The Attorney-General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, has defended President Bola Tinubu’s decision to declare a state of emergency in Rivers State.

Fagbemi, speaking to journalists in Abuja on Wednesday, explained that the state of emergency prevented the Rivers State House of Assembly from following through with its impeachment process against Fubara and Odu, who were facing charges of “gross misconduct.”

The AGF stated that the declaration of the state of emergency by President Tinubu could be viewed as a strategic maneuver to stop the impending impeachment of the governor and his deputy.

Fagbemi emphasized that had the impeachment proceedings been allowed to continue, Fubara and Odu would have been removed from office, possibly for the remainder of their term.

“About compromise and replacement. It appears so. Don’t forget, I think yesterday (Tuesday), there was a notice of impeachment from the House of Assembly,” Fagbemi remarked.

He continued, “If that impeachment had been allowed to take its full course, then the governor would have lost entirely and completely. So, in a way, if you say it’s a compromise, I will agree that instead of allowing the impeachment process to continue, which in the end, would have seen both the governor and the deputy governor out of office and would have been out for the entirety of the four-year term with the remainder of what we have.”

Fagbemi defended the president’s decision, describing it as a “very bold” move to restore order in the state. He highlighted that Tinubu had thoroughly addressed the situation during his nationwide broadcast, providing a detailed account of the events leading to the declaration of a state of emergency.

“We were all there when he addressed the public and chronicled all the facts from Genesis to Revelation,” Fagbemi stated, reinforcing that the president had acted in the best interest of Rivers State and the nation at large.

The declaration of the state of emergency, which saw the suspension of Fubara, Odu, and all members of the Rivers State House of Assembly, has sparked mixed reactions.

Even Fubara without SIM knows that Mr President saved his sorry ass. Tinubu is an astute politician, a very wise man. He saved the situation and that's what any responsible and proactive leader would do. Many of the critics failed to see it from this perspective because they are consumed in their shallow sentiments. Funnily, many of them who have been criticizing this decision cannot even solve their own family issues but are very quick to talk a diverse complex national issues.


Modified; some are saying Fubara wrote to the Assembly members a letter asking for the budget presentation but that was a lie. The letter only existed on social media as no copy of the letter was received in person by the Assembly. Even when there's a communication to present the budget, you have to wait for a feedback from the Assembly on a suitable date for the Presentation. You don't just walk into somebody's residence without invitation after you had previously demolished the Assembly complex meant for the purpose.

So they are aware that the 27 dishonourable lawbreakers initiated impeachment proceedings against Fubara, but suddenly fail to be aware that this cartel and gang of 27 lawbreakers avoided budget presentation, and have been harassing Fubara and CJ , but they still turned around to blame Fubara. Tinubu saved Fubara from imminent impeachment

Fubara was on the verge of being impeached before his suspension and that is what kept Fubara from being impeached.

Fubara's supporters should be grateful to Tinubu for the timely intervention.

It would have been difficult to remove Fubara anyway.
The major decision lie with the 7 man panel that the Chief Judge will appoint. Unfortunately, the Chief Judge and the Assembly members are not in good term.
Tinubu deliberately usurped the funds and appropriation of River state fund through an ignoble means.

Politics aside, the allegations against Fubara met impeachment standard ( Gross misconduct, abuse of power) even though I wasn't in support of that

They're planning to save face.
The Supreme Court decided that the statutory allocations due to Rivers State should be withheld because the Governor did not recognize the House of Assembly, and did not present the budget before the said House for passage.

President Tinubu claims that Governor Fubara, who had written to the same House to enable him present the budget, has failed to obey the Supreme Court.

The same Tinubu went ahead to appoint a Sole Administrator after suspending the Governor, Deputy Governor, and the members of the House of Assembly.

Now we are reading that the withheld allocations will be released to the Sole Administrator who is nothing but an impostor concocted capriciously by the President.

So, the allocations were withheld because there was no House of Assembly or the Governor did not recognize the House, and did not present the budget, but you have now suspended both the Governor and the House and proceeded to appoint a Sole Administrator and handed over allocations to the Sole Administrator.

How do you reconcile this?

If it was right for the allocations to be withheld because there was no House of Assembly or due to the governor’s refusal to present budget before the House, on what legal, moral, or logical basis are you releasing the same allocations to a Sole Administrator after suspending the Governor and the House?

Is the Sole Administrator a constitutional substitute for the House of Assembly and the Governor?

Is this shenanigans all about stealing the allocations of Rivers State? Is that what this impunity is all about?

Which budget will the Sole Administrator now use to appropriate the allocations of Rivers State?

State funds and allocations cannot be appropriated without being enabled by an Appropriation Law. Sections 120 and 121 of the Constitution are very explicit on this.

Tinubu has defecated on the Constitution of Nigeria.

They openly confessed to interfering in Rivers state assembly matters and overstepping their bounds.
The mumu AGF doesn't know that blocking a state assembly from fulfilling its constitutional role is nothing short of treason.

All parties in the crises were complicit of misconduct, Fubara inclusive, but that impeachment would not have sailed through without the CJ tagging along which could never have been. The lawmakers knew and had to adjourn sitting indefinitely.

The president unilaterally suspended a governor that was brought into power the same way the president was brought into power.

Didn't get the approval of the House of Assembly and is blaming a governor of not adhering to the law

Is the president adhering to the law?

Blatant nonsense for a president that always claimed to be a democrat.

Not even to mention that the Chief Judge of Rivers State is on the governor's side. If he constitutes a panel that finds the governor innocent of the accusations of the house, then the impeachment will be thwarted.

All politics, nothing would have happened to him. Only the Judicial Commission would have been in a position to discipline him if at all such allegations were true. He was and is still incorruptible.
