr. Joe Agi (SAN) and team of lawyers that facilitated the Paris Club fund matter for the Federal Government.

Justice I. E. Ekwo of the Federal High Court, Abuja, had on November 20, 2019 under form 15, issued the judgment summon to Emefiele in a case with suit no: FHC/ABJ/CS/1193/2017 instituted against Central Bank Of Nigeria as Garnishee/Respondent, Linas International Limited and the Hon. Minister Of Finance as Judgment Debtors Garnishees by Mr. Joe Agi Judgment as Creditor/Applicant on behalf of a team of benefitting lawyers.

This order is coming barely 48 hours after an Abuja High Court, presided over by Justice Jude Okeke, sentenced the Director-General of the National Council for Arts and Culture (NCAC), Olusegun Runsewe, to prison in a ruling on a motion drawn from a suit filed by Ummakalif Limited against Minister of the FCT, Federal Capital Development Authority (FCDA), DG of NCAC, and the Minister for Culture and Tourism, as the first, second, third and fourth defendants respectively.

This judgment summon, which was issued by Justice Ekwo and made available in Calabar at the weekend said: “the plaintiff/judgment creditor obtained Garnishee Order Absolute against the Central Bank of Nigeria in this matter on the 5th day of July 2019, for the sum of $70,000,000.00 (Seventy million US dollars) and the same sum remains partially unsatisfied till date to the tune of $53m.

“The Judgment Creditor has filed an affidavit in this Court, a copy whereof in hereunto annexed, wherein it is alleged that you the above-named Godwin Emefiele are liable (as the Governor of the Central Bank of Nigeria, the Garnishee) to pay the sum payable under the said Garnishee Order Absolute…”

It would be recalled that there is a judgment on Paris Club fund, where the Federal Government approved the payment of money, and the court ordered that they should pay 20 percent of the fee to be paid to a team of lawyers, led by Agi. But the CBN governor ignored the order and paid less to all the lawyers out of the total sum of $70m.

This man knows those judges that can do dirty jobs for him. When you know the kind of person a man is, you will surely know the motive behind every of his actions.

Mr Joe Agi, a Senior Advocate of Nigeria has opened up on the $30,000 he deposited in the account of the suspended Chief Justice of Nigeria Justice Walter Onnoghen.

Mr Agi in a statement explained that though he convinced the suspended CJN to open the said domiciliary account with the Standard Chartered Bank ten years ago with initial deposit of $30,000, but insisted that the said deposit was never a bribe to the CJN.

Court order the CBN to pay 20% of the Paris club fund to the team of lawyers involved in the case but CBN Governor pay lesser amount to them.
But did this $53m represent the whole 20% of the said amount or the balance of the amount paid so far.
Lot of figures all over the places and doesn't reflect in the lives of common Nigerians.

Las Las somebody might be jailed for disobeying court order which is very common with this current administration.

Neither do they know what is a Garnishee order absolute.

In simple terms- Garnishee order arises when a court instructs a third party (the bank) to pay a creditor a certain sum on behalf of the debtor. In this case, CBN is to pay a team of lawyers on behalf of FG (debtor).

GTB has a similar case with Innoson.

Failure to do so will attract consequences.

What I don't understand is why Emefiele would go to jail. What happened to entity concept?

Emefiele is different from CBN. It is just like Segun Agbaje going to jail for failure to pay Innoson a sum.

This is how garnishee order works. Lets say Mr. Okeke owes Mr. Obinna 20 000 naira. Now Mr Okeke is employed by Mr. Chukwudi. So the court tells Mr. Chukwudi to remove 20 000 naira from Mr. Okeke's salary to pay Mr. Obinna. Mr. Chukwudi (Mr. Okeke's employer) is the third party who is directed by the court to pay the debt owed by Mr Okeke to Mr. Obinna.

In this case CBN governor, Emefiele, is the third party. And the federal government is the one that owes money to the team of lawyers. So the court has instructed the CBN governor to take money that 'belongs' to the federal government and use it to pay the money owed to the team of lawyers.

Garnishee orders are very common with child support payments. If a parent fails to pay child support, the court might tell the parent's employer to take money (owed to him in salary) and use it to pay his child support debt.
