While evil can sometimes be relative there is a general commonality in most cultures to what can constitutes as evil.
Performing an action with the intentions of causing harm, and/or causing irreparable damage with or without intentions.

So per your example someone deficating on an open road doesn't really fall under the category of evil. It may be bad, stupid, or a crime, but not enough to be considered evil.

Now a better example of evil is if I choose to steal the inhaler of someone I knew had asthma.
