Sorry sir.that of imo is different.go back to the first page and read what kahal posted.the case was purely between nwosu and AA.APC and uzodinma were never parties to that case and it is a universal principle that judgment cannot be binding on someone that was never a party to that case.the case was purely about double candidature.when ihedioha lawyers raised this issue,the court answered them.

Mind you after the imo APC primaries,nwosu went to court and it declared that uzodinma was APC candidate.it was never appealed so this matter ended there at the high court.the supreme court ruling is invalid and null to the extent where it concerns APC.it is just like the supreme court ruling today that buhari is not qualified when the electoral calendar for 2019 elections has passed and when there was no originating case from the lower courts.

the zamfara and bayelsa governor came in to power because the stupidity of your APC chairman Adams oshiomole but imo state governor was given to a 4th place person uzodima as a birthday gift by chief injustice of Nigeria TANKO MUHAMMED.

Whether the person came second, third or tenth is irrelevant. The fact remains that the current governors of Zamfara and Bayelsa did not come first when election were conducted and they have no business ruling without the Supreme Court judgement. They are all Supreme Court governors.

A layman like me in law knows there is fraud here, if the Supreme Court admitted that both APC and AA submitted Nwosu as their candidates thereby disqualified him on that on the bases of that why won't they at the same time disqualify APC for submitting two candidates for the same election, plus the fact that there is no way Hope would have legally scored 98/99% of those 388 controversial polling boxes.

The person I explained the case for has understood,I don't know for you.immediately the APC primaries ended,it went to court in 2018 and the court ruled against nwosu.he never appealed but ran to AA.they now took him to court after the elections and in January this year, the apex court ruled against him and said he actually was APC candidate. But since APC and uzodinma were not involved in the case,it had no effect on them plus the case was never about who was APC candidate.

It is just like arsenal match yesterday.the fa now after reviewing the offsides say vardy goal was offside and arsenal should have won and that nketiah red was a wrong call but it is too late

The people who went to court knew they have no case. Like I wrote in my initial post, the case was instituted to distract the governor and get people like you excited. It is dead on arrival. Uzodinma will remain the governor of Imo state (except death occurs) till 2023 and there is nothing anybody can do about it.

In Amaechi's case, the Rivers PDP was not factionalized, unlike what happened in Imo. There was only one primary.

The SC only declared Ameachi the validly-nominated candidate citing irregularities in the process that produced Omehia.
Hence, while the PDP retained their mandate, (as elections in the eyes of the law are won by parties and not candidates), Omehia had to make way for Amaechi.

In stark contrast, 2 separate factions in IMO APC conducted 2 primaries, with one producing Nwosu, and the other Uzodimma.
At the climax of the litigation, Tanko's SC declared the faction that produced Nwosu the authentic faction thereby effectively nullifying Uzodimma's candidacy.

However, Nwosu too was disqualified on the ground of dual-candidacy (having also featured on AA's ticket).

The implication of the above ruling was that the APC had no candidate for the IMO guber since their authentic candidate, Nwosu got disqualified.
The question now is since our electoral laws make no provision for independent candidacy, under which party's platform is Uzodinma currently serving as a governor? cheesy grin

The IMO mandate theft was a culmination of a well hatched-up plot.
Knowing the amount of followership that Father Mbaka commands in the SE, he was drafted in to douse a potential tension they knew the fraudulent judgement would raise, while trying to hoodwink gullible Nigerians into believing he got some non-existent revelations from God.

However, the father marries a second wife and that second wife gave him another son. And now , the Son overseas comes home, demanding his Traditional due rights . And now you saying, to avoid any confusions, fighting that might occur to just continues to allow the second son to keep all the necessary Traditional rights due to the first son, right!!

That was when the tribunal ruled that he did not win the initial election into the 5th Senate, which he already enjoyed to the fullest.

“Therefore, what we did in 2010 was to amend the Constitution to set a timeframe for filing, hearing and delivery of judgment/returns on election petitions.

“Such petitions must be filed within 21days and judgment must be delivered within 180 days from the date of filing of the petition.

These people are very right o. I've kept wondering how come they all forgot this. Okorocha's faction got the legal recognition - up to Supreme court - that's why he is in Senate. Now, that his same faction produced Uche Nwosu, who is the de facto, legitimate APC candidate and has since been disqualified by Supreme court for double nomination, meaning that APC had no candidate in that election. So after removing APC, whoever had the highest valid votes in that election is the winner.

Hahaha! You nailed it and finished it totally! What you said is exactly same as what I earlier posted. The issue is a very simple thing. Except Supreme court reverses itself that Okorocha's faction is no longer the authentic faction (in which case, Okorocha will now have to vacate the Senate!), then APC had no candidate in that election. Can you see how Supreme court folks are just causing confusion and now even embarrassing themselves?

APC said then that the primary that produced Hope Uzodinma was the genuine APC primary.

APC denied the primary that produced Uche Nwosu as APC guber candidate.

xBut the supreme Court said the primary that produced Nwosu was the genuine one.

When the case comes up for hearing, Uzodima's lawyers will most likely raise a preliminary objection that the case is time barred and therefore the FHC lacks jurisdiction to hear it. The court would definitely agree with them and strike out the case. This is because...

Section 285(9) of the 1999 Constitution is clear on this. This section provides:
285(9):-

“Notwithstanding anything to the contrary in this constitution, every pre-election matter shall be filed not later than 14 days from the date of the occurrence of the event, decision or action complained of in the suit”.

To activate this constitutional clause, a pre-election suit must be filed within 14 days from the occurrence of event or cause of action.


Once the 14 days lapses, the court have no jurisdiction to entertain it. Therefore, a cause of action is statute-barred if legal proceedings cannot be commenced in respect of same, because the period laid down by the limitation law had elapsed.
