what is happening again? this man really want PDP to lose bayelsa else why would he be contesting against the primary. had it been that APC were still in power there, would there be a court case the guy should know that court could chase PDP from office. I smell APC handwork

Bayelsa knows no development because of political interests and madness..

Facts of the Case:

Ndutimi Alaibe made three prayers:-
1. That the PDP guber primary be nullified on the premise that the Ward congresses of the PDP was not well-conducted and did not follow the constitutional guidelines of the party.

2. That the inclusion of the local government elected officials as members of the delegates was illegal.

3. That the inclusion of the ad-hoc delegates was suspect and nkt in tandem with the statutes as labelled in the PDP guidelines, the Electoral Act and the Nigerian Constitution.

He furthermore stated that the PDP constitution , Section 50(1): "The NEC shall, subject to the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended), Electoral Act (as amended) and the PDP guidelines, formulate guidelines and regulations for the nomination of candidates for elections into public offices at all levels and shall be the final authority for resolving all disputes relating to the choice of candidates for the party for any election."

I agree but it will be too glaring and open and may likely cause chaos but as it stands even death can't arrest that judgment from being delivered.expelling him from the party will also not work because as of when he filed,he was a member of the party except he defected.in amaechi vs omehia and araraume vs pdp,pdp expelled amaechi and araraume but the apex court still gave them victory.if you read their rulings,it was one of their reasons for the judgment

I have been looking into it since afternoon.....

Again, Alaibe argued that, the ad-hoc delegates election was flawed procedurally. In many cases, the court has opted that is a domestic affair of the party.
The Court will only decide on the matter if the SWC and NWC are at variance with the list.
Example: Kashamu & Ors v PDP & 3 Ors
Ekiti PDP before Justice Taiwo
Chime v PDP

Once the National Working Committee agrees with the SWC, the Court most times especially when the onus of proof is on the claimants to show evidence. There is none.
Struck out.
You know how difficult it is to prove these things.

Alaibe has gone to the Federal High Court, Abuja on July 10 via a motion exparte to halt the LG elections that was to hold on Aug 10. The Court granted it and adjourned till October 19.

The Bayelsa SIEC went ahead saying they saw no notice.
Again Rule 12(1) of the Court says:
"No order made on motion exparte shall last for more than 14 days after the party or person affected by the order has applied for the order to be varied or discharged or last for another 14 days after application to vary or discharge it has been argued."

The SIEC is an independent body as highlighted by Odili (JSC) in one of her submissions and hence the Bayelsa State Govt and indeed Diri cannot pay for the miscommunication between the FHC, Abuja and Bayelsa SIEC.

Alaibe didn't stop there, he also approached the State High Court in Bayelsa to bar the elected LG officials to vote at the Congress and Justice Eberiyi Umukoro in his words: "This court has no jurisdiction, the matter is political, domestic and ultra-vires" (link reproduced).

It was further expanded at the 2017 Convention to include:

Are you OK or you just want to embarrass yourself or its hatred for apc? Pre election matters just like election matters must be dispensed by a high court not later than 180 days.he filed on the 13 of september which means it is within time range until between 13-20 of march and the court will deliver judgment on the 10.so many ignorant fellows lurking around

It's not yet 180 days. I think Mar 13 or 14 will make it so.

That is why i said it depends on evidence adduced before the courts.The courts have ruled that while parties can manage their internal affairs,it must be strictly according to their law and once they bring cases to courts,they are at the mercy of the courts.the supreme court has frowned at arbitrariness of parties severally.

Before the primaries,a delegate list was prepared and accepted by all.dickson allegedly inflated the figures days to the primaries,that is very fatal and undemocratic.
What pdp agreed at their convention must still be included in their laws.the number of voters at that primaries is allegedly more than what was earlier agreed,there was overvoting like in osun.

You called a federal high court judgment,a jankara ruling but the ones that were dished out against oshiomhole are in order? Again,you are an annoying fellow.what happens to a court order being always followed no matter how absurd it looks?

You take these things too personal....

Calling a FHC judgement Jankara is absurd, and withdrawn.

I didn't see the already prepared delegates list before ..the delegates list is online.

Alaibe has to prove it.
It depends on what his people write and prove.
