A lot of people are still in the dark as to whether the FG acted lawfully on Kanu's purpoted repatriation. Judge with this analogy.


A man named Mr Charles owns a smartphone. One day, he decided to charge in his neighbour's house.

His neighbour named James opened the door to him, accepted and plugged in the phone for him.

In the evening, on his way back from the church, he saw another friend named John with same phone. John claims that Charles unlawfully took a picture of him john, and, as a man of principle, he John has finally gotten the phone and wants to be fair by deleting only the wanted picture in the presence of Mr Charles. Mr John also fails to disclose how he got the phone.


Questions

Should Mr John who was found with someone's smartphone be allowed to proceed to tamper with the phone or should he answer questions for theft? Does his unwillingness to disclose how he got the phone justify having a property not belonging to him?

Is Mr James in whose custody the phone went missing off the hook? Can he successfully deny the phone's whereabouts despite collecting and plugging it in for Mr Charles?

Does the phone's owner, Mr Charles have the right to reclaim his phone unconditionally, and even demand for Mr John's punishment?

Answer the questions and understand why malami was called a disgrace to the rule of law.

BTW, Mr Charles represents the United kingdom. The Smartphone represents Nnamdi KANU. Mr James represents Kenya, While Mr John represents Nigeria.

Mr Charles and Mr John are joint owners of the phone 50-50 with each of them having equal ownership of the phone and this is known by Mr James.

Basically imagine Mr Charles and Mr John as a married couple and Charles leave a phone with James.

John then comes later to collect the phone.


Charles can be upset but who cares? The phone belongs to the both of them legally

Two people can't own a phone at the same time. therefore your analogy does not suffice since the UK has the sole stake to Kanu's citizenship in circumstance under consideration, having traveled with their passport.

obviously he shouldn't be allowed to continue tempering with what isn't rightfully his. The owner must approve of it.

No, it doesn't justify shit.

Well in my opinion, he should be let off. Obviously John tricked him into giving him the phone when he told him he just wanted to delete a picture that belongs to him that's in the phone. He should get little or no punishment.

no he cannot except he's a good liar and charles decides to just let it slide

sorry, your argument of dual citizenship is not valid here since one cannot travel with two passports at the same time. Any country on whose passport one travels is the one that protects an individual. Nigeria will run into trouble the same way Kenya would run into trouble it they Kidnap Obama with US passport on foreign soil.

That he travelled with a passport does not in anyway negate the fact that he is a citizen of the other country. A passport is just an evidence that you are a citizen for travel reasons. Being a citizen is more than the passport

You travel as a citizen of the country you have their passport not as a dual citizen. As a matter of fact, one cannot enjoy the citizenship of two countries at a time. So, Kanu was kidnapped as a British under international law. Your giving up your argument is well understood.

When Kanu was arrested in Kenya, there was a passport found on him and that’s the country he should have been repatriated to.

Nothing concerns Nigeria at all.

If Kanu had committed a crime in Kenya, the news headline would have read “A British Nationale does so and so”... there wouldn’t have been any mention of Nigeria because nothing Nigerian is on him.

No. You travel on a passport. If you are traveling with British passport, it means you are traveling as a British and the law sees you as such. The idea of dual citizenship does not apply here.
