The Nigerian Law school has released application for admission into October 2022/23 academic session (Bar Part II program).
It's so unfortunate many Nigerian Law graduates may not make it to the Nigerian Law school this year anymore due to the Nationwide ASUU strike, as the session will commence in few months to come.

It is pertinent to examine the stance of the law concerning confession.
Many Nigerians has been sentenced without a proper investigation as regard any crime committed, however i took it as a burden upon my honorable self to explain in details what “confession” is all about.
Confession can be simply defined as a VOLUNTARY statement made out at any time by a person charged with the commission of a crime and communicated to another, stating or acknowledging that he committed the alleged crime as defined by the court in the case of Yakubu v. State.
Section 29(2)(a)-(b) of the Evidence Act 2011.
Please take note of the VOLUNTARINESS. which means, for a confession to be admissible before any judicial proceedings, it must first off conform to voluntariness.
Before a statement can have a valid key to be a confession, a crime first of all must have been committed, and not just crime, the person charges upon such crime must be the real committer of such crime, it is important that a crime had been committed first, and it is the same crime that the accused is charged with, or intended to be charged with.
Now, after giving out reasons before a statement can leads to confession.
Such statements being given must conform to certain guides, without these guides, any confessional statements made out of these guides, such statements cannot be admissible in the court of law.
And these are:
1. Such statements must be unequivocal
2. Must be Direct
3. Must be positive
4. Must be adverse to the interest of the maker.
Any of these four guides must not escape a confessional statement, that is to say, before a confessional statement can have it’s validity, none of these four should be missing.
And the last is so much important, a confessional statement must be opposite interest of the maker, that is, it must not be in favor of the maker.
A confessional statement could be made at any time in so far as it is voluntarily made; hence, voluntariness of the statement is a precondition for the validity and admissibility of a confession as seen in Section 29(2)(a)-(b) of the Evidence Act 2011.
It should be noted that, for a confessional statement to be relevant and admissible, whatever means or method it was obtained from the accused person(s) is immaterial so far it was voluntarily made by the accused person. Thus, the promise of secrecy in Section 31 of the Evidence Act 2011 does not affect the admissibility of a confession made by the accused to a prison cell, as reasoned in the case of Igbinovia v. State, where the appellant while in custody confessed to the murder of the taxi driver to a disguised police officer in the cell and was convicted on the confession. The Supreme Court in dismissing the appeal held that the confessional statement was admissible since it is relevant to the issue and was voluntarily made.
The police cannot force you to write down a confessional statement, whenever the act of force is included, then such statement cannot be admissible in the court of law.

One learned writer submitted that an ex- convict may contest for any public office but subject to some exceptional circumstances under section 137, 67 82. The exception would be reproduced for clarity purpose and ease of reference.



(a) where convict is under a death sentence;

(b) where less than 10 years before the date of election, he has been convicted and sentenced for an offence involving “dishonesty”

(c) He is found guilty of contravening the Code of conduct for public officers

By implication, the submission of the writer is that apart from those exceptions under section 137, 182, 67 of 1999 constitution an ex convict can contest for public office. Undisputably, the above cited section under section 137 can bar an ex convicts from contesting or holding any public office in Nigeria and this was rightly submitted in the case of A.P.C. v. P.D.P. ( 2015) 15 NWLR (Pt. 1480).

Hence, the focus of this article is solely on whether Nollywood actor, Funke Akindele and her husband can hold or contest for any public office as far as their conviction is still subsist until set aside by the appellate Court.
The writer submitted that the dou MAY hold or contest for any public office by relying on section 137(B) of 1999 constitution. With due respect to the learned writer, I beg to differ on this.
The writer produced the said section to substantiate his position but failed to produce same in WHOLE.

The said produced section
(b) where less than 10 years before the date of election, he has been convicted and sentenced for an offence involving “dishonesty”

Mr Arome Abu, further submitted to justify his position that

There is no doubt that since the offence for which they were convicted is not laced with any element of dishonesty, the fact of their conviction cannot operate as a bar to inhibit them from holding pubLIC office if they wish to do so in the future

Does the submission of the writer represent the position of the law for not producing the full section?
I would vehemently respond to this in negative.

The writer probably did shopping on the said provision of the Constitution and select the one that would favour his position and abandon the other limb of the provision.

It’s been held in replete of cases that statutory provision should not be construed in isolation but in whole in order to achieve the intention of the law makers.

ABARIBE v SPEAKER *HOUSE OF ASSEMBLY (2002) 4 NWLR
DANLADI v TARABA STATE HOUSE of ASSEMBLY(2005) 4 NWLR

The subsection 137 of the Constitution whom Arome Abu fails to produce shall be reproduced in full

(d) he is under a sentence of death imposed by any competent court of law or tribunal in Nigeria or a sentence of imprisonment or fine for any offence involving DISHONESTY or fraud (by whatever name called) or for any other offence, imposed on him by any court or tribunal or substituted by a competent authority for any other sentence imposed on him by such a court or tribunal

It’s very glaring beyond doubt from the above bold limb of this provision that the writer construed the above section and stopped under DISHONESTY which makes the writer to have misconceived the intendment of the law makers.

The Apex Court has poignantly addressed this issue in the case of DAPIALONG v DARIYE (Supra) that

the cardinal rule of construction is that the whole statute should be drawn upon as necessary, with its various parts being interpreted within their broader statutory context in a manner that furthers statutory purpose. I.e An holistic endeavor. we must not be guided by a single sentence or member of a sentence, but look to the provisions of the whole law, and to its object and policy.

However, since the writer intend to base his half- cited section on whether Funke Akindele and her Husband can hold or for any public office, it’s my humble submission that the dou CAN’T hold or contest for any public office in Nigeria as far their conviction is still subsist until same is set aside. It’s settled law that order, Judgement of the court is subsist no matter how wrongly delivered until same is set aside. See ELIAS V ECOBANK Nig PLC, CA/L873 2014

Though, there have been Legal debate whether Nollywood actor, Funke Akindele and her husband was legally convicted or otherwise. As it were, both CAN’T hold or contest for any public office provided their conviction is upturn on Appeal or being pardoned by State government. This shall be a subject of discourse in my next article.

It has outrightly becomes a norm that most guys find it really hard to win a girl’s heart, not because they don’t have the courage and what it takes but due to lack of prefix from the start.
This thought engulfed my whole heart lately and couldn’t help but point out some mistakes most guys make and however give solutions to help my brothers in the ministry.
Take a cool ride with me while i take you from your present predicament to a beautiful destination.

(1) Stop sliding into a lady’s DM with some usual words like “hey babe” “sop dear” “evening pretty damsel” “morning angel”...
These words makes you less important at first meet, and it’s annoying. You can start with a simple “Good morning, how are you”
These are formal, not attractive but easier to respond to.
(2) Please stop DMing random ladies you haven’t had a simple connection with, either on Facebook or any other social media platforms.
Take your time and make sure she gets familiar with your handle in some typa way. You may second or buttress her in the comment section. The gist is for her to sense a form of familiarity. This help in getting a quicker response/reply in DM.
(3) Do not DM a lady when she uploads her picture, that is the worst time to do such.
This time there are over 100 of guys sliding in then, you’ll get lost in the rubble. Wait till the fame dies down.
(4) Be creative.
The general notion is that when a guy slides in a lady’s DM, he wants a relationship.
Make her feel curious at first meet, you can go with something like “there’s something particular about you that makes me pay attention to you in the comment section”. Something like this makes her curious and wants to know more. She gets many “HI”s how are you” everyday, but when you establish a simple form of curiosity makes her grin and wants to click on your message.
(5) Try to be funny.
I’m not saying, turning the whole scene to a basketmouth show. Just create a sense of humor, perhaps compliment her in a funny way. Like “make hay while the sunshine is not applicable to you, you shines bright like a bald man’s head”
Something like this cracks her up, trust me, doing that distinct you from other guys.
(6) Do not abbreviate.
This mostly is a turn off for some ladies, make her sense you are bright bro, write in full.
(7) Know how to carry a conversation.
Don’t go by calling her “baby” “my love” when you just started talking, it renders you unimportant except she comes up with the vibe herself, know how to read the other party.
(cool Don’t make the conversation long at first meet.
Be precise, make it short, don’t write epistles pouring out your mind, a small compliment then end the conversation till the next day.
(9) Don’t say “tell me about yourself”
Go with something more matured like “though I know little about you and it interests me to know more, but first off let me start by telling you little about myself if you won’t mind” from this, you’ve created an avenue for a longer conversation which she’ll want to trade with you.
(10) Do not ask for her contact at first meet, make her feel secured, with her response you’ll know if she’s interested or not, if she replies often, then start by letting her know you hardly spend time online as your work doesn’t permit you, this will pass a message to her that you’re requesting for her contact, which she might gives willingly and if she doesn’t, chill for days before asking her.
(11) Don’t text her at any random time, do not text in the afternoon except it shows she’s online, people have jobs, target evenings...those times are for relaxations.
(12) Have self respect as a man.
You are a man, once you text twice and you don’t get a reply over a span of 5 days, delete that shit and pretend it never happened. You win some and lose some. Don’t go writing Hello 77 times.
