Kogi election: Faleke’s supporters to sue INEC& APC

Supporters of James Faleke, deputy governorship candidate of the All Progressives Congress (APC), in the Kogi election, have decided to sue the Independent National Electoral Commission (INEC) for declaring last Saturday’s election inconclusive.

The group at a briefing in Lokoja, wondered why INEC declared inconclusive, an election that had produced a clear winner.

Messrs Achama Matthew and Mohammed Abdulahi, in a communique they signed on behalf of the group, also said the fresh primaries being proposed by the APC to replace late Prince Abubakar Audu, was unnecessary.


According to them, only 32,785 of the 49,953 registered voters in the area where INEC scheduled to hold the December 5 supplementary election had the Permanent Voter Cards (PVCs).

“INEC should be courageous to declare Audu/Faleke as the winner of the election. With 240,867 votes, Audu was leading his closest rival and incumbent Governor Idris Wada of the Peoples Democratic Party (PDP), with 41,353 votes, having polled 199,514 votes,” they said.[/b]

He is evidently wasting his time. APC will pick Yahaye Bello, and that will be the final decision. He should forget about profiting of the death of Audu and instead hope he enters the government house as the deputy governor.

APC has the choice of either going the easy way by allowing Faleke to complete the process or the hard way of the law courts..

It is entirely up to them, but INEC & the AGF erred & are now turning the constitution & electoral laws on their head!!!

you people take this barcanista character seriously. At the end of the day, a fresh election will be conducted in Kogi, which is the only lawful thing to do.

My guy, stop advocating for illegitimacy. The Yahaya Bello can NEVER be Governor anytime soon. APC has no choice but to go along with Abiodun Faleke, while INEC has no choice but to go-ahead with the event. You CAN'T bring in a fresh primary when election has kick-started. If people don't want Faleke for his Yoruba ancestry, then they should tell me whether faleke is not a Kogi man or he wasn't legitimately nominated as running mate.

in wildest dream, Yahaya Bello might be a chairman of Okene not Kogi Governor. He has not been performing and contributing to the campaign of Apc since he was defeated by Audu and even if he stand for primary he can't win. Also, Apc are not stupid to pick a man who is not active, he can't even deliver in Okene which Wada won

What an arrant submission. This is somebody who sweated under the scorching sun of kogi during the campaign with Audu. Now you want him to take a bow and step aside. So in your warped opinion, who do you think is more deserving of the position?

A fresh Election can never be conducted in Kogi State. Do you expect the INEC to conduct a fresh Election if the Candidate of PPA who has managed to secure 20,000 votes of the 35m accredited voters, dies after the Presidential Election is declared inconclusive? Hadn't been it was a Candidate of a small Party that died and Wada was leading, would you have said a fresh Election should be conducted?

stupid analogy. The election was declared inconclusive. Either a fresh election is conducted with APC fielding a different candidate or it will amount to APC not having a candidate for the election. Either of These 2 options must play out. Modath should think everything is about yoruba interest. I dey laugh.

Inec does not ve the power under the constitution or electoral act to cancel an already announced election, only the tribunal has such power, but they ve the right under the same act and constitution to "Regulate, issue guidelines and rules in election matters".
This option they ve decided to explore, Falake is eliminated unfortunately because he did not go through any primary, which the Court and Electoral Act stipulate as a condition for substitution. I may not like it, but that is the law holding Falake down, Yahaya bello is the other legal option.
If on the other hand the party goes ahead to conduct a primary it will be because APC Kogi don't want Bello, maybe due to his i don't care altitude towards Audu campaign and election as inferred from some of the post on this forum.
As i said, if the party still goes ahead to hold the primary, then it is a deliberate move against Yahaya and a risk they plan to take just to achieve that purpose and in the interim get the Governorship stool off PDP for now, definitely PDP and possibly Yahaya will contest it in court. For now Inec is relying on the only power it has which is the power to regulate, issue guidelines and rules, believing that from the known in law the un known can be established.

With Audu dead, the votes to him are automatically annulled or votes for the dead. This was the same way Abiola's June 12 was annulled. With his death, neither Kingibe nor SDP was declared. Wada should immediately seek an interlocutory injuction barring INEC from conducting the supplementary elections, rather Wada should be declared winner as APC has NO CANDIDATE to conclude the elections. Moreover, the Taraba tribunal ruling comes to play here.

Finally, this group has gone the way i predicted, but i guess they waited too long, they should have done this by tuesday. the APC primary planned if at all can only produce a consensus candidate in the person of James Faleleke, he was actively involved in the campaign as the running mate, and the joint ticket of him & audu have produced 241,000 + votes, an insurmountable lead. It will total Injustice on Faleke if a new man inherits the 0ver 95% election result. It is like saying in a union of husband and wife, at husband death, the husband friend is made to inherit his property ahead of his wife. Who does that?

exactly my thoughts. So far a winner was not announced. That means the election is still in process and the period for substituting candidates according to INEC law has elapsed. Recall the supreme Court ruling of Amaechi vs Omehia. The Supreme Court ruled against substituting candidates. So the most logical thing to do is to either declare Wada as governor elect since APC has NO candidate or fix a new date for a fresh election

This INEC has become more of the more you look the less you see.

PVC has no place in the electoral laws nor does it has any place in our constitution. What the constitution recognises is the number of registered voters.

From the death of Audu, all votes cast for him are also dead as he was not declared before his death, his party also got 'dead' votes. It is like thumb printing for a party without candidate on the ballot. As it stands APC has no candidate to conclude elections, so the contest is between Wada and LP candidate. That is the position of law as of today.

No new elections are required, all Wada should do is seek legal redress stopping INEC from including a dead candidate in any elections to conclude the Kogi gubernatorial polls. Assuming it is any of the other party candidate that died, would INEC be bothered? The law is clear and we should not stand it on its head because APC is involved.
As for substitution of candidates, the time has passed so unfortunately, APC and INEC need to seek constitutional amendments for the future.
