CURTAINS were drawn on hearings in petitions arising from the Ekiti and Osun state governorship appeals on Thursday, with telecommunications giant, MTN Nigeria, reportedly telling the five-man National Judicial Council (NJC) probe panel that its system was impregnable to hackers conducting illegal activities.

MTN’s Senior Manager, Commercial Legal, in the Corporate Affairs Division, Mr Rotimi Odusola, who incidentally was a witness of the President of the Court of Appeal, Justice Ayo Isa Salami, was said to have contradicted Salami’s claim that his MTN mobile line was hacked to call chieftains of the Action Congress of Nigeria (ACN) before, during and after the controversial judgments in the two states.

Salami brought before the panel his court’s Head of Information Communication Technology (ICT), Mr Sheriff Usman, penultimate Wednesday, who reportedly testified that the hacking process possibly used against Salami was “spoofing.”

Spoofing is the practice of causing a telephone network to display a number on the recipient’s phone which is not that of the actual caller.

It is an authorised way of using a subscriber’s line illegally.

Salami, while not denying the conversation with the ACN chieftains, was said to have defended the usage of his MTN line with the spoofing theory, culminating in his invitation of the MTN official to prove that the telecommunications firm was not fool-proof.

Former Governors Olagunsoye Oyinlola of Osun State and Segun Oni of Ekiti State had accused Salami of engaging in unholy conversation in the course of determining governorship appeals in the two states.

Odusola, however, reportedly contradicted Salami by saying “hacking is not possible in our system.”
The MTN manager was also said to have been made to read The Nation newspaper of February 26, 2011 tendered by Salami, in which the telecoms company confirmed that it was not possible to hack into its system.

Confirming the release of the call logs in respect of the case at hand to the National Security Adviser (NSA), the MTN boss, who reportedly said call logs from the organisation were always released on demand, added that such was always released in hard copies, through email or in flash drives to security agencies or to the individual subscribers.

A source privy to the proceedings quoted him as saying “we print the CDR (logs). The exception is we sometime released electronically and through flash drives to the subscribers, police, SSS and EFCC.”

Under cross-examination by counsel for former governors of Osun and Ekiti states, Lekan Olatawura, he reportedly said that MTN prints call logs in standard A4 papers, while he was said to have admitted that when photocopied, the paper “could be enlarged with bolder prints.”

Nigerian Tribune learnt that the MTN manager further confirmed that the entries in the call logs tendered by the NSA tallied with those in the logs submitted by the Osun and Ekiti PDP with their petitions.

He was said to have found it difficult to explain why his company claimed in a letter to the NJC that it did not have call logs earlier than February this year but curiously submitted those of December 2010 and January 2011 to the NSA.

Another set of the same call logs sought to be tendered by the PDP was reportedly turned down by the panel on the grounds that their covering letter was not certified by a High Court.

The panel was said to have announced the conclusion of its sitting on the Ekiti and Osun states matter after Salami reportedly closed his case while the PDP was asked to submit its address on Monday next week.

Justice Salami opened his defence before the NJC probe panel on a dramatic note, as he brought a witness to prove that his telephone line was hacked into to make calls to ACN chieftains and lawyers.

How does this compare to the story of MTN denying the call logs in the first place


A telecommunications service provider, MTN Communications Nigeria Limited, on Thursday in Abuja told the Justice Umaru Abdullahi panel investigating the face-off between the Chief Justice of Nigeria, Justice Aloysius Katsina-Alu, and Appeal Court President, Justice Ayo Salami, that the contentious call log before the panel did not emanate from it.


MTN said it was duty bound to protect its customer’s confidentiality.


Giving his testimony at the panel, the company’s Senior Manager (Corporate Legal Services), Mr. Rotimi Odusola, said he could not confirm the authenticity of the contentious call log which was tendered by the petitioners.


The Justice Umaru Abdullahi panel had been charged with the responsibility of investigating an alleged perversion of justice leveled against the CJN and the alleged unethical behaviour of the as well as other Justices of the Court of Appeal who sat on both Osun and Ekiti governorship appeal panels.


The PCA and the other justices of the court of appeal were said to have engaged in telephone conversations which eventually resulted in the tribunal sacking ex-governors Olagunsoye Oyinlola and Segun Oni of Osun and Ekiti states respectively for which they were replaced by Rauf Aregbesola and Kayode Fayemi.


The call logs were supplied by the petitioners but the PCA said they were mere fabrication.


The MTN officer explained that the telecommunications company, as a policy, only provided such Call Data Records otherwise known as the call logs to only three categories of persons under a covering letter requesting for them.


They are a competent court; the law enforcement agencies and the subscriber that can establish that he is the owner of the line.


Odusola said the contentious CDR did not emanate from MTN, adding that the firm never used the paper on which it was printed.


Meanwhile, the panel has adjourned its sitting to enable the parties to file their final written addresses.

Well, what I can establish from all these is that there were actual calls from Justice Ayo Salami's phone number to some ACN Chieftans. The judge is not denying that but saying he didn't make those calls and that they were enabled by spoofing. The onus is now on Justice Ayo Salami to prove beyond reasonable doubt that the calls were actually enabled by spoofing! grin grin grin grin grin grin grin grin grin grin

I don't want to derail this thread but what is Nigerian Journalist obsession with the word PENULTIMATE? Not sure they even use it correctly, using the word in every sentence has got to stop.

The word is used mostly in present tense to indicate an event is next to the last one or end.

Guy, the tribunal has concluded its sitting. If he wasn't able to prove that in his submission, then he is a gonner. Personally, I am convinced he has a case to answer. He left the Lagos State judiciary for the Court of Appeal and Tinubu is close to his family.

This is not true, Sony was down for weeks due to activity of hackers,pentagon, even lockeed that manufactures most of US war planes were hacked.

have you been living under the Rock all this while? MTN have already declared that the call logs allegations against Justice Salami is Fake. About your personal view that he guilty you can never be a good Judge.

All of una wey dey shout about hacking, how many sites una don hack sef? FBI, CIA and banks have been hacked by pple wey go caltech, Harvard, MIT, etc. They can decipher codes without pen and paper. Na govt dey beg dem not to engage in crime sef in return for cash. How many of those kind pple dey naija. Make I hear word abeg!

Funny! Wen has it bcome a crime, moral or otherwise for a judge to make or receive calls while presiding on a case? Methink d argument should have been d main body or content of d so-called call logs. Did d discussions center on d judgements to be delivered, as in 'Your Lordship dont forget our discussions on d judgement' and stuff like that. Perhaps NJC shld start confiscating d phones of their Lordship until they dispose of d election petitions before them!
PDP and their handlers are just chasing shadows and MTN is fidgetting!

if MTN call records were actually hacked, then the evidence may not be admissible in court because its a product of criminal activity and its authenticity can easily be questioned. Its one the reasons why evidence from torture, unwarranted searches etc are easily thrown out in court
