A bill will soon be passed into law criminalising the collection of multiple advance rents from tenants by Landlords in Lagos.

This is quite an interesting development. No more 'owo agreement'  and the rest embarassed

Inasmuch as the government has good intentions, monthly rent arrangement is not feasible in Nigeria at the moment. One year payment should be set as maximum rent advance.

you have a point there. at least a minimum of 6 months and a maximum of 1 years, will be considerable

There has been a thread on this topic, this is duplication. Any way thanks for the awareness for those that have not come across it before in political section (Non Politics lovers). At least now that it is in home page they can see it.

this will be a welcome development considering the hardship tenants go through in the hands of landlords and those thieves that call themselves estate agents.

That will be between him and his landlord because if they are both caught?!

1 year rent advance payment will be a big relief and will make housing more affordable for the working man , hope this comes to pass

This can't work. Why?

1, LandLords will not rent out if advance money is not paid.
2, How would government enforce this one?
3, No one is talking about tenants that don't want to pay. The reason why landlord are asking for money upfront is because people in Naija don't want to pay for anything
4, If you want to rent my property and i ask for advance of 2 years, will you then take me to court? or look else where?
Before you even pull a court case I have already decided that I am not renting to you.
5, What happens if tenant decides to take someone to court because they want to forcibly rent their property.

And apart from all these there are other ways round that law. I will not put anything in writing until i know you are ready to pay for 2 years. And even after you have paid for 2 year I will not give you a contract. So what will the court do. Where is the evidence?
As long as this is a seller's market LandLord is KING

Please tenants don't take this as offence,  it is very costly to be a landlord, and it may be a blessing in disguise to build one for yourself.
And poster please don't forget this is not government house. It should be left as a free market. But I don't support heartless land lord thou

the Government should build more Housing Estate and allow for health competition from the greedy Landlord and Agents. Enough of Law. We want alternatives. What Lagos State Government are building presently is worse than what the lANDLORAD ARE CHARGING,imagine a three bedroom of 7Million Naira from Government of the people.

it is not the governments job to provide housing. the most they could do i enforce regulation on that would help both sides of the housng market. people cant build something and expect total returns on cost in a few years it would drive prices past the sky.

my mum has two properties in Lagos, she collects 1yr max for one(flat), monthly for the other (rooms). If the guy in the flat wants to pay monthly, I'm sure she will bulge. Why do we think monthly payment wont work in 9ja?
It can definitely work. Just that the monthly fee will be another problem, maybe half your salary.

I dont even know how this greedy bastards who call themselves LandLords expect people to find ONE WHOLE years rent are they mad? People just end up borrowing money and get themselves into a mess.

It is criminal to ask a young graduate that just got a job of 150k per month to come and pay for 3yrs for a 250k apartment a year.
And don't also forget that Gov. Fashola is a sensible man. He has also made provision for Landlords to evict tenants who failed to pay
after 3months.

It's one thing to impose a rent law its another thing for Lagos Landlords/Agberos/Agents to obey it. For instance, if demand outweigh supply which is a usual thing in Lagos, some people will be willing to pay for 2 years in spite of housing law.
Presently, I paid for a 2 bedroom flat @ the rate of 250k p/a for 2 years and another 150k for agreement and commission, they are still demanding for another 6 months and extra 50k for commission.

Abeg U need 2 link me up with ur mum o! my 300k/yr X 3 years will be expiring by November, cant believe about 1m payment in 2006 expired so fast and am sure my landlord will b planning 2 increase it 2 400k/yr. Greedy Landlords!!!!!!!!!!!!

They own the property and if the government is making ways to make life easy for an average Nigerian, then it is a welcome idea.

but it is very wrong to call them greedy cos you were not there when they were paying Omo onile.

@webdezzi. U r right 2 an extent. In my case I never complained when I paid in excess of 1M in 2006 cos d property worths d price, though expensive. But I've been informed dat I will have to pay 400k/yr x 2years when my 1.something mill elapsed by November, is dat not greediness!!! at least 350k/yr would have been a welcomed development.

Am not sure if this was well thought out because looking at it, its like putting the cart before the horse.

1. The law of demand and supply - If there are more houses / flats for would be tenants to choose from, landlords won't be in a position to demand 2 or 3 years rent. Maybe its time for the government to put effort into mass housing

2. Credit worthy - There is no way for land lords to know that tenants will pay up monthly. In a country where the legal systems is forever developing, evicting non paying tenants will become a nightmare.

3. Administration of the collection process - The banking system needs to get to a level where landlords / tenants can set up direct debits for monthly collection without the landlords having to come looking three or four times each month before collecting his / her money. And what about landlords who are abroad?  Remember there are no trust worthy rent administration companies

4. Cost of buying / building houses - Landlords are business men and women looking to make profits, just looking at the asking prices of some properties, especially in Lagos gives me instant headache

5. This has the same feel and look of when the federal government decided to ban the importation of vehicles that are certain years old instead of putting efforts into making it possible for investors to invest in the automobile industry. The outcome, well Nigerians started bringing in such vehicles through Cotonou and created another avenue for customs to make money.

6. Not totally sure about this but I think  rent capping etc  was tried in Lagos in the past and it met with failure.

'Lessons Learned' are important part of governance.

Anyway, we shall get there eventually.

what i think they should do is to stop all this

agency and legal fee - right now even if you pay for one years rent you still pay 10% of the amount for 2 yrs for agency plus 10% of the amount for legal for 2yrs.

someone should please show me the law that justifies this. its daylight robbery

Great news!!! Its a good news to follow up the "housing for all" vision. Governor Fash is the messiah that we were been told would be coming to lagos lol. Its another step forward!

When you allow criminal acts to go on for too long, it becomes like a norm to the people.
That is the case of this advance rent. Why shouldn't I be able to rent a house for just two months?

The criminal act had been allowed for too long and various generations have come to grow to meet
the nonsense. Now it seems normal and people are even finding argument for it on nairaland

Call a spade a spade. Its another sensible one from Gov. Fashola, the God sent for Lagosians
