Exactly. In the world of diplomacy leadership must raise poultry to feed the foxes if it wants to rid the country side of such savages. Even terrorists know this so they abduct, not for raw show of power but so they can have a currency of exchange. In a three way power equation there is no way you can win with all your pawns intact. You must make sacrifices to win. This win at no cost approach by the three arms has resulted in significant losses for them all. It is mere foolishness for each arm to try and destroy or debilitate the other arm. Granted stability is guaranteed in diametric tension but it all should be done under the canopy of the rule of law. In this we have not matured. All these 'my way or total destruction' is symptomatic of political toddling which is getting us nowhere.

Well said but what is the way out?

He must perform it constitutionally- His role is to show the certificate received not to subject it to a debate. So the certificate of recall is binding shown or not[ quote author=HAH post=67090089]Senate President To Perform Last Function In Recall Process Of A Senator

In that case when INEC finishes their abracadabra we will spend another 12 months in the court while Dino will remain a distinguished senator of the FRN

It doesn't matter. The rule of law must take effect at the end of the day.

With the above if Saraki just decide not to perform the last function the whole exercise of Dinos recall is in futility.

The process is so difficult that before it gets to saraki I will already be defeated

Story, we have had a Senate president refuse to swear in a duly elected senator until the very last month of the end of the regime... That should be..... The senator is from Anambra state...... Ubanese

stop beating about.

Inec has the power to issue or withdraw certificate of return for public office holder.
Saraki part is just a formality process that cannot alter or stop the process.
Just like chief judge of the federation declining to swear in a democratic elected president with certificate of return .it will never stop the president from ascending to the seat .
To cut the short, saraki part is ceremonial it cannot stop or alter the process.
Once inec completes her part Dino certificate is withdrawn. The security officers re notified .Dino can never be allowed to enter the nass complex until another person is elected by the constituency

CONTINUE DECEIVING YOURSELF.wHEN THE PROCESS IS NOT COMPLETED COME AND REMOVE HIM LETS SEE.FROM ALL INDICATIONS THE RECALL APPEARS TO HAVE FALIED AS PEOPLE HAVE SHUNNED THE VERIFICATION PROCESS

We need to understand the genesis of the movie in Kogi. The fight is between Dino and Bello, Dino wants to pose as a godfather in Kogi state politics after the death of Abubakar Audu, he supported Yaya Bello to become governor against Faleke who campaigned in all local governments in Kogi along side Abubakar Audu to win the Governorship sit. knowing the power he possess as the governor Yaya Bello now wants to put Dino in his place. Buhari's has nothing to do with these.
Ur u telling me a governor in kogi state has more influence over police in abuja to arrest a federal senator in abuja national congress.without d backing of the presidency the executive and chief commander of the armed forces who directly can command the police all over Nigeria arresting an elder statesman(senator) by a governor of kogi state is not possible.melaye has constitutional immunity thats y d arrest of omo agege the mace theft senator was not possible everybody knows buhari doesn't not respect the Constitution if he wants to victimize people as in the case of dasuki,s detainment.buhari is a civilian dictator sikena!!!

Correct me if I'm wrong but a recall would be followed by the replacement of the deposed senator wouldn't it?

It would be criminal to prevent the constituency from having representation.

Anambra North stayed almost 2 years without a senator representing them did anyone tagged it a crime?

What a dumb positioning in your last statement. What an irritating show of ineptitude!

You showed us what the constitution says..."the Senate President will effect the recall".

Do you what it means to effect upon something?

To bring about the required or expected outcome.

So the recall is already completed by the time INEC sends a letter to SARAKI. At that point INEC has completed its statutory duty of the recall, it is now Saraki's turn to act, INVOLUNTARILY on the constitutional statute and "effect" the letter sent to him by INEC.

Are you telling us the Senate President has discretion to obey or disobey the constitution?

You are an embarassment to academic credentials. Your education is not worth the paper your degree is printed on. Very annoying Nigerian! Calling for Senate President to disregard Constitution.

Is it not the constitution we are making use of and some other persons will be posting thrash. The DSP has elaborated on this issue and as a professor of constitutional law, his facts are Well enumerated. So whatever thing you are hearing or reading outside the constitution is just like chasing a wild goose.

Omo Agege did not walk in and snatch mace. If he did he will be in deep shyte, his immunity notwithstanding. The immunity is not absolute!

In Melaye's case, he was a direct accessory to felony crimes. He provided and tooled people with weapons of deadly force, not for self defense....but for assault.

But he can still refused to do the needful unless someone sue him and it will take 4yrs for the court to determine that.

Was evidence proven in a court before his forceful detained arrest of an elder statesmen in a democracy.anybody can accuse anybody of anything the fact has to be established in court.is it in court yet.his immunity stands Constitutionally as a serving senator but was not respected.some members of the public applaud it like u cos of the disdain have for legislators and party loyalty

immunity is only limited to President, vice President, Governor and deputy Governor, senators don't have immunity in the Nigerian constitution. Senator Ovie Omo-agege can be arrested but he denied knowing those thugs, we all believe that those thugs are working for him but Nigerian Police don't conclude that way without investigation, if you can remember vividly senator Ali Ndume was arrested and tried when he was accused of financing Boko Haram but was declared not guilty, the Senator representing Delta North recently was also arrested for fraud but was granted bail on self recognition but the case is still in court. The Senate President Bukola Saraki was also ducked before Justice Danladi Umar. Senator Dino Melaye can also be arrested, tried, jailed or declared not guilty as the case may be, the nature of Senator Dino Melaye's case involves murder, unlawful possession of fire arm and sponsoring thugs to disturb the peace of Kogi state which we will agree that all politicians in Nigeria are guilty of (not saying Senator Melaye is guilty), Senator Melaye and Governor Bello are only fighting for supremacy which is uncalled for. I have learned to give honor to whom honor is due, if some one is superior to you, you don't have to be rude when proving a point. Senator Melaye threatened to beat and rape Senator Oluremi Tinubu on the floor of the Senate and boosted that her husband can not do anything, he was even childish enough to snap a picture close to their residence in Lagos challenging them. Senator Dino melaye also insulted Mr. Adams Oshiomole (former governor of Edo state) and his wife. This Senator have stepped on toes which can be avoided. If we don't agree with people older or more influential than us, it's better we express ourselves and stand our ground without been rude. I'm not in the position to judge Senator Dino Melaye, I'm only interested in watching their movie. I don't vote because PDP and APC are all the same (theirs no permanent friend or enemy in Nigerian politics). According to Hon. Rotimi Amechi during his Senate screening he said '' if politicians agree on sharing formula which favors them, they don't remember their people but when the sharing formula is not in their favor they go back to their people to say they are marginalizing us'' they only use the vulnerable people as their foot soldiers.

U must be a core apc supporter i stopped being an apc supporting zombie 3months into buhari,s tenure when he said he won't favor 5% of the country for not voting him.i knew then nigeria didn't av a president that stands for a united country. The handwriting was written on the wall now we are reaping the fruits.killings, maimings, nepotism i can go on forever but im busy.
