A law to back states’ battle to collect Value Added Taxes, VAT, their right to mine and control their resources, is underway in the House of Representatives.

Several states of the federation, are currently in a legal battle with the Federal Government on who collects VAT on goods and services.

A bill to that effect, entitled “An Act to Alter 39, Part 1 of the Second Schedule of the 1999 Constitution as Amended to Substitute and Move the Item from the Exclusive Legislative List to the Concurrent Legislative List”, sponsored by Reps Hassan Usman Sokodabo and John Dyegh, was exclusively obtained by VANGUARD.

The instrument proposes in part, that “The Constitution of the Federal Republic of Nigeria, 1999, is hereby altered as set out. Item 39, part 1 of the Second Schedule of the Principal Act, Altered by substituting the item and moving it from the Exclusive Legislative List, to the Concurrent List.

“Thus, item 39, Part 1 of the Second Schedule of the Constitution to be moved to the Concurrent Legislative List now read: States Government shall manage their resources, mines and minerals, including oil fields, oil mining, Values Added Tax(VAT), geological surveys as well as natural gas. 50% of the total revenue accruable from the minerals shall be retained by the state where the minerals are derived.

“30% shall be credited to the Distributable Pool Account, while the remaining 20%, shall be credited to the Federation Account”.

The piece of legislation listed for consideration in this legislative quarter, is expected to generate a considerable controversy, sources told VANGUARD.

Where was the bill 2 years ago? Or 1 year ago at least. So if Wike didn't go to court and win, nobody for remember say they should create bill to allow states collect VAT.

It makes sense on paper and sounds like the much talked about restructuring but expect the northerners to frustrate it. I know they just doing all these so the bill can be officially silenced and they can get back fully to one Nigeria business.
If any southerner thinks those who want to resist VAT collection at state level will suddenly support another more impactful form of resources control, then welcome to Nigeria.

Correct but note that LAgos made the move before Rivers (Wike). Lagos state government sued the federal government and the court told Lagos can’t sue the government but the agency in charge of VAT, so Wike had to go after the agency (FIRS).

This doesn't make sense. Which one is 30% going to redistributable account? This is another fraud in the pipe. Let's the states retain 80-90% of it earnings while 10% or 5% goes to the centre. The FG won't be able to borrow or fund useless states. So they will sit-up.

Redistributable account English is another scam to take money from the big earning states and give to the low earning ones while FG retains control on who gets what. FG is trying to play tricks. Doesn't want to lose her hold on states.

This bill is not so much different from what is obtainable now. Na % and English different.

Many still don't understand the write up or the VAT debacle yet they want to write something. Nigerians are very sentimental people that is why we can hardly get things right.

However the proposal by the HoR is a welcome development as it will create soft landing for the over 30 states that are insolvent.

The bitter reality is that if States are to take control of their respective state VAT over 30 states of the federation can't meet up going by their current standing.
Apart from Lagos, Rivers, Oyo, Ogun and one or two States in the SS including FCT, the remaining States are insolvent. Yet their indigenes won't allow us on nairaland about state control whereas their Governors are scared to stand on their own.

Modified: Pls I'm not against States taking total control of their resources but the process should be gradual and intentional.
I've listened well enough to the VAT debacle and it is reasonable to factor out convenient grounds. The FG stands to lose nothing except the individual states.

We need total separation from the North to move forward. We do not have the same goals. A house that is divided against itself will definitely collapse.

VAT is not included in the sharing formula, just mineral resources. No state should share their vat with others.

States (governors) collecting VAT is true federalism, but refusing Local Government Autonomy is not part of the federalism debate abi??

Whether the state collect the VAT or the central, it will still end up in the pockets of the ruling elites.

Go and start learning Chinese now, the govt cannot repay their debts, neither will they stop borrowing.

Let states control 60%, Local Government 25% and federal 15%. If the federal government likes, let it use its own to be funding barren Northern states.

Eti Osa Local Government will buy the entire Northern region.

This bill has got many hurdles to cross. Would the current rubber stamp senate allow this bill to see the light of day or would the nepotistic and tribalistic vegetable in Aso Rock assent to the bill even if it manages to scale all readings?

Good move in the right direction though. Financial autonomy is the first step to true federalism.
