She isn't , but some people have been fortunate to get their passport submitted and some were not allowed, when it was just a day late, I guess that's where favour comes in .

If you don't get a closer date you can take the risk ..cos the conditions are clearly spelt out ..within 24 months after your visa expired or 3 months before expiration date .

It’s a general thing and there’s nothing anyone can do about it.
You can either decide to wait for 8 months or just forget about any US trip…

You are right but if someone decides to faith it and it works for the person , isn't that favour .

I personally won't apply if I was not qualified but to each her own .

It is not that they choose not to submit, but if they don't get an IW appointment dates , and while waiting they are no longer eligible and they are willing to try, why should we discourage it as long as they are not taking someone else's place .

I am a student in London applying for a Usa visiting visa. I have been denied a visiting visa once in Nigeria in 2018.
My program is still January 2023 and my brp ends in May 2023, Two years msc program. I am 33, unmarried, female.
Pls how do I go about my application not be denied
Do I use myself as sponsor, do I use a hotel as place of stay or a friends address.

Just say the truth about yourself and your intentions.

To be frank, it’s better to fill a hotel accommodation on the DS160 form…not wise to put a friend’s house as where you’ll be staying. The fact that you are applying during your Master’s program will give a bit of credence to your claim to be a tourist…since you’ve committed resources to your UK programme already and will desire to complete it…

Hello, I would advise you to use yourself as a sponsor and book a hotel.

I got my first US visit visa three months after I commenced my Master's programme. It was in London and during the interview I was asked which State I was going to and why I chose that particular State. I was also asked what I was doing before my masters and how I was finding the programme.

Just say the truth about yourself and your intentions.

To be frank, it’s better to fill a hotel accommodation on the DS160 form…not wise to put a friend’s house as where you’ll be staying. The fact that you are applying during your Master’s program will give a bit of credence to your claim to be a tourist…since you’ve committed resources to your UK programme already and will desire to complete it…

I want to start a fresh application for my father in-law and mother in-law, however, I want to open just one cgi federal account and add the other as someone you're travelling with because I want them to attend the interview together (my mother in-law doesn't understand English that much, so my father in-law would help). So my question, do I need to pay MRV fee for each of them even though i'm adding 1 to another?

Please I have put in my application for visa renewal and since I was no longer qualified for IW, I have been checking for an interview date, all I am seeing is March 2024 upward. What should I do, wait till I get a favourable date or just click on the available date? How many times can one change/reschedule an appointment date? Many thanks.

I can’t beat my chest and answer authoritatively…but if I’m the VO, I’ll be wondering why a non-family member will agree to host you in his apartment for few weeks free of charge (remember that the VO isn’t an African and may not understand our communal style of living in Nigeria)…
If you claim to be going on holiday, then it’s assumed that you have made adequate preparation and provision for it…
“Staying with a friend” is a red flag, for me (I’m talking of stating such on the DS160 form ni o)

Noted but I have gotten a US visa twice in the past on the invitation of a friend who we lived together for several years before he relocated to the US. They just asked me how long we have known and all that. The way they deny these days is the reason why we sometimes get confused as to what they really want to see or hear. The last time I went for an interview, a young man was refused when he said he was going to stay with his mom when asked who was going to host him in the US. That family tie is very strong and could raise a red flag that the family member may keep you back and help you navigate the system as an illegal.

Hello, I want to ask a question ,A friend is in the US Presently ,He Traveled with Tourist Visa He has Spents 3 Months Now .

He Met a Nigerian Lady who is a Citizen in a Mall ,He heard the Woman Speaks her Dialects,he Greeted her ,Well they became friends ,Visits ,they became intimate Friends Etc Started . According to what He Told me ,I have chatted live with both of them via Videos and Phone .He told me She is one of the first set of Nigerians that Won Visa Lottery when it was Sooo New Many Years ago .

The Woman is a single mother of one ,Lives alone .

The Relationship is getting so deep that they are planning to marry each other .

His Tourist Visa Would Expire in 3 months time, I'm Advising him not to Overstay his Tourist Visa .I also advised that He could get Married to her ,Obtain Marriage Certificate then get back to Nigeria then she can File for him ,Spouse Visa ....

I have not Traveled before to USA ,I only read about Travelling Experiences ..Please Folks that have Experience ...I need your Input on this ..

He is a very Nice Fellow ,I have heard that Overstaying after Visa Expiration can be So Bad ..

What has he been doing for the past 3 months to sustain his continued stay in the US?
Has he been working, or he has so much money he has spent 3 months in the US and has not returned to his home base to get back to work or run his business?
Has he been staying at hotel for 90 days? Or he has accommodation arrangements somewhere?

What did he tell the VO at his interview WRT length of stay?

He probably was stamped in for 6 months at PoE, so he hasn't broken any law right now, but he will have difficulty at the next interview or even a repeat PoE on the same visa.

Now the flip side to all of this is that it is not against the US law to visit the US on a B visa and find love, get married and adjust status. The issue is people abuse the B visa in other to pursue marriage, which is different from what was said at the interview in getting the B visa.

This is the misrepresentation at visa interview. This is why there is an assumption of immigration intent you are supposed to dispel. He dispelled that which he is now doing.

All of this will be nitpicked at his green card interview after his married, and God help a stokes interview is triggered down the line.

If he satisfy the questions at the interview, then he's fine.

Has he broken any law yet? No
Can he find love and get married? Yes
Is 3 months overstay? If he was stamped 6 months at PoE, then No.

But these questions and the answers will be judged by what he filled in his DS160 and what he said at the interview, and USCIS may deny his green card application as marriage for green card and he ends up in immigration court with no EAD while the case is adjudicated. If not denied. He will get 2 years, then 10 years green card and be eligible for US citizenship.

Can he get married, come back home and she sponsors a spousal visa? Yes. It may take a while for it to come through, which people avoid, by staying back.

You, him whoever is the true person in this situation should seek legal advise from an immigration lawyer.

Him being a nice fellow is irrelevant to the case completely.

If he’s sure they are getting married he can adjust status over there in the USA even though his visa has expired but if he overstays and they don’t get married he’s screwed.

Questions : Should he Get married ,then get back to Nigeria before his Visa Expiration and wait for his Spouse to file for him ?

People adjust status all the time.If he is single and the woman is single they can get married,and as long as the marriage is bonafide,he ll get his green card.Thats all the UScis wanna confirm. You can fall in love after 90 days and get married;but not before 90 days
