President Muhammadu Buhari has extended the appointment of Tanko Muhammad as the acting chief justice of Nigeria by another three months. Mr Buhari sent the recommendation to the National Judicial Council and the supervisory body approved the appointment on Thursday, a spokesperson for the NJC, Soji Oye, said in a statement on Saturday. Mr Muhammad was first appointed in January after the president controversially suspended Chief Justice Walter Onnoghen who was accused of false declaration of asset. Mr Onnoghen was convicted on Thursday by the Code of Conduct Tribunal, and was barred from holding public office for 10 years. He has denied all allegations against him, and has appealed the ruling. The president’s suspension of Mr Onnoghen sparked uproar as the move was deemed unconstitutional. Also, coming just weeks before the February presidential election, it raised suspicions, with the opposition accusing Mr Buhari of moving to appoint a stooge who would ensure judicial support after the polls would have been rigged. Mr Onnoghen notified two weeks ago he was stepping down, but the Presidency has yet to announce whether his exit had been approved by the president. In what appeared to be the first pointer to the Presidency’s decision, a statement by presidential aide Garba Shehu on Thursday, following Mr Onnoghen’s conviction, referred to him as “former” CJN. The statement released on Saturday by the NJC denied an unnamed media report that the council would meet next week to deliberate on the extension of Mr Muhammad’s term as the acting chief justice of Nigeria. It said the approval had already been given. “Contrary to the above, the Council actually met on Thursday 18th April, 2019 and at the 88th Meeting considered and approved the request of President Muhammadu Buhari, GCFR, for the extension of the Appointment of Hon. President Muhammadu Buhari for the second time has said the National Assembly inflated the debt figures to be repaid by the federal government to some states. He asked the lawmakers to send details of the amounts they approved for Delta and Taraba States. He said he would go ahead to pay the amount earlier approved by the federal executive council and not the National Assembly figure. The debt repayment in promissory notes is for projects executed on behalf of the federal government by various state governments. A promissory note is a debt instrument which one party promises in writing to pay a determinate sum of money to the other, either at a fixed or determinable future time, under specific terms His request was communicated via a letter which was read out by the Senate President, Bukola Saraki, on Tuesday. In the letter, Mr Buhari pointed out that the total amount approved by the National Assembly to Delta and Taraba states was higher than the amount approved by the Federal Executive Council (FEC). He also said the National Assembly of not approving reimbursement to Bauchi and Kogi states after FEC approved reimbursements for them. Part of the letter read, “I wish to inform the Senate that we have received the approval of the National Assembly via letter referenced NASS/CNA/106/volume11/004 dated 29th January 2019 for refunds to Delta and Taraba states through the issuance of a promissory note for projects executed on behalf of the federal government. “In view of the approval of the National Assembly, the following was observed: 1. While the Federal Executive Council approved the total sum of N78 billion (78,601,631,430.16), as reimbursement to Delta and Taraba state governments, national assembly approved N90 billion (90,236,461,031.36) which is higher than the amount approved by the Federal Executive Council. 2. The national assembly did not approve any reimbursement to Bauchi and Kogi states governments whereas the Federal Executive Council approved reimbursement for them.” The president reminded the lawmakers of the provisions of the Public Procurement Act 2007 which empowers the Bureau of Public Procurement (BPP) to approve contracts – as he said the amounts presented to the National Assembly were duly certified for reimbursement by the Bureau before they were approved by FEC. “Since the Bureau of Public Procurement is charged with the responsibility of approving contractual sums when there is a need for compliance with the Public Procurement Act 2007, I wish to request that you forward to us details relating to the amount approved by the national assembly for Delta and Taraba states in essence of what certified by the Bureau of Public Procurement for necessary certification approval. “Meanwhile, the federal government shall proceed with the implementation by reimbursing the amount approved by the federal executive council. Furthermore, I wish to suggest that you review their reimbursement in favour of Bauchi and Kogi state governments while looking forward to timely consideration of the request,” he said. This is the second time the president will accuse the National Assembly of inflating debts to be repaid to states. He had in December 2018 accused the National Assembly of approving N488 billion as reimbursement to the state governments while FEC approved 487 billion. The Abuja Division of the Court of Appeal on Thursday affirmed the victory of Governor Kayode Fayemi of Ekiti State at the July 14, 2018 governorship election in the state. The three-man panel, led by Justice Stephen Adah, in a unanimous judgment, dismissed the appeal filed by the Peoples Democratic Party and its candidate in the election, Mr. Olusola Eleka. Describing the appeal as “unmeritorious,” Justice Adah affirmed the July 28, 2019 judgment of the Ekiti State Governorship Election Petition Tribunal which had upheld Fayemi’s victory at the poll. The Independent National Electoral Commission had declared that Fayemi and his party, the All Progressives Congress, polled a total of 197,459 votes to defeated Eleka and the PDP who placed second with 178,121 votes in the July 14, 2018 election. Dissatisfied with the outcome, PDP and Eleka had filed their petition before the Ekiti State Election Petition Tribunal which sat and delivered its judgment in Abuja. The petitioners alleged, among others in their petition, that the election was marred by a lot of wrongs, including non-compliance with the Electoral Act. But the tribunal on January 28, 2019 dismissed their petition and affirmed the results declared by INEC. The petitioners further appealed to the Court of Appeal, raising seven issues against the judgment of the tribunal. But delivering judgment, Justice Adah, who gave only a summary of the Court of Appeal’s verdict on Thursday, resolved all the seven issues raised against the appellants and in favour of the respondents — Fayemi, INEC and APC. The court, which had conducted a hearing on the appeal earlier on Tuesday, dismissed the case in its judgment on Thursday for lacking in merit. Justices Tinuade Akomolafe-Wilson and Emmanuel Agim agreed with the lead judgment delivered by Justice Adah. The three-man panel entered the courtroom at about 7pm on Thursday but started delivering the judgment at about 7.14pm. The summary of the judgment given on Thursday lasted more than 30 minutes. President Muhammadu Buhari on Thursday launched a micro pension plan for self-employed Nigerians. The launch took place at the State House Conference Centre, Abuja. Mr Buhari launched the programme by supervising the registration of a Keke NAPEP operator, Sagir Shawai, a resident of Karu village of the Federal Capital Territory. The president said the programme was conceived for Nigerians in the informal sector of the country. He appealed to trade associations, workers unions and non-governmental organisations (NGOs) in the informal sector to join hands with the government in enlightening their members on the importance of the scheme. “This initiative will capture those that are not fully captured in the existing pension scheme. In the past three years, we have provided loans to farmers and others in the informal sector. TRADE Union Union Congress of Nigeria, TUC and the Association of Senior Civil Servants of Nigeria, ASCSN, have congratulated President Mohummadu Buhari over his election for a second term of four years during Saturday’s presidential election. In separate messages, TUC and ASCSN, pleaded with the President to take advantage of the fresh mandate to beef up welfare packages of workers by implementing the new National Minimum Wage as soon as the Senate passed the Bill since the House of Representatives had already done so.
