Supreme Court Sacks Kebbi Governor by werepeLeri: 7:18am On Mar 03, 2012
The Supreme Court on Friday sacked the Governor of Kebbi State, Usman Saidu Nasamu Dakingari of the Peoples Democratic Party (PDP), and ordered the Independent National Electoral Commission (INEC), to conduct a fresh governorship election in the state within 90 days.

In a unanimous judgement delivered by Justice Walter Onno-ghen,the court set aside the ruling of the Court of Appeal, which upheld Dakingari’s election on the ground that it erred in law fore deferring the reason for its judgement to outside the 60 days allowed by the constitution.

Meanwhile, the speaker of the state House of Assembly, Aminu Jega, has been sworn in as acting governor.

The apex court had set aside the judgement of the court and in its stead upheld the judgement of the Kebbi State Election Tribunal, which had earlier nullified the governor’s election and ordered a fresh one.

The Court of Appeal, while affirming the governor's election in its judgment, deferred the reason for its decision to January 23, 2012, a day clearly out of the 60 days prescribed by Section 285 (7) and (cool of the 1999 Constitution as amended.

It, therefore, held that the Court of Appeal not being the final court in the determination of appeals arising from the conduct of governorship elections, lacked the power to deliver judgment and defer the reasons for its decision, more so, to a date which was outside the mandatory 60 days prescribed by Section 285 (7) of the Constitution.

The court held that "It is obligatory for the Court of Appeal and the Supreme Court to dispose an appeal within 60 days from the date of the decision being appealed. Section 285 (7) implies that both the decision and the reasons for that decisions, must be completed within the stipulated time. Any decision without a reason is no decision at all. The judiciary has no option than to work within the time frame provided by the law."

Meanwhile, PDP has expressed shock over the verdict.

It said in a statement signed by its National Publicity Secretary, Prof. Rufai Alkaki, in Abuja on Friday, that while its faith in the judiciary remained unwavering, it was, however, deeply concerned with the trend of judgments some of which it observed "breed unnecessary tension and instability."

According to the statement, the PDP National Chairman Alhaji Abubakar Baraje, on behalf of the National Working Committee (NWC) and the entire members of the PDP "is deeply touched by this temporary setback" but has called it the teeming supporters in Kebbi State to remain calm, law abiding and continue to support the party "which remains the most formidable and purposeful political party in Nigeria."
