She told the surities each time before ajournment that they need to bring kanu back and even refused to release any of them from their responsibilities when the requested. All 3 of the surities have a case to answer.

This is an ongoing case. The judge can order a surerty to produce the accused but the judge cannot render judgement without allowing the surety to show cause why the accused cannot be in court. In other words, even though Abaribe may have been ordered to produce Kanu, if he can show that Kanu cannot attend court due to the fault of the Government, he has no case to answer.

In this situation, Abaribe and the other two sureties have to show the judge that Nnamdi Kanu wanted to come for his court date but had to flee for him life because the Government wanted to use the military to kill him.

If the judge is satisfied that the accused cannot attend court due to threat to his life by government, the judge cannot hold the sureties responsible. Dead people dont go to court.
