President Muhammadu Buhari has called for urgent measures towards the speedy trial of cases and decongestion of custodial centres in the country in view of COVID-19 outbreak.

Buhari in a letter to the Chief Justice of Nigeria, Justice Ibrahim Tanko Muhammad, drew his attention to the recent call by the United Nations.

He said, “From available records, the inmates population at various custodial centres across the country presently stands at about 74,127 out of which 52,226 are Awaiting Trial Persons (ATPs).

“Most of these custodial centres are presently housing inmates beyond their capacities and the overcrowded facilities pose a potent threat to the health of the inmates and the public in general in view of the present circumstances, hence the need for urgent steps to bring the situation under control.

“In view of the above scenario, it has become imperative for Your Lordship to request State Chief Judges to embark on immediate visit to all custodial/correctional centres within their respective States to identify and release deserving inmates where that has not been done already.”

The President noted that during such visits, the chief judges are to consider conditional or unconditional release of ATPs who have spent six years or more in custody.

He said, “ATPs who have no confirmed criminal cases against them, aged inmates and terminally ill may be discharged.

“It is expected that particular attention should be on the aged, those with health issues, low risk offenders, those with no sufficient legal basis to remain in custody, inmates convicted for minor offences with or without option of fines and inmates who have less than three years term left to serve having served a substantial term of their service for offences that attract five years and above.

“Payment of fines may be made in favour of inmates convicted of lesser offences with option of fine, who are in custody because of their inability to pay such fines.”

Buhari said a report on the proposed visit is expected to be forwarded to the Presidential Committee on Correctional Service Reform and Decongestion Secretariat, Federal Ministry of Justice, Abuja, for compilation and onward transmission to his office.

My suggestions

1. Release first-offender suspects on Awaiting Trial Persons list who have already spent or exceeded the number of years they would have served if convicted.

2. Introduce concept of PAROLE into our criminal justice system. A prison inmate can earn an early supervised release if he has served more than half of his sentence, he is of good behaviour or if young, has applied himself to and making impressive progress in academic pursuits or gained proficiency in a trade. Routinely granting parole to deserving prisoners will reduce overcrowding gradually over the years.

3. Expand, upgrade and equip our prison facilities to truly be correctional centres rather than semi-dungeons.

Something they should have done since.

Hopefully they stick to releasing those being held on non-violent charges or are deemed to pose no immediate threat to society.

This is a good move.
Usually many of the inmates awaiting trail are innocent but they spend years awaiting trail in the dungeons undecided poor souls.

Right step in the right direction.

We the prison ministers always goes through difficulties mentoring, counselling and meeting the needs of these large crowds of inmates.

Is just God that always gives us the grace, wisdom and money to continue to attend to them.

In many occasions you will discover that is minor cases that makes some one to stay in awaiting trial for many years without been attended to.

Please let them do something urgently.

Can someone inform Buhari that this is a democracy and he can't order the CJN around? If he wants to give pardons he can and should without overstepping his constitutional bounds.

Please I'm not against the government releasing the unlawfully detained individuals or those awaiting trials but Some of those awaiting trial might be guilty of the crime they're been charged for. You want to release these people into a society in which we're struggling with an increase in crime rate since the onset of this pandemic in our country. You're releasing them into a society where everyone is struggling to survive because of the lockdown and the hunger that has come with it. Is it just to release them, what plan do you have to keep them off the street or from being lured into crime,do you have any plan to provide for them. This is not the right time to make decisions of this kind that would affect the masses. With all due respect, I think Mr President should review his decision.
This is definitely not the best time for this, Mr President you're making a move that would lead to public unrest on a long run. As a nation we're already heading towards anarchy and this would be a great determining move.
