RIVERS ASSEMBLY SPEAKS ON SUPREME COURT'S DISMISSAL OF GOVERNOR FUBARA'S APPEAL

The Rivers State House of Assembly, on Monday, addressed the press following the Supreme Court’s judgement dismissing an appeal filed by Governor Siminalayi Fubara.

Addressing the press, the Speaker, Rt. Hon. Martin Chike Amaewhule recalled that the Federal High Court presided by Justice J.K. Omotosho, on January 22, 2024, delivered his judgement which affirmed the legitimacy of the 27 lawmakers, but dissatisfied with the Judgement, Governor Fubara filed an appeal at the Court of Appeal, where the judgement of the lower was upheld.

Rt. Hon. Amaewhule averred that further dissatisfied, Governor Fubara appealed the matter to the Supreme Court, which has now been dismissed by the apex court, bringing the legal battle to an end.

“The Supreme Court has spoken, and the people of Rivers State are elated with this judgement,” the Speaker declared; commending the five-man panel of Justices of the Supreme Court for upholding justice and reaffirming the rule of law.

Rt. Hon. Amaewhule extended his gratitude to leaders of Rivers State who have supported the Assembly throughout this period, singling out the Minister of the Federal Capital Territory (FCT), Chief Nyesom Wike, for his immense support.

The Speaker condemned the Governor’s refusal to provide the Assembly with its statutory entitlements for nearly a year, adding that the Governor thought they would be starved, but today’s judgment has strengthened their resolve and hope in the judiciary.

Rt. Hon. Amaewhule enthused that Governor Fubara is reputed for consistently disregarded court orders, but warned that all eyes are now on him to see whether he will disobey the Supreme Court’s verdict.

While addressing the issue of vacant seats in the Rivers State House of Assembly, Rt. Hon Amaewhule maintained that one former member had passed away, another had absconded from duty, and three other seats had been declared vacant due to absenteeism; and called on the Independent National Electoral Commission (INEC) to conduct elections to fill these positions.

Speaking further, Rt. Hon. Amaewhule reminded the Governor Fubara of the injunctive orders issued by Justice Omotosho, which barred him from withholding funds meant for the Assembly. “The end to this rascality is very near", Rt. Hon. remarked; emphasizing that the House remains committed to upholding the mandate given to them by the electorate.

Rt. Hon. Amaewhule stressed that Governor Fubara has been spending taxpayers’ money for a year without appropriation, in clear defiance of the Federal High Court and Court of Appeal Judgements. “Today’s judgment confirms that Governor Fubara has been in gross violation of the 1999 Constitution as amended,” Speaker Amaewhule asserted.

This guy is just playing on the unintelligence of the Ronu gang. Cause he clearly knows that the matter withdrew by Fubara at the supreme court was ONLY about the 2024 budget passage. Nothing else.

There is no help for Amaewule and his co travellers from the ruling. They will remain hopeless till 2027. They have no ability to impeach anyway and Fubara will never accept anything from them

The supreme court didn't give a judgement on the issue because Fubara choose to withdraw. The battle is still on. Shey wike's sha paying the lawmakers loyal to him sha because they are the biggest loser in this issue.

If you are in court seeking reinstatement as an honorable Senator, but the lifespan of the Republic has expired, your case becomes purely academic. You cannot take the seat of the next elected Senator when your term of service is no longer active.

This case is just the same interpretation.

Fubara quickly withdrew the petition against the 27 lawmakers a few minutes before the hearing, after grandstanding and deceiving the Obidients as if he had a liver. The mumu man is still deceiving the zombies as if the same judgement that is binding on the 2024 budget is different from the one that is binding on the 2025 budget.

Fubara withdrawing his appeal at the Supreme Court simply means he has accepted the verdict of both the High Court and Appeal court that affirmed that he (Fubara) had no right in the constitution to sign into law a budget that was passed by a kangaroo assembly .

The ruling indirectly reinstated the 27 lawmakers .


What this means is that the 27 members can convene anywhere they deem fit and start impeachment proceedings on Fubara.

The judiciary will not involve itself to save Fubara as used to be the case in past impeachment sagas like that of Obi as Anambra state governor who ran to the courts to halt his impeachment.

The judiciary will simply declare that it is a legislative matter .

Fubara is toast.

This guy is not wise at all. No one have won a battle against the executive governor. Even presidency always becomes careful and withdraw in most of the fights. Rivers State can shut down if this guys are sworn in to impeach the governor.

I believe the DSS will advice the presidency better. This 27 friends must be sacrificed to maintain peace in Rivers State while the oil flow unhindered. This case should linger till the end of this term. There's peace in Rivers and a court case shouldn't destroy it.

Leave the LG election alone. Every State did theirs, why provoke choas cos of selfishness of one man.

The whole thing is like saying...there's peace in Rivers State, let's use court case to destabilise the state. Think twice

The governor has no constitutional powers to declare any legislator's seat vacant on any grounds.

This is purely a legislative matter and only the Party can activate the call to have their seats declared vacant .


The executive overstepped their boundaries by declaring the lawmakers' seats vacant . This is executive rascality comparable to how the Edo state governor arbitrarily suspended duly elected Local Government Chairmen in that state.

There are provisions for separation of powers for this very reason so as to curb executive rascality being displayed by Fubara.

If BAT were to have the seats of 90% of Senators declared vacant and began running the country with only 15 Senators will you be in support of that rascality ?

Seriously, how can anyone support such rascality and still claim to be an advocate of democracy and rule of law?

Fubara is turning himself to a dictator and the Marxists in the obidients are the only ones cheering him on because the obidient Marxists have shown severally that they are not only anti democratic but are also anarchists who do not subscribe to the rule of law.

Most of the debt owed by Africa are from instigated civil wars and that taken to be stolen by installed dictator puppets who siphoned whatever loans that were not needed back to Jewish banks while leaving their country in a mess of debt.

The legislative acts as a check and balance of the executive

Fubara has shown that he is a despot by assuming he has powers to sack duly elected lawmakers and run Rivers state with a handful of rubber stamp stooges .

This is pure rascality and all of you supporting this madness from Fubara are not only anti democratic but against the rule of law .

If Tinubu were to try this at national level and have 90% of Senators and Federal Law makers barred from the NASS and use a handful of blind loyalists to pass budgets and bills for his own selfish agenda , will you be in support of such madness ?

You are the one that didn't read the judgement. You're just being sentimental. Don't let anybody deceive. Get a copy of federal high court judgement and appeal court judgement to read. The two judgement were what Fubara appealed against in supreme Court. By withdraw the case, Fubara now accept the judgement of the appeal court. Stop being emotional.

President Tinubu is truly a democrat,no governor can try what Fubara and his illegal three house of assembly members are doing in Rivers state during Obasanjo regime but disobeying a supreme court judgement is the height of it all.

Fubara has been given enough rope to hang himself.

The 27 lawmakers will convene and have Fubara impeached and no court will interfer in the matter as the courts have now sworn never to interfer into any legislative matter.

Let's see how Fubara will remain in Government House after he is impeached.

Fubara was trying to be smart by half .

His lawyers wanted to withdraw the case so as to refile it in future when the issue of the 2025 budget appropriation arises .

The court saw through his shenanigans and agreed with the plaintiffs to have the case dismissed and struck out.

The Supreme Court dismissal is important as it means Fubara can not refile the same appeal before the Supreme Court


Now the court has ruled that Fubara erred against the constitution by having a budget passed and signed into law without the minimum required number of lawmakers that can seat and form a quorum.

That's an already established illegality and criminal offense already waiting for Fubara.

Now going forward, Fubara's 2025 budget is now an illegality as well.

The 27 man faction of the assembly can now seek an order to freeze all accounts operated by the Rivers state government and go a step further by declaring that the executive should halt the collection of levies and taxes as inflows are also part of a budget.

This will cripple the state government and make it totally impotent.

If Fubara wants to remain stubborn , the law makers can then meet any where and have him impeached.

No court will save him from impeachment after he (Fubara) has been in violation of serveral court orders .

If he refuses to vacate the office of the governor , the Commissioner of Police will be deployed to have him arrested as an impostor .
