He must be one of those charge & bail lawyers who are scare of trial, they always advise their clients to settle the case before it goes to trial, because they are not confident of their chances....this is just a speculation though!

Jokes apart, his chances of prevailing on trial are slim to none...it is on court record that he was warned previously...to make a strong case, though not necessary...the judge can put the bailiff on the stand and that will sealed his fate. if found in contempt of court after trial, it will be reflected in his permanent records and might affect his career....or frog jump is a temporary discomfort, if he is too ashamed to return to that court to practice, he can relocate somewhere else to reduce the shame...but a contempt finding will follow him where he goes....so he made a good roll of the dice here.

Please let's try to cover this terribly embarassing scenerio from international media. How much lower in foolishness can we endure as a country? At least the averagely educated layman knows that court is a gathering of well-groomed intellectuals; not a place to apply 'primary school-like' jungle justice on a grown-up individual. He could have at least fined him, like they do in civilised settings...

Even me wey no be lawyer know say to be docked for better, how come a lawyer?. Infact that lawyer is not a learned colleague. If i were him, i will pull out my ragalia abi chieftancy and bow out of the profession because nobody go bring case come near am.

Contempt is any act or omission(conduct) which diminish the authority of court.The court has an inherent power to punish for contempt. Contempt is the only crime that is not written in any law book or statute in Nigeria. It had been held in several cases by the Supreme Court that the power of a court to punish for contempt is not at variance with section 36(11) of the 1999 Constitution as amended which provides that no man can be punished for an offence which is not contained in any law in force in Nigeria. It is important to state that the purpose of punishing for contempt is not to bolster the ego of the Judge but rather to maintain the dignity of the court. The magistrate here went too far in asking an advocate of the Supreme Court of Nigeria to frog jump. I earnestly hope that the NBA in the state involved will not take this likely with this magistrate. I expect them to picket against him/her. Remember this same thing played out sometime early this year in Aba when a female judge ordered a lawyer to mount the table. the NBA Aba Branch never took this likely. they staged a bitter protest against her and even locking up her court room. The CJ of the state was forced to intervene but the NBA insisted that she must be transfered out of Aba. What this magistrate did was self serving and I expect a respond from NBA.

I made some investigations from my friend who is also a lawyer in Osogbo, he said the Magistrate apologised to this poor lawyer as He got to know that it was his client that was making noise and also the Head of the Magistrate apologised too. Lawyers in the House, can the Magistrate be sue for high handedness?......please enlighten me on this......

It was like a drama yesterday during a Court session, when the presiding Chief Magistrate of an Osogbo Magistrate Court, Adewunmi Makanjuola ordered a middle-aged lawyer, Nnajite Okobie, to observe a five-minue frog-jump as a punishment for making noise during the court proceeding.

Makanjuola, who was presiding over a case of alleged Molestation of an 11-year-old primary school girl was apparently disturbed by the noise emanating from Okobie, who was having a conversation with two people suspected to be his clients in the court premises.

He had earlier sent the court orderly to warn him to desist from making noise but he failed to adhere to the warning of the court.
Provoked by the action of Okobie and his two clients, Makanjuola therefore ordered the court orderly to invite the trio before him.

The Chief Magistrate told them to decide on whether to be docked for contempt of court or observe a five-minute punishment of frog-jumping and then ordered the court orderly to sanction the trio by engaging them in a five-minute frog-jump stressing that their action had put the court in disrepute.

It was a sight to behold for the workers of the court. While some were full of pity for Okobie, others were seen making mockery of him.

It cannot happen in a civilized society. First of all, noise making is too trivial to constitute a contempt of court. The lawyer could have been asked to leave the court yard. For the sake of argument, let us say the lawyer was in contempt, the normal process was to charge him with civil contempt and have a trial on the charge. This would have given the lawyer a chance to present a defense or move to dismiss the charge as nuisance charge.

The magistrate abused the process and acted ultra vires. He alo violated the lawyer's due process rights because he granted him none before he sentenced him to frog jumping. Moreover, the magistrate acted without decorum. I believe that the magistrate does not have the temperament for the position he has.

No judge in the U.S. for example would sentence a fellow lawyer to frog jump. It would be considered abuse of discretion that may subject the magistrate to discipline. Furthermore, noise making would simply have attracted an order to vacate the premises and nothing more. No lawyer would even accept such humiliation in any civilized clime.

I think it was Castro that was quoted as saying that in a lawless society it would be illegal to be law abiding. Therefore, the lawyer should have requested that a trial be set and should have demanded his due process and let the chips fall were they may. The magistrate acted outside the law and deserves to be scorned and scolded.

The Magistrate definitly exceeded his bounds. The lawyer foolishly opted for that option because such contempt cannot be tried by the same Magistrate. Magistrate re lawyer that were merely asked by Gov to precede proceedings. Lawyers should learn how to confront even judges when they make unnecessary demands. Similar incident happened at Aba High Court 2 where a lawyers was asked to stand at the gallary merely b/c his phone rang in court. Aba lawyers are still boycoting the said court till date.

Frog jump is too easy. The magistrate should have ordered them to do a monkey jump. Contempt of court is a serious matter.

No person in the U.S. would be so sentenced under the circumstances here. It would be grounds for disrobing for abuse of discretion and for cruel and unusual punishment as well as violation of the due process right of the alleged culprit. I emphasized the term fellow lawyer because the magistrate and the lawyer would know the law of civil contempt and what rises to that. An American lawyer would have disobeyed this type of abuse of power.

The rare exception is if after a trial, a person that is convicted is then given the option to frog jump in lieu of a known sentence that is more severe than five minutes of frog jump and he accepts. Moreover, there is esprit de corps among lawyers including judges and fellow lawyers. This type of sentence would be very rare in a civilized clime under any circumstance because every crime has specific sentencing guidelines including contempt whether civil or criminal. Therefore, a judge would have gone beyond the scope of the guidelines to do this.

Now, it is said that the magistrate apologized because he found out it was not the lawyer making noise. This is a problem that could have been discovered if due process was granted to the alleged culprits. The magistrate is not deserving of the job period and should be weeded out.
