Odinkalu is a former Chairman of Nigeria's National Human Rights Commission and a visiting Professor at Hazard Law School

Those expecting some form of magic from #Nigeria's judiciary in election dispute resolution should read this judgment in the Osun State Governorship case. The #SupremeCourt says to prove results have been manipulated, you need to produce each BVAS machine for the affected PUs.

So, if you are alleging manipulation of results in 1,000 PUs, you must produce 1,000 BVAS machines, 1 for each PU. Meanwhile, these cases are decided in courthouses not warehouses. The court may just have pre-determined the outcome of the major cases through an unrealistic standard of proof.

Think of it this way: to prove I have sent you an sms, it is not enough for you to get the network provider to certify what transpired, you must produce the phone from which the sms was sent. The quality of judicial decision making in election disputes is utterly diabolical.

Yes Bvas machines is the game changer. Same way voters register too. Some states will be won by the Pdp especially Nasarawa, Kaduna and Ogun States.

I once mentioned it on a thread that BVAS is just a machine that accredit voters!

With the court judgements below, it means if you provide a BVAS machine for a polin unit, the only thing BVAS would validate is numbers of accredited voters!

Once the numbers of votes are not more than the numbers of accredited voters, then such result stands! But if numbers of votes supersedes numbers of accredited voters, according to BVAS, then such result would be canceled!

The only advantage of this BVAS is that... If it accredit 200 voters in a poling unit, no matter the level of rigging that wants to occur, total votes must not be more than 200!

Unlike during the era of Pdp where a poling unit can be having imaginary 10,000 votes! BVAS reduces rigging largely..

The Nigerian electoral system has been designed in such a way that it is almost impossible to unseat the so-called elected president. For the people that brazenly usurped the wishes of the people to confidently tell you to go to court is because they know the system has been rigged against you and they have muddled the law to back up their criminality. I see nothing coming out of these electoral disputes. Sadly Nigerians are not willing to take back their country.

Don’t mind them, there’s enough over voting in Osun and since APC can’t produce BVAS machines for the over voting Supreme Court had to throw the case in dustbin.
