Falana demands release of Agba Jalingo


Human rights lawyer, Femi Falana, SAN, on Saturday demanded the immediate and unconditional release of Cross River activist and journalist, Agba Jalingo, from police detention.

The PUNCH had on Friday reported the men of the Nigeria Police Force detained the journalist at Alapere Police Station, Lagos State.

In a statement on Saturday titled ‘Release Agba Jalingo now!’, Falana claimed that the activist was being detained for an offence which is not under any provision of the criminal code.

According to him, the police officers informed me that his detention was ordered by the Authorities in Abuja

The statement read, “Yesterday, a team of the police personnel despatched from Abuja stormed the home of Agba Jalingo at Alapere, Ketu in Lagos State to arrest him. After subjecting his wife and children to unwarranted harassment for hours, the police arrested Agba, yanked him out and took him to the Area F Police Command, Ikeja, Lagos State where he was detained until this morning.

“I met him at the police station where he informed me that he committed no offence but that his newspaper, CrossRiverWatch had only asked why a lecturer who wrote examinations for a student in the Nigerian Law School, Abuja has been arraigned in court while the student is being treated like a sacred cow.

The police officers corroborated his account and stated that the petitioner had alleged that Agba Jalingo had committed “defamation and infringement of his integrity”, which is not an offence under any provision of the Criminal Code
Based on the information at my disposal, I was compelled to demand for his unconditional release since he has contravened any provision of the Criminal Code.

“But the police officers informed me that his detention was ordered by the Authorities in Abuja. Thus, at about 11 am this morning he was flown out of Lagos and he is currently being detained at the Criminal Investigation Department, Garki, Abuja.

“The ongoing harassment of Agba based on the allegation that he has defamed the wife of the brother of a serving Governor is the height of official impunity in a democratic society. Since defamation is not a criminal offence the action of the Police is a flagrant breach of section 8(2) of the Administration of Criminal Justice Act, 2015 and section 32(2) of the Police Establishment Act 2020 which have banned the police from arresting any person in Nigeria for civil wrong or breach of contract.

“Therefore, the police Authorities should release Agba Jalingo unconditionally and advise the petitioner to sue for libel in a civil court.”

"Absolute power corrupts absolutely." In the same country, this can easily be settled in a court of law without any form of oppression or victimization. The difference between me, you, and that man is a force uniform out there is the weapon he wields and a bit of experience he possesses(that is if he has one).

Take away his weapon and watch him become defenceless. These men fail to realise that power doesn't last forever but it is rather tentative. What offence has the man committed? undecided undecided This country na wa o.

When we say that this country needs to be redeemed, you won't understand because religious fanaticism and ethnic bigotry have clouded your mind. God will help us. A country on autopilot. lipsrsealed

Since defamation is not a criminal offence the action of the Police is a flagrant breach of section 8(2) of the Administration of Criminal Justice Act, 2015 and section 32(2) of the Police Establishment Act 2020 which have banned the police from arresting any person in Nigeria for civil wrong or breach of contract.

Until the cops go to jail or have to pay out civil fines from their pockets or pensions they won't care. They're just the armed thugs of the state. Like any other set of criminals they don't care about laws or care about the harm they cause their victims. Some individuals expect people to praise them for their jobs or else another set of criminals would be at your throat.

Questions for the thread who is to blame for these policeman misconduct. Who gave the order to arrest this guy in the first place? When nobody gets punished who do we blame? It's doubtful they would arrest someone for talking crazy about you in the papers.

This is exactly same reason why we are living in shambles here in this country.

Nobody has the right to speak out and when you actually do, you get bullied and harassed until you either end up dead or sent packing from the country.

Unfortunately, those whom you have risked your life and resources fighting for, they will never appreciate or even reciprocate same energy when you get into trouble while fighting their tormentors.

Exam mulpractice now very common in Nigeria. Many students in our schools don't write exams by themselves anymore. It's also now common in even police and army schools. But exam mulpractice in Nigeria law school is something to worry about.
