A case in point relates to the minor involved in the recent school shooting in Michigan, USA. His parents have been arrested because he came to school from his home with the gun on the day of the shooting.

There is almost no vicarious liability in criminal responsibility for no one can be convicted for a a crime committed by another person, so it is impossible for either loco parentis or the school to be guilty of murder, which even the Michigan case prove.

The school is however culpable for not taking the necessary and due action towards preventing the death and suffering of Sylvester.

The age of criminal responsibility in our criminal law is 12 years, not 18.
Kids below 7years, at law, do not to have the mental capacity to discern between good and evil, thus can't commit crimes.
Kids aged 7 and above but below 12 years can be found guilty of crime. However, there is a presumption at law that they do not have the mental capacity to discern between good and evil. Thus, for the prosecution to ground their conviction, they must successfully rebut this presumption.
Kids aged 12 and above are criminally liable as the adults. The only difference is that they would not be sent to the normally prisons, but to juvenile or correctional or rehabilitative facilities. And capital punishment will not be passed on them, that is death sentence.

No, it's not our law to punish somebody for the criminal act of another person, boss. That only obtains in civil action, never in criminal action.
