Muhammad Magaji, the state’s Commissioner for Finance and Economic Creation, made the appeal at the start of a Technical Workshop on the development of the state’s Medium-Term Sector Strategy (MTSS).
He stated that the other states, particularly those in the Southern region, should set emotions aside and become their brothers’ keepers in sharing the VAT produced in their respective jurisdictions.

The demand came in response to Governors Babajide Sanwo-Olu of Lagos and Nyesom Wike of Rivers taking moves to begin VAT collection in their respective states.

Last month, the court had issued an order restraining FIRS from collecting VAT and personal income tax (PIT) in Rivers and directed the state government to take charge of the collection.

Following the court’s judgement, Wike signed the VAT Law No. 4 of 2021 on August 19.

Speaking at the event, Magaji said with the declining money from the federation account, just three of the country’s 36 states could exist without assistance from the Nigerian government.

“The VAT issue will have adverse effects not only on Gombe State but almost all the states of the federation. I was part of the discussion few weeks ago by all commissioners of finance across the country.

“The realisation was that only Lagos, Rivers and probably Delta states would be able to pull through without this VAT being administered centrally, and it is our appeal that we all put sentiments behind and work towards a federation that is one, by being our brothers’ keepers and ensuring that what is pull together at the center is distributed to be able to balance resources across the country,” Magaji said.

According to him, it would be a very bad development that won’t augur well for the country if every state will ask for control of its resources.

He added, “Don’t forget that the oil producing states collect only 13 per cent derivation, so if you say every state will take whatever resources it has, that it means we are starting a very dangerous trajectory that will not augur well for the federation called Nigeria.”

The Attorney General of the Federation (AGF), Abubakar Malami (SAN), on Wednesday, prayed Justice Ladiran Akintola of the Oyo State High Court sitting at Ring Road in Ibadan, to strike out the suit filed before him by Yoruba nation agitator, Sunday Adeyemo, popularly known as Sunday Igboho, on the ground that the court lacks the inherent jurisdiction to hear the matter.


Malami had through his counsel, Abdulahi Abubakar, filed a notice of preliminary objection to the suit brought pursuant to Sections 251 (1)(R) of the 1999 constitution, Order 2, Rule 1 and 2, Order 8, Rules 1 and 2, and Order 9, Rule 1 of the Fundamental Rights (Enforcement Procedure) Rules 2009, Order 3, Rule 1 of the Oyo State High Court (Civil Procedure) Rules 2010.

Abubakar and his team had filed the objection along with a Motion on Notice to ask for an extension of time to enable him to file his preliminary objection, counter-affidavit and written address in opposition to Igboho’s application and both processes were moved before the court at the resumed hearing of the matter.

The motion for extension of time was however objected to by Igboho’s legal team led by Chief Yomi Alliyu (SAN) on the grounds that extension of time could not be applied as time is of the essence in a suit of such nature.

He had argued that the law stipulates that replies shall be given within five days, stressing that Malami had nowhere to hide because the case is predicated on the issue of fundamental human rights, adding that by filing the motion on notice, Malami had called for the discretion of the court.Alliyu consequently asked the court to exercise its discretion instead of granting Malami’s application.

On their part, T. A. Nurudeen, who is the counsel to the Directorate of Security Services (DSS), which is the second respondent and the director of DSS in Oyo State, who is the third respondent, had no objection to Malami’s application.

Giving a bench ruling on the matter, Justice Akintola allowed Malami’s lawyers to move his application and awarded the sum of N50, 000 as a cost in favour of Alliyu and his team.

Minister of Justice, Abubakar Malami on Tuesday May 25 appeared before the House of Reps committee investigating the status of recovered loots, after failing to show up on Monday May 24.



Malami during the appearance, reportedly blamed the non-passage of the crimes bill, an executive bill which was forwarded to the National Assembly in 2017, for lack of coordination of the recovered loots
He said;



“When we came in, we realised that there was no legislative framework on recovered loots. We resolved to send a bill to the National Assembly. I regret to state that the legislative framework has not been passed. If the National Assembly had passed the bill, we will not be in this position.”The AGF was however accused of being complicit in the funding of the budget of his office with money from the recovered loots instead of the consolidated revenue.



Adejoro Adeogun, the chairman of the committee said;



“The law is that every revenue should be transferred to the Consolidated Revenue Account. Has the office of the attorney general ever received any fund from the recovered loots account?”Malami responded by saying;



“The office of the attorney general has never at any time received any kobo from that account, not even the cost of collection. The office of the attorney general is not a recipient of a dime from the recovered loot.”

He said it is in the context of that rule that kidnappers should not be paid ransom so as to starve them of the funds they could use to boost their arsenal and sustain their evil campaign.

"Since Allah (SWT) has forbidden the payment of money to an enemy who is at war with you, in order not to empower them to continue to fight you, then contributing money as ransom for the release of kidnapped persons, is haram (prohibited),” he said.

Quoting a Hadith (prophetic tradition), Mr Maqari narrated the story of a man who approached Prophet Muhammad, asking him what to do if someone tried to rob him of his money and the Prophet told him to resist the person.

The man then asked the Prophet “what if the person fights me, and the Prophet told him to fight back.”

“What if I kill him,” he asked, and the Prophet said, “He goes to hellfire.” He asked again, “What if he kills me?” and the prophet said, “you enter paradise.”

The Hadith, the deputy chief Imam emphasised, upholds the impermissibility of giving ransom to kidnappers.

He also explained that Islam’s code for discouraging criminality provides that material demands imposed as conditions by criminals are to be ignored, no matter what havoc the criminals threaten to unleash, if the demands are not met.

Refusing to meet the demands of kidnappers would inevitably turn them into losers who wasted their money to feed the captive, wasted their bullets in killing them and wasted their time, he asserted.

“But he (the criminal) has been made aware that the money is never going to be paid and the one who is killed (the victim) is going to paradise,” he said.

Maqari said applying the Islamic provisions can effectively address the challenges of kidnapping currently affecting the society.

“But as long as people will continue to give ransom to secure the release of their loved ones, the recipients of the money will continue to use it to acquire more arms that they will use to perpetrate their atrocity and promote it as a business,” he advised.

Another implication of submitting to kidnappers’ demands, he pointed out, is that the vice will be grow and be hard for security agents to handle.

“So the best way of stopping it, is for the criminal to know that if he kidnaps someone, he can choose to chop his body into pieces,” but he will not get what he wants.

He, therefore, advised Muslims that getting killed by kidnappers is a sure way of going to paradise.

challenging Atiku’s eligibility to contest for President and praying the court to hold among others, that considering the provisions of sections 25(1) &(2) and 131(a) of the constitution and the circumstances surrounding his birth, the former Vice President cannot contest for the top office.

Federation (AGF) and Minister of Justice, Abubakar Malami has told a Federal High Court in Abuja that former Vice President Atiku Abubakar is not eligible under the constitution to contest for President.
Malami said this in an affidavit in support of a suit marked FHC/ABJ/CS/177/2019 and filed before the court by the Incorporated Trustees of Egalitarian Mission for Africa (EMA).
EMA is challenging Atiku’s eligibility to contest for President and praying the court to hold among others, that considering the provisions of sections 25(1) &(2) and 131(a) of the constitution and the circumstances surrounding his birth, the former Vice President cannot contest for the top office.

Although the suit was filed before the 2019 presidential election, it is yet to be heard and determined.

However, it was mentioned on March 15, during which Justice Inyang Ekwo noted that the suit was ripe for hearing and fixed May 4, for that purpose.

The AGF through his legal team led by Oladipo Okpeseyi argued that, having not been born a Nigerian or by Nigerian parents, and having not met the provisions of Sections 25(1) &(2) and 131(a) of the constitution, Atiku would be violating Section 118(1)(k) of the Electoral Act should he put himself forward as candidate.

Malami in an affidavit said, “The first defendant (Atiku) is not qualified to contest to be president of the Federal Republic of Nigeria,” Malami submitted. The first defendant is not a fit and proper person to be a candidate for election to the office of president of the Federal Republic of Nigeria.

“The first defendant was born on the 25th of November, 1946 at Jada, at the time in Northern Cameroon. By the plebiscite of 1961, the town of Jada was incorporated into Nigeria.

“The first defendant is a Nigerian by virtue of the 1961 plebiscite, but not a Nigerian by birth. The first defendant’s parents died before the 1961 plebiscite.”

Malami said the effect of the June 1, 1961 plebiscite was to have the people of Northern Cameroon integrated into Nigeria as new citizens of the country, even after Nigeria’s independence.

“This qualified all those born before the 1961 plebiscite as citizens of Nigeria, but not Nigerian citizen by birth. Consequently, only citizens born after the 1961 plebiscite are citizens of Nigeria by birth,” he added.

Citing the provisions of 1960, 1963, 1979 and 1999 constitutions Malami said the “reasoning of the lawmakers in ensuring that the persons to be the president of Nigeria is a citizen of Nigeria by birth is because such a person is the number one citizen and the image of the Nigerian state”.

“This is even more so where his parents do not belong to any tribe indigenous to Nigeria until their death,” he said.

“The facts of his (Atiku’s) birth on the Cameroonian territory to Cameroonian parents remain unchallenged.

“At best, the first defendant can only acquire Nigerian citizenship by the 1961 plebiscite. The citizenship qualifications under Section 26 and 27 of the 1999 Constitution of the Federal Republic of Nigeria (1999), by implication, has limited the first defendant’s privileges or rights and cannot be equal or proportional to the privileges of other citizens who acquire their citizenship status by birth.

According to the union, it had at its last National Executive Meeting on March 13, 2021 in Abuja, issued a 21-day ultimatum to the government to implement the financial autonomy of the judiciary
Judiciary Staff Union of Nigeria (JUSUN), have stormed the Federal High Court, Ikoyi, Lagos and driven workers out of the court premises. 
bThe national leadership of JUSUN in a circular dated April 1, ordered the shutdown of various courts across the country as from Tuesday, April 6.
JUSUN had declared an indefinite nationwide strike to demand financial autonomy of the judiciary.

A source at the court told SaharaReporters on Tuesday that "executives of the union stormed the court premises and drove workers out of the place."

"They said we should not be here because an indusrial action had commenced," the source added. 

In the circular signed by JUSUN’s General Secretary, I. M. Adetola, it directed all states and zonal heads of the union to comply with the strike.

According to the union, it had at its last National Executive Meeting on March 13, 2021 in Abuja, issued a 21-day ultimatum to the government to implement the financial autonomy of the judiciary

It had threatened to resume its suspended national strike if its demands were not met. 

“Therefore, as a result of the public holiday on April 5, 2021, the strike action has been postponed to Tuesday, April 6, 2021.

“You are directed to shut down courts/departments in your states until further notice from the National Secretariat of JUSUN in Abuja,” the circular read in part.

Their agitation is to get financial independence for the nation’s judiciary.

The legal actions taken by the union led to January 14, 2014 judgment of Adeniyi Ademola, then a judge of the Federal High Court, abolishing the piecemeal funding of the state and federal courts by the executive.

President of the Senate, Ahmad Lawan, has said he would not support tenure elongation for incumbent President, Muhammadu Buhari.
Senator Lawan remarks was on the heels of a tweet attributed to him that he “won’t mind a constitutional amendment to allow the unlimited term of office for President if President Buhari wishes to remain in office beyond 2023.”

But the President of the Senate in a statement signed by his media aide, Ola Awoniyi, disowned the tweet as he noted that the 1999 Constitution has a firm position on the tenure of the President that reflects the popular stand of Nigerians.

He said: “Section 137(1)b states as follow: A person shall not be qualified for election to the office of President if (b) he has been elected to such office at any two previous elections.

“The Senate President has never found anything wrong in that provision of the Constitution and has always stood firmly by it.
