Hello Messibliss207 - You will be asked about prior education on your DS-160, and you may also be asked about it in your interview. As with everything else on the DS-160 and the interview, you should tell the truth. You can have your interview for a F-1 visa up to 120 days before the date your program is due to start, and if your visa is approved you can travel to the US up to 30 days before the start date. The decision the VO will have to make if you choose to apply again is whether or not your ties to Nigeria at the time of the new application are strong enough. However the burden is on you to prove you are a credible student with ties, and your ability to meet your school's basic requirements will factor into this. |

Hello Mrsdoctor007 - You are absolutely correct, it is not advisable to lie to the VO. As a matter of practice, we don't really issue B1 or B2 alone, but rather we issue a combined B1/B2 for all applicants who apply for either of those. Medical tourism is legal in the US on a B1/B2 visa. It is important that the VO document in your case that you disclosed an intent to have a baby in the US so that when you get to the Port of Entry that is in the file. To qualify for a B1/B2 for medical tourism, you need to demonstrate ties to Nigeria just as with any other tourist visa, plus you need to demonstrate a bona fide relationship with a medical provider in the US and the ability to pay for the treatment. How you choose to demonstrate those facts to the VO is up to you, as I am not permitted to give specific advice about how to handle an interview in any individual case. In general, if there is anything about your situation that is out-of-the-ordinary, you should be prepared to explain the situation to the VO. Above all, tell the truth. If it is determined that you have misrepresented facts in order to obtain a visa you would not qualify for, that can result in a lifetime ineligibility. Mrsdoctor007: 8 Likes |

Hello rantmoniker - 1) E2 non-immigrant visas are not available to Nigerian nationals at this time because there isn't a requisite trade treaty between Nigeria and the US. 2) So long as your B1B2 visa is still valid, you may make additional trips to the US, provided that your travel purpose for each trip is an allowable purpose under a B1B2 visa. rantmoniker: |

Hello JWTheocracy1 - There is no rule against approving a non-immigrant visa for an applicant who also has an immigrant visa petition pending. The key decision the visa officer has to make is whether or not the applicant intends to immigrate on the visa he is applying for at that interview. The presumption of immigrant intent is a core concept of US immigration law that governs our visa process. Another overriding concept is our judgement of whether the applicant will use the visa correctly--to abide by the laws of the land and to return after a short stay. We understand that immigrant visa petitions can sometimes take years to process. In the meantime, an IV applicant may wish to make brief visits to the US but will not want to endanger their lawful, long-term plans to migrate. Hello Ijesco. As far as the United States is concerned, you do not need a letter of consent to depart with your child. You do, however, need the father's consent (notarized) on the DS-3053 in order to apply for your child's passport. Your post is difficult to understand. You shift from saying that you are applying to saying he is applying, then refer to the person in question. In any case, for you, he or anyone else, we do not advise paying for any trip expenses until you have the visa in hand.
