The last time I checked, stealing means taking what does not belong to you.

Avoid unnecessary police wahala embarrassment and court cases over bunches of banana that may not cost up to 10k.

Just tell the owner to come carry his load or push it back over the fence.
The banana has trespass which is punishable under the law, the banana and the owner are at fault here and they are liable to pay fine for trespassing into your compound(property)

You either cut it and take to the owner or you call the owner to come and cut it... It requires no rocket science to solve...

look at it from this angle
a hen flew and land in your compound. it's still not your hen. the best thing to do is free the hen or call the hen owner.

you know why ? I'll tell you .


There's a banana tree next door to where I live .This tree overhangs my premises .
Every morning I have to sweep up the dead leaves of the next door .
Now this banana tree has two lovely bunches of fruit in it. The two lovely bunches overhangs my premises. I love bananas and my children love bananas too . If we have to sweep up the dead leaves from the tree ... surely we are entitled to some compensation for our trouble? suppose one day .... I cut down one of the bunches and eat the bananas. After all ... we did not go into our neighbor's compound to cut it . we found it in our yard . what would the law say about it ?.



The law would say I have converted another man's property to mine . which is a round about way of saying I am a thief .
As far as the law is concerned , even though the banana bunches overhang my premises .... they do not belong to me .



But I say to the law ..... what about the dead leaves I have to sweep up every morning?
has the tree that does not belong to me right to litter my premises ?
And the law replies , That's a different matter ; the law allows you to cut down the overhanging branch because every owner of the premises also owns the space above it .
If your neighbor's branch overhangs your premises , That's an infringement of your space .



All this is puzzling me . so I say to the law ,
if I cut down the offending branch , the fruit will be lying on the ground , and will become rotten if they are not eaten .
And yet you say I must not eat the bananas. They belong to my neighbor. After All it was his tree that bore them .



so there it is - the law at its silliest . I may cut down the bananas but I must not eat then , indeed ! I came across this but of law in an old boom written by a lawyer or the layman that is you and me .
And the feeling I got after reading this book was that the law is the most complicated business one can ever involved in .
No wonder they need lawyers to interpret them .


one if the most risky things a person can do is defend himself in court . He may think his case of a straightforward ....but in law nothing is ever straightforward.
