Musician, Oladapo Oyebanjo, aka D’Banj, is forging ahead with the N1.5bn libel suit filed against Miss Seyitan Babatayo, who accused him of rape, despite the latter withdrawing a petition submitted to the Inspector-General of Police.

D’Banj’s lawyer, Mike Ozekhome (SAN), disclosed this in an interview with Saturday PUNCH on Friday.

“They withdrew their petition but the police said they could not prove a case of rape against D’Banj. This fact should not be hidden. It is based on this they are begging him to withdraw the case but I have not received any letter from my client asking me to withdraw the case. So, the case in court is still alive,” Ozekhome said.

D’Banj had on July 3, 2020, filed a defamation suit before an FCT High Court requesting the court to order Seyitan to tender a letter of apology for the accusations directed at him, which he claimed has caused him “embarrassment, ridicule, derision, marital disharmony, mental agony, and psychological trauma.”

Seyitan, who had accused D’Banj of raping her in 2018, later wrote a letter to the IG withdrawing the petition.

In his response to the letter, the IG through the Deputy Commissioner of Police (Admin), Umar Sanda, said investigation had discontinued due to lack of evidence.

The letter posted on Twitter by blogger, Kemi Olunloyo, read in part, “In view of the foregoing facts, investigation was discontinued as no substantial evidence to prove the allegation of rape against the suspect.”

Human rights group, Stand To End Rape Initiative, popularly known as STER, said Seyitan decided to end the case without receiving any monetary compensation.

STER, which was actively in support of Seyitan’s quest for justice, thanked everyone.

The statement read in part, “On July 13, 2020, Ms. Babatayo (Seyitan) informed STER that a private non-monetary agreement was reached with D’Banj’s team. We, therefore, present this statement as the full account of our stewardship on this matter.”

Seyitan had accused D’Banj of raping her at Glee Hotel, Victoria Island, Lagos in December 2018, an allegation he has denied several times.

Speaking with Saturday PUNCH on Friday, a lawyer to Seyitan, Mr. Tommy Ojoge-Daniel, said D’Banj had yet to effect service on his client.

Ojoge-Daniel said his client decided to withdraw the complaint against D’Banj for personal reasons. He, however, said they would not be intimidated by the N1.5bn libel suit.

“We have not yet been served with the processes. However, we are not afraid of any libel suit. Our client only decided to withdraw the petition for personal reasons,” the lawyer said.

hmm!

There are abusive individuals whose worst little demons are greed, sloth, envy, gluttony, pride and wrath enslaved by their god which is money. They usually set their false assumptions, wrong judgments, gossips and lies forceful than the ones who hold the truth but what they missed out is that the victims of their aggressions, the targets of their wrong accusations and the recipients of their repetitive harassments carry what is truly essential and what lives longer, that is: truth and goodness, both of which shall always prevail against their vicious, evil manners.

This is very good. Dbanj should sue her with everything he's got. Women like this have sent men to their early graves for no reason.

Let her prove her innocence in court not social media.

They turn small boys into Rapists, when they grow and display what they learnt, you start hearing Say No To Rape! Balderdash.

We are patiently waiting and watching how this will end at last.

Only senseless people will be supporting either of the accused or accuser, not even the hotel staff!
Only if you are in the room with them watching on the said night can you have a say.
Not typing rubbish from your bed or couch at home.

Let Justice prevail for whoever is saying the truth.l among these 2 people.

All of us @ SAY NO TO RAPE AND SAY NO TO FALSE ACCUSATION OF RAPE.

They are both deadly!

As he rightly should.

The current trend to name and shame rapists should not be used as a cover for false accusations.

This exact reason I always say all this social media trial will only damage image of rape case

All this oloshi them dey use rape accuse dey do play play as if its a game. If u can't file a rape case with tangible reasons beyond doubt pls better hold your peace and allow your faith cos accusing such case put doubts.

Rape is a serious crime not just a crime but an unending emotional one. The way media trial of rape in going in Nigeria in future will start putting so much doubt that will soon bring laws that may somehow frustrate real rape cases.

I strongly think anti media case rape case should be put in place. If u feel raped, go straight to police or file a case in court and don't start media trial first.

Am sorry if my comment offend anyone
. Just try read it in a reasonal manner u may get the point

Why the girl withdraw the case if e sure for her?

She was probably just looking for cheap popularity and attention and it seems like she's stepped on the wrong toes.

Money wins again. He intimidated her with police and had access to better lawyers due to his wealth. The poor girl realized she didn’t stand a chance so she withdrew the case hoping to just forget the matter.

But this mans ego is so big and his heart so dark he just can’t let it go. He wants to finish her off. Sad.
