Joint ownership of Land: What you should know

jointly owned property is a property that the onwers jointly enjoy the use of the property.
Joint ownership of land simply means 2 or more people owning a piece of land. Any right, benefit and claim over the land belongs to the owners jointly and not on individual basis.

E.g jointly owning a land includes land that belongs to huband and wife, father and son, brother and sister etc.

Anyone who purchases a jointly owned land or property from one of the owner without the consent of other owners has purchased a defective property that could be rejected or revoked by the court.
What you have to know is that just one owner cannot sell the property without the consent of all the parties involved.

These are the implications of jointly owning a property

- Whatever improvement that happens to the land belongs to all the parties involved. E.g If one of the owner erect a building on the land, the building must be jointly enjoyed by by all parties regardless of whether he single handed built it.

-The Consent of all the onwers must be sought before any of the joint can sell any part or the parcel of land.

-When one of the owner of a jointly owned property dies, his right to the property cease. The implication of this law is that a joint owner cannot pass his right over the property or portion of the property to another person.
His children or wife cannot inherit his right to the property.

-Joint Owners must enjoy the land together. No one can claim ownership to a part of the land, to exclusion of other joint owner.
