Hello everyone, I kindly crave the indulgence of anyone reading this as this is going to be one very lengthy post.

I'm posting this on behalf of an aunt of mine who has been going through a very difficult time, due to issues emanating from loosing her husband ten years ago. Its been quite painful to watch her go through so much injustice from her late husbands family and so I'm posting this in the hopes that experienced readers would be able to proffer solution(s) that could very well solve this problem once and for all.

Her husband died leaving a Legal Will that was drafted by a proper Lawyer and due to trust, her husband instructed that one of his brothers be made an executor to the said Will in conjuction with the Lawyer, but just as we see in most Nollywood movies immediately after her husbands demise, the entire family swooped in demanding to take total control of her late husbands properties with her brother-in-law who was made an executor to the will leading the pack.

In her bid to stand up to them, she quickly handed over the documents of the properties to the Lawyer for safe keeping, but this didn't dissuade her brother-in-laws from their continuous assualt in their attempt to take charge, and this in turn led to the unsuccessful attempt of the Lawyer to read the Will on multiple occasions . When the harassment became unbearable, she made the decision to leave the house she had been living in with her late spouse to a different state taking all her kids (4) who were still underage at the time.

Her leaving infuriated her in laws the more as she was now out of their reach and while she hoped the whole issue would subside after a while, it only got worse as there became an internal battle within her late husbands family over her husbands estate, leading to series of police and court cases, with the main pioneers of this conflict being her late husbands baby mamas who had kids for him and in their bid to also take charge of the properties had turned on the family.

Seeing how the tables had turned, attempts were then made by her brother-in-laws via phone calls directly and through their legal representative for her to join in the legal tussle, but she had about had enough and adamantly refused to join in and at some point even contacted the family Lawyer who had drafted the Will to hand over all the documents in his possession to her in-laws just so she could be left alone, but the Lawyer refused to heed to that instruction saying that would go against the interest and wishes of his now deceased Client to let go of everything he tried to preserve for her and her kids.

According to her narrative, everything went quiet for sometime until after about eight years when she was contacted again by one of her brother in laws, the one who had been made an executor to the Will and subsequently the family Lawyer that her presence would be required as the family had finally agreed for the Will to be read.

The Will was read and by virtue of what was contained in it, adequate provisions had been made for her and her kids, including the kids her husband had outside their marriage, but unfortunately some of the properties had been encroached upon, vandalised and sold in the years that had gone by especially by one of the other women who had kids for her husband.

A family meeting was held after the reading of the Will in a bid to address this in case any of the beneficiaries were affected by the looted properties, after which the Lawyer was instructed to hand over the property documents so as to finalize the handing over of the properties, only for the Lawyer to refuse on the grounds that he had not been paid for all his troubles and based on that would not be dropping any of the documents. This led to a new disagreement, and my aunt in her way of trying to address the issue requested for the Lawyer to hand over the document to one of the lands so that part of his professional fees from her end could be paid from the proceeds of selling the land because as it stood, she has been struggling financially to cater to the needs of her children, yet this Lawyer refused.

This became a new issue entirely and all her effort to get the Lawyer to hand over the land document proved abortive and at some point he informed her that he had been informed by her late husband that none of the properties should be sold even though that wasn't stated anywhere in the Will and when she turned to her brother-in-laws to step into the matter, she was told that since she was the one who handed over the documents to the Lawyer, it was soley her duty to get them back.

This dragged on for another two years without any positive result and due to the deplorable state of my aunts finances, she decided to visit some of the farmlands that had been given to her and her kids by virtue of the Will just as a means of keeping the family going for the meantime, but to her surprise, upon traveling down, she met some labourers working there who informed her that they had been employed by one of her brother-in-laws to work there and remit payment to him and this had been going on for the past two years after the reading of the Will, and after some family advice, my aunt decided to confront him saying she had come to take over the farm, only for this man to say she won't be able to do that because she ran away with his late brothers kids and until she brings them back, she doesn't have the right to begin operations.

This is definitely one of the most absurd thing I have ever heard in my life for sure, anyways, when we saw that her in-laws were up to no good, we encouraged her to get redress from the human right commission, to which she adhered to and filed a case against her brother-in-laws and the family Lawyer last year but surprisingly the case has been grossly mismanaged, with the officials of the HR insisting that she bring her kids according to the wishes of her brother-in-laws after an official meeting was called, while all efforts by the commission to summon the Lawyer to explain why he has been withholding the documents has been futile.

My aunt has been relentless in her effort to see this matter to an amiable end, and even after going with one of her kids to the commission with her brother-in-laws present, they yet insist that she comes with the rest of them before there can be an handover and while this is yet to be resolved, she has been reliably informed that her brother-in-laws has issued threats and warnings to the farm workers that on no account should they have any dealings with her or make payments to her in relation to the farms.

As for addressing the issue of her family Lawyer, she has gone as far as employing the service of another Lawyer against him, but as it stands, the man seems to have gone MIA as he now refuses to pick her calls and that of her Lawyer and reaching him physically is now out of the question as he has also changed base.

To me and I believe anyone reading this, this matter is quite a simple one but yet so complicated and before anyone screams sue the bastards, my aunt unfortunately doesn't have the financial strength for that and we all know how long court cases could drag on for years unending.

I kindly implore anyone who knows he/she can come to the aid of this widow with measures that would yield results in bringing this matter to a conclusive end to please do so because this has really gone on for way too long.

She need money ... or maybe contact a senior lawyer that will help her with pro bono..

All is legal matters.. what’s the name of the Lawyer .. write petition against him.. then report him to legal practice disciplinary committee... he’s enrollment number can easily be sourced once you’ve got his name.

She has a good case.. but she’s been going about it sentimentally..

She have to wake and face reality.. otherwise she will lose all.
Guess the lawyer has trespass on some of the properties... reason why he absconded..

Get the lawyer first... arrest him on sight.. citizen arrest.. hold him and cramp him till people mob him..

Have your Aunt write to and visit the Ordinary President, Ahmed Isah. His radio program, Brekete Family Programme is aired from about 7:30am to 10:00am Mondays to Saturdays in Abuja on 101.1 FM.

The Ordinary President, Ahmed Isah, will help her get justice if what you have narrated is true.

We must first of all commend your Aunt's Late Husband for writing a will even though he had underage children which is very uncommon with Nigerian men who have the false hope that they won't die and leave behind a young family. The will has been the hope in times of despair and without it, the property of the deceased would have been distributed among his kinsmen years ago with nothing left for his wife and kids.

Despite the brilliance of the deceased and his foresight which compelled him to write a will, it appears womanizing was his Achilles heel. I personally would love to be with many women in future as I plan to earn enough to satisfy them materially, but succession disputes which arise during the sharing of estates have made me conditioned my mind to become a man who will only love and be loyal to one woman when I'm ready.

If the Human Rights Commission advises your Aunt to bring the Kids before they conclude the matter, then that may be the best option for her. It is definitely not legal but we know the reality in Nigeria since a bit of customary law mixes with statutory law and common law in family cases. Remember the Court told Ubi Franklin and his estranged wife , Lilian Esoro , to get back together when they filed for a decree nisi . Also remember the way the executive Governor of Benue State settled a controversial domestic violence case between a Journalist and his medical practitioner wife. Let them see the children and the Human Rights Commission will handle his kinsmen and the Lawyer if they don't handover .

In conclusion, this thread should be a lesson to all men to write their wills no matter how healthy they are and when they do, they should handover the property to a professional trust fund who may administer the property until the Kids become adults while paying proceeds to the mother of the kids for their upkeep from the profit generated from the administration of the estate of the deceased while the kids are not old enough.
It is even more important to mention that men must endeavor to marry hard working, industrious and productive women who would have blossoming and successful careers independent of their husbands. If your Aunt was rich , she would not want the property for now. She'd just deposit an amount monthly for a consistent chain of injunctions which would last for years until her kids grow older. This way , she doesn't make use of the property and the kinsmen of the deceased do not also benefit from it until when her children are grown.


God bless my mother , she has enough property to share for us independent of our father's own.

Herdsmen thanks a lot for this suggestion, However like I stated in my narrative, he has changed his physical base, how would you propose she gets to him because all she has right now is the man's phone number.

As for getting a senior lawyer to handle this pro bono, I doubt if she knows any, if you perhaps know any who will be magnanimous enough to take on her case, please do well to drop his name or information (privately that is). Thank you.

This suggestion was proposed but her Lawyer has been trying to foremost secure a meeting with the man without the intervention of the disciplinary body, but the Lawyer has made himself completely inaccesible. Unfortunately this case isn't within the jurisdiction of Lagos State.

Tell ur aunt 2 report him through writing 2 d NBA of d state dat lawyer is currently practising stating professional misconduct and breach of trust in d carrying out of his duties.
I bet u, d mata would b investigated and if found guilty, he'll definitely b dealt with. If he dosent comply, he's playing with d revocation of his certificate.

Also, ur aunt should approach d ministry of justice in d stare she's presently in. The government offer free legal services through the Legal Aid council to indigent citizens.

Its my humble prayer God sees her through and grantz her victory @last.
