Your landlord or landlady is correct.
We've 12months, so from April to March is a year, if it's April to April is over one year and a month. You can't calculate how you celebrate your birthday with that, all calculation are different.

Once you paid your landlord, your money has been counting or else if there's any issue concerning what you paid for.

Next time don't argue with your landlord, you knew that you paid him April previous year then tell him that you would pay him. By April-May pay him then tell him you're sorry, indirectly you've satisfy your self by paying April to April. Chikena

I am a lawyer called to the bar in 2008.I have been practicing law for 12 years now. I am shocked at the level of ignorance exhibited by some folks here even after being corrected.
Under the Nigerian tenancy laws, a year is 365 days ie 12 calendar months. The OP paid for 1 year which makes him a yearly tenant.
A yearly tenancy expires on the eve of the anniversary of the tenancy.In this case the OP's tenancy became operational on the 18th of April,2019. The tenancy therefore terminates without more on the eve of the anniversary of the tenancy which is 17th of April 2020.
That is complete 365 days or 12 months.
Even if he paid on the 29th of March the law will take the last 2 days of the month into cognisance in detemining the computation of 365 days.
Any other calculation is erroneous.He is entitled to pay his rent latest 17th of April, 2020.

Now if he does not pay by that date, his tenancy expires on the basis of effluxion of time. If he holds over without paying after that date he becomes a tenant at will and is entitled to 7 days quit notice.His landlord still has to go to court to apply for a notice of owner's intention to recover possession.

However where by reason of the tenancy agreement the tenant pays on or b4 the expiration of his tenancy, the tenancy continues and remains extant for another year that is assuming he still pays for 1 year.

I hope this settles the controversy. If you argue after this then you have a special bed space reserved for in Timbuktu.Dont mention pls

If you pay money or enter a property, it does not count on that. What matters is the terms (date) on the tenancy agreement, where the date of the tenancy agreement being created, term of tenancy (begining and expiration date) amount of rent paid are explicitly stated while the landlord/landlady is mandated to issue you a copy alongside a receipt evidencing payment of rent and the terms (date) stated clearly.

As a batch C 2014 youth corp member, we started our orientation camp on the 4th of November 2014 and we rounded up our service on the 3rd of October 2015, which is exactly 1 year. A year is January to December and not December to December.
So your landlord is correct.
A year is Jan. 1st to Dec. 31st. New year starts from another Jan. 1st.
Now using your service year, new year is Nov. 4th and the year should end in Nov. 3rd so that another new year can start on Nov. 4th another year. So, the landlord is wrong

I was surprised when someone that claimed to practice that same law said Nigeria tenancy rate according to the law is 11 months.

i have been a member of nairaland since 2008 and have only replied to a post once, but it saddens me to see the comments over this issue. if it is this difficult for Nigerian youths to calculate the number of days that makes a year, I think this old men should keep leading us.

a year ends the day before the start date on the next year. the land lord was wrong.
please check expiry date of motor particulars to confirm how it is being calculated.

If his tenancy didn't start April first, then it is not a full year yet.

If he paid 6th of April, his rent doesn't expire till 5th of April the next year (365days)

I swear down. After all explanations people are still saying the tenant is wrong. We have given them all explanations, citing tenancy law 2011 to them. Even someone posted a screen shot of the tenancy law on notices to quit here, but they feel they know more thay we that are into practice.

No wonder we have many landlord and tenant cases in court wasting pleasurable time that could have been used for better things.

Thank you barrister for your input. I know many don't even know they become tenant at will at that instance.

How will you live in someone's house for free 6 months. Even before God and man, it is wrong.

A calendar year is January - December not January - Jamuary

If you paid rent in April 2019, you next rent will be in March 2020.

Birthdays are different for those using beer parlour logic above.

Oga house rent payer, my rent is from 15th Sept. to 14th Sept. yearly. I am expected to renew every Sept. 15th. The op is expected to renew every 18th of April. This is simple logic.

He moved into the house in April and has to pay the rent for April so you start counting from April.

You are wrong. If he moves in April 1st, rent should expire at the end of March. Now, he moved in April 18th, rent is now expiring March 20th. How come?
Rent should expire on April 17th. Mine is from Sept 15th to Sept 14th yearly.

Some of you are not smart and it shows. January to December makes a year truly but the true picture is that January 1st to December 31st (11:59) makes a year which is just a day difference. Not a month difference. If you pay your rent on January 1st, it expires December 31st, not December 1st.
OP your Landlord is either confused or intentionally obtuse, try to enlighten him and if he choose to be intentionally daft please find a good lawyer and sue him.

So if you went to lodge in an hotel, when does your time start to count isn't immediate you pay and enter, except booking ahead of a particular time or period. So if you pay for house rent your money start to count or if there's any challenges on what you paid for it won't count. Properties agencies count base on English calendar not the birth calendar. They count in 12months not 13months, January to December is a year that we all knew right, we can't say January to January a year. Get it right bro
