Before Delta State people are shortchanged

It is a needless debate but the federal government is doing everything to turn the proprietary of a £4.2 million (N2.4 billion at the official exchange rate) to be repatriated to the country by the UK government, into one. The money was realized from parts of assets recovered from a former Delta state governor, Chief James Ibori, by the British government.

On Monday, Nigeria and British governments signed a memorandum of understanding (MoU) on returning the money to Nigeria, and controversy set in when the Minister of Justice and Attorney-General of Federation, Abubakar Malami, hinted that the money would go to the federation account and not the Delta state treasury. Things got even messy when Malami noted that the money will be deployed to completing the Second Niger Bridge and the Lagos-Ibadan Expressway, among other projects.

“In consonance with existing framework engaged in the management of previous recoveries, the Federal Executive Council has directed that the instant repatriated funds should be deployed towards the completion of the Second Niger Bridge, the Abuja-Kano expressway, and the Lagos-Ibadan expressway under the coordination of the Nigeria Social Investment Authority (NSIA),” Malami was quoted to have said during the signing of the memorandum of understanding.

That decision is outlandish, to say the least, and expectedly, sparked a fierce debate among Nigerians. Whether on the media space or public gatherings, Nigerians have expressed divergent views on the controversy. For some, the federal government was right to claim ownership and determine usage but that argument didn’t go well with some others who pointed out that since the money was from the Delta state treasury in the first instance, the state should get back the money.

In law, and even morally, recovered assets should be returned to the treasury it originally belonged to, no matter how difficult it took to get it, or who helped in facilitating the recovery. In the past, a lot of assets that were unlawfully frittered from different states were returned to the rightful owners. Those recovered assets were sent to the state’s treasuries where they were unlawfully taken and for the benefits of the people who are entitled to them in the first place.

This is what a renowned human rights lawyer, Femi Falana, SAN, tried to point out in his argument that the £4.2 million should be returned to the Delta state government. Falana, who went through memory lane to point out instances of similar recoveries returned to state governments, wondered why the federal government will be taking a different approach on that of Delta state.

“The £4.2m does not belong to the Federal Government,” Falana declared in a statement, recalling that “The money confiscated from Governor Joshua Dariye in the UK was recovered by the Federal Government, repatriated to Nigeria and returned to the Plateau State Government.” Continuing, Falana noted that “The money confiscated from Governor Diepreye Alamieyeseigha in the UK was recovered by the Federal Government, repatriated to Nigeria and remitted to the account of Bayelsa State Government.” So, why should the case of Delta state be different?

If assets are confiscated from Ibori, who at no time was a federal minister or served at the federal level, then how could Malami or anyone at the central government justify the glaring attempt to deny the Delta people what rightly belongs to them? The excuses of the Delta state government not owning up to any money been lost is at best, flimsy and a calculated move to divert what obviously belongs to the people of Delta.

Just as the Commissioner for Information in Delta state, Charles Aniagwu, alarmed, the plan by the federal government to appropriate the money is the height of wickedness because the people of the state lose on both ends. “Why should Delta State money be used in building Lagos-Ibadan Expressway or Abuja-Kano rail?” Aniagwu queried. As with most arguments against the federal government move, Aniagwu maintained that the money belonged to Delta state and that the state “would have understood if the Federal Government had said it wants to receive 20 percent, but to take all the money is wrong.”

Indeed, it will be wrong and a dangerous scheming to shortchange millions of Deltans who are the original owner of the money. The arguments advanced that by returning the money to Delta state, the bad conduct of state government would be rewarded, are at best specious and runs against the principle of fairness and justice, because it intends to deprive people of Delta state what rightfully belongs to them for the benefit of others without their consents and inputs.

With this context, the right thing to do is to return the money to the Delta state government treasury. That will not just be impactful on the people who originally own it, but show that they will not be shortchanged under any guise. That is fairness and justice, and the federal government should not act differently.

Delta state will not get a kobo from that money since they decided to be stupid. Not like if they got it, the ordinary Deltas would have benefitted from it anyway.

When Ibori was on trial, the Attorney-General of Delta swore an affidavit on oath before the Court that Delta state's money was not missing and that even if it was missing, it was the Attorney General of Delta state who should prosecute the matter and not the Attorney General of the Federation. That's why the $15M Ibori wanted to use in bribing Ribadu, it was forfeited to the FG since Delta denied ownership.

If Delta is not careful, the former AG of Delta will go to jail over the lies in the affidavit he swore. Yet, 1 kobo, Delta will not see.

The Delta State Government denied having any missing funds, that was the moment, they lost the right to reclaim their looted funds. Even the current governor knows in his heart that they bleeped up. The best thing they can do is to plead with FG at best and not starting to claim legal rights

Stupidity.
The laws on recovered funds is very clear. Any money recovered from public/civil servant goes directly to the federation account.
The only way the money can go to another person/company is when it is private organisation or individual money that was stolen in the first place.
If an individual/private organization funds were swindled they can invite the EFCC to help them in recovering the said sum and/or prosecution, in such situation the funds will be returned to that same individual/organisation.
Whereas if the money was looted from the public treasury (federal/state/local government) the recovered fund goes back to federation account no question on that.
The penalty to the state/local government or federal parastatal that allow the funds to he stolen in the first place is they will loose the whole money which they allow by their action/inaction to be stolen.
Now to this case the case involves different countries, and the rule of recovering from western countries is that before they repatriate the funds they must know what it is going to be used for, and they will be monitoring the process throughout to make sure it was followed diligently.
Also Delta claims no funds were missing, so how can they receive something that is not missing in the first place?
Delta state should forget this money. They will never get it back.

The money belongs to delta state and its ought to be given back to them but, the truth is that is it lands in delta, it 'll find it's way to Ibori's Pocket ..He is still a father when it comes to politics in the state....
On the hand, FG couldn't account for other recoveries, it means what happened to Abacha loot 'll still happen to Ibori's own...

Delta State has denied ownership of the money. It is on record. He who comes to equity must come with clean hands. Delta State has its hands soiled in this matter. Delta State and its society of citizens who have a culture of corruption clearly do not deserve a whiff of the money or project done with the money. Truth is bitter. It is advised that Ibori go to God in repentance before his time to face death and meet God arrives. We all will account for our time here. Hypocrites will suffer crisis when it’s time to face death and meet God in judgment.

What injustice to Deltans? A people who tolerate and celebrate corruption and Thief Ibori! A people who condone stealing from the public treasury! What is not deserved should not be conferred! Clearly, they do not deserve the money. You can be %99.5 sure the money will find its way back to Thief Ibori if UK had allowed its return to Delta State. The UK and Strive Masiyiwa who testified against Ibori on the stealing of Delta State Econet shareholding by Ibori know that Ibori has always been a thief and intensely criminally minded individual from back then when he was a petty thief at the supermarket in London where he worked as a hustler. The Delta State people and society appears to have a culture of corruption! They kept very quiet on the matter! Check out The Asaba Airport physical structure for example! What a society! Visit Sapele and check out the personal buildings of Osadebe a former Min of Finance- constructed so solidly nails will find it difficult getting hammered into its walls. Contrast public structures he and his ilks built and are still building in Delta. Very sad to see!

No one is saying the federal government cannot use the money to execute project in delta state. The point is Deltans do not deserve it having denied it belonged to Delta in their unenviable bid to protect Ibori from prosecution and conviction for obvious reasons. They cannot eat their cake and have it. They cannot approbate and reprobate at the same time.

The money is not revenue accruing to the FG. It belongs to British Govt whose prosecutorial system nailed Ibori the shameless common thief of Oghara, Delta State when ours failed to do so. The British nailed Ibori and recovered the laundered money from him Delta State having abandoned its property rights in the money. Britain chose to give the money to Nigeria with a caveat that it should be used to execute verifiable infrastructural projects.

The terms of its return are clearly specified in the MOU signed between two sovereign States and NIGERIA is bound to ensure its observance.
Delta State for obvious reasons stood idly by while NIGERIA fought to recover the loot from Thief Ibori. It denied its coffers were looted by The Oghara Thief. The Marcellus Awokulehin infamous Court Judgment of the Federal High Court Asaba ruled that it was not Thief Ibori from Oghara but another Ibori who poo poo all over Delta State Treasury. Now some folks say it belongs to Delta State Government! Even Delta State Government has been mum on the matter! Silly thought indeed!
