I am a Nigerian schooling in Australia. My wife is an American as we met and married in Australia.
Recently, she has been pushing that we relocate to US after my studies.
She claims to miss her family so much and can't leave me behind in Australia.
For me, Australia is a beautiful country with better wages compared to America. She insists that with my degrees, I'll be fine in America.

I do not want to go there on visiting visa.

Depending on the length of time of your marriage, your spouse may file for you as a CR1 spouse (married less than 2 years) or an IR1 spouse (married more than 2 years). ladies and gentlemen in the house, please i need your help, we got a visa for 2 yrs, last december 2016, wifey was suppose to put to bed in the u.s,she was pregnant,we informed them and she couldnt travel due to one health drama or the other,she put to bed in 9ja. however i want to use the visa now but i intend to apply for my daughter (the new born) and including either my cousine who is with us or my brother, please advise if i need any letter from either of their parents to submit application or take to the embassy, we plan to travel in March 2018. we are going to newark, i will need the best/cheap airline advise and best airport to land to avoid any POE dramas

For visa classes where derivatives may be added, it depends on where the file is. If the file is still with the National Visa Center, the principal applicant should contact them with the birth certificate of the child so they may add the child to the petition. If the file has already been sent to the consulate, the principal applicant should email the consulate with the same information on the child. At that time, they will also need to obtain a medical exam for the child, fill out a DS-260 biographical form, and be prepared to pay the fee for the new baby at the time of the interview. The baby will also need an international passport.

In terms of giving birth before or after an interview, if the baby is due before the principal applicant plans to travel, the baby will still require all the necessary documentation listed above in order to be issued a visa.

Thank you very much for the response V.O. One quick question sir. You mentioned that the baby will need a Ds 260 form as well, and due to the movement of the visa bulletin, its obvious our case would not be current until next year. If the case is with the consulate by then, how do we fill the ds260, cos its online. Will the baby's ds260 appear online under my case file once logged in, after the consulate has been notified? or is the form going to be filled at the embassy on the day of the interview. Really appreciate your response sir.

Please could you confirm if it's true the recipient of a K3 visa have to go back to the country were the marriage was taken place? Secondly, can you please confirm if a K3 visa is being processed at the Consulate in China, precisely Shanghai? Thanks

My understanding is that we do not process K3 visas at the consulate at this time.

As previously noted, nonimmigrant visas and immigrant visas are adjudicated with different considerations in mind so prior B1/B2 refusals may not necessarily have a negative impact on the adjudication. Immigrant visas are adjudicated based on the claimed relationship between the petitioner and the beneficiary. As for the length of time it takes for a petition to be filed, approved, and scheduled for an interview, it depends on a number of factors. As such, it is impossible to state with specificity how long the different processes would take.

Good morning.
Please, I'm confused about something. My supposed monthly pay is different from my actual monthly earning due to some deductions as a result of the upfront payment that my company gives. Please, if asked what my monthly pay is, what would you advise me to state as my monthly pay?
Let me give an example. A man is supposed to earn 600k monthly (7.2 million annual income). In the first year, the company pays him over say 3 million naira upfront. Now, his actual monthly payment is 600k minus deductions as a result of the upfront payment spread over 12 months. Actual monthly pay now amounts to 300k. What should he tell the VO is his monthly pay if asked? 600k or 300k?

First, the immigrant visa interview is not an interview for a green card; it is an interview for a visa. Green cards are issued in the United States by USCIS after an immigrant has entered the United States and filed the proper paperwork and paid the relevant fees.

In terms of the questions the officer may ask, it depends. Remember that the immigrant visa adjudication is based on the claimed relationship between the petitioner and the beneficiary. As such, an applicant can generally be expected to answer questions about this relationship.

Hello, I will like to ask how long does NVC reply after your k1 visa petition has been approved and how does they contact you?

Hi, I have a few questions surrounding a K1 visa. When the petitioner submits the signed form I-134 for the interview, does the Lagos Embassy accept this form scanned or does it have to be original 'wet signature', meaning I would have to mail it from the States so my finacee has it.

Secondly, I plan on providing the last 3 years tax transcripts, is this fine or do I need to include my federal returns (1040's) notarized, as well? I have other documents that i will be providing but I keep reading conflicting information regarding tax transcripts and/or federal returns and whether or not it needs to be notarized as well.

Lastly, I read that when providing chats as evidence, it should not be copied to Microsoft Word (for example), but should be from the site. However, with both facebook and whatsapp, they have an option to where you can export your chat, which is in text format (whatsapp) and facebook exports it into like HTML format, but still just text basically. So, is this an issue? Should I just do screenshots instead? Also, the chats for both cover the time span of one year. Most people say to include about 4 pages per month, to show the continued correspondence month to month, instead of providing thousands or pages of chat. Do you agree that this would suffice, about 4 pages per month (I think I may have did 7 pages). But again, if text format isnt good, I will have to revisit this and do it again (screenshots?) so she will have the proper evidence for the interview.

The issue now is that I am a man and I have done change of name (for obvious family reasons) and wish to apply with the new name.

Thanks for this wonderful platform. I have three questions;

1. Can I enter the US a day or two after the start date on my I-20?

2. My visa approval has been stalled since last week Friday as the VO placed me on administrative processing. My research assistanship was not stated on my I-20 and I guess she was skeptical about its authenticity. My start date is Jan 8 and the school won't resume until Jan 2 for confirmation of this funding. Does the embassy bear this in mind while addressing issues like this?

3. Say, my visa is issued on Jan 8, can I still travel knowing fully well that Jan 8 is the start date. If No, what steps can I take aside deferring my admission till fall.
