I swear. They are very ignorant, lazy and unpatriotic. I have been reading posts about this for some time now, how Nigerians are praising ÚS could simply arrest Nigerian for alleged crime on nigeria soil. Can Nigeria govt simply arrest American on American soil if reverse was the case?. Nonesense

Do we still practice rule of law in this country? If Yes, then there's absolutely nothing wrong in releasing Abba Kyari to the FBI since you agree they've been a mutual agreement between both countries to hand in criminals in a bid to contain internet fraud.

In addition, how best would you have wanted the US and FBI to go about this particular case?

Nigeria is in the mess we find ourselves today because some people are treated like they're above the law. More reason why our politicians commit crimes and walk away freely b'cuz there's always an exception to the rule when it's them.

A court in the US that was trying the case of Hush Puppy found out in the cause of their judgement that there's an accomplice to the crime back here in Nigeria and they ordered the FBI to arrest the person. Then the FBI contacted our own EFCC which is an antigraft body here. Then EFCC alerted the IG of police and in all of these, there's no way to keep the media out of it b'cuz Hush Puppy's case has garnered public interest already.

So I really don't know what you expected. But on the case of trying the criminal here. C'mon we all know how EFCC and FBI extradite Yahoo boys at will. There shouldn't be any exceptions to the rule. Else, all the noise about PMB anti-corruption fight will be exposed for the world to see. The country already has its reputation tainted and anymore move to take side with a corrupt police head will only cement our sorry reputation as a heaven for corrupt practices.

They can declare someone wanted through Interpol and Mr. Kyari should understand that better than anyone else.
If he dares to show his fugly face anywhere outside Nigeria, he risks being handcuffed and delivered to US authorities.

The issue is that, Nigeria is not being sincere enough of this matter. Why is the creation of INTERPOL. Aba is a good police officer with a lot of achievement. I like him because he has done so much in terms of security in this country. But the justice should have been given more space to determine Aba's capability in this issue so at the end the whole thing will not give Nigeria a bad name and bad representation.

Abba Kyari is a Policeman. Even within the country, it's difficult to try a police in a civil court. As a matter of national security and also integrity, we can not hand over a policeman to another country to be tried. No way!

US Court Can’t Order Arrest Of A Non-citizen Resident In Nigeria

The Police service Commission (PSC) is absolutely wrong if it says that the US Court can not order the arrest of a non US citizen in a foreign country otherwise why was Hushpuppi arrested in Dubai? This arrest is possible through International extradition, which is the formal process by which a person found in one country is surrendered to another country for trial or punishment. The process is regulated by treaty and conducted between the Federal Government of the United States and the government of a foreign country (Nigeria). It differs considerably from interstate rendition, commonly referred to as interstate extradition, mandated by the Constitution, Art. 4, Sec. 2.

Generally under U. S. law (18 U.S.C. § 3184), extradition may be granted only pursuant to a treaty. However, some countries grant extradition without a treaty, and of those that do, most require an offer of reciprocity. Further, 18 U.S.C. 3181 and 3184 permit the United States to extradite anyone including Abba Kyari, without regard to the existence of a treaty, persons (other than citizens, nationals or permanent residents of the United States), who have committed crimes of violence against nationals of the United States in foreign countries.

If the fugitive is not subject to extradition, other steps may be available to return Abba Kyari to the United States or to restrict his ability to live and travel overseas. He would become a prisoner in the ZOO.

So, US Court can order the arrest of a non US citizen abroad who has committed a crime against the US and has done so many times prior to now.

It is strange that an American court would order arrest of a non American citizen, who didn't commit a crime in America, and the crime didn't affect America.

The crime broke American laws. Proceeds of fraud were laundered through the American financial system.
