I really wish there will be a law that prohibit defections because, whether defecting to APC or PDP, the result is the same: A corrupt corporate government.

A party, or any institution that is in power or in opposition, does all things to get only for its own goal and interests, no matter in a legal way or through illegal resources, like forces, print and electronic media, and negative propaganda among the people , spending the millions of money for this. It is called dirty politics by the support of evil spirits.

First there needs to be a legislation that will clarify who owns the mandate, the candidate or the party.

PDP need not speak about this issue because in the past they’ve courted, aided and abetted defections to their party without the said parties relinquishing their mandate(s).

There's no such law, the courts can rely on.

Except if the NASS pass such law. And even at that, it will still be subjected to subjective interpretation as its not in the constitution.

The only way out is to expressly state it in the constitution that once you change party, you resign whatever position you occupy through the party.

But this will make the parties too powerful, and they may start bullying elected leaders.
These are things ordinary citizens don't know but keep on commenting ignorantly about our constitution. You will hear people saying the constitution is our problems forgetting the fact that the constitution does not operate itself, rather the people and especially the politicians and privileged ones direct it operation.
The politicians will always find lacuna in the constitution to manipulate their way out no matter what type constitution we have.
If we are to go by the spirit of the law, we will realize that there is no portion in our constitution that support defection, however, because every law is subject to interpretation, there is nothing anyone can do when judgement are passed base on fact on ground.
Just look at issue of local government joint account that the state governors have used to cripple local governments system in the country. We all know that whereas the constitution suggests a joint account for the local governments in a state, it does not say the state governor shall take control of the account. What is the practical reality today? Everyone of the state governors have successfully manipulated the process by ''legally'' taking control of local governments' federal statutory allocation to the various local governments within their jurisdiction.
Even in developed democracies, issues like these abound. That's why we must be cautious not to throw the baby out with the bathwater

but their case is different from that of zafara. In zamfara case it is the court that gave the PDP that opportunity after removing APC from the ballot.. so APC has no candidate... My opinion though

There's no law stopping the executives from defecting irrespective of how he got to power.
No governor in this country will lose his seat because of defection. The PDP should get serious before they become empty ahead of 2023.

Whose mandate?Zamfara people voted massively for APC.PDP gained power @ tribunal because of APC pre election party crises but APC = PDP they might decamp back to PDP very soon again

His disqualification by the APC didn't make him to stop being an APC member. Disqualification is not same as expulsion from the party.
