As long as that visa application resulted in an issuance, and you have never been refused a visa under 214b or any other sections of the INA, you can say that you have never been refused a visa. A 221g refusal simply means that not enough information was available at the time of your application for a final decision to be made.

You could answer that you have never been refused a visa, or, if you like, you can answer that you were refused 221g and subsequently issued.

Sorry, what is a 221(g) refusal? A refusal as written alongside it I presume. In what sense then sir? While it’s yet hanging on my neck without my application being “officially” REFUSED so to speak, can the Canadian or any other Embassy hold this as a REFUSAL against me if for instance I am yet to attend the interview with the US Embassy, supply the requested documents or get of its hook generally by reason of being issued a visa after it?

I was asked to cancel my B1 221g achedule appoint if i intend applying for another visa category I cancelled successfully but unable to book another visa category on my profile page, have sent mails to LagosNiv and ustravels docs they still haven't responded anyone knows the step o should take next?

Any explanation on why a first time applicant, that was supposedly supposed to pick up passport with B1/B2 approved visa was given a 221g, and told to reschedule for another appointment under 221g after passport pickup?

I understand this could be applicable for drop box applicants. Has this happened with first timers as well?

I am having tbe same issue over 2 weeks ... i send enail and theh reply almost immeidately with a generic response ... its becoming fustrating ... ita not like there are no dates .. but it is blocked ... is this a delibrate attempt ... pls what else can be done .. o have called, sent emails ... no definite response ..

We ask all applicants to be honest about their intended activities in the United States, and the interviewing officer must be satisfied that the applicants can afford the kind of travel they are planning. This includes prospective students, business travelers, tourists, and those seeking medical care, and it applies to everyone around the world, regardless of nationality.

If you visit our website at https://travel.state.gov/content/travel/en/us-visas/tourism-visit/visitor.html, you will see that receiving medical care in the United States on a B1/B2 visa is legal. However, the website also states that applicants must demonstrate that they can afford to pay the "doctors’ fees, hospitalization fees, and all medical-related expenses". Though every situation is different, accepting discounts or paying less than the full amount can raise questions about the applicant's finances, credibility, and their intent and ability to pay for the full cost of their care.


Thanks for providing clarification. For our awareness, how do we best present burden of proof & doctor's correspondence when we're not given the opportunity to do so? What I mean by that is a VO quickly going through the standard childbirth questions and not bothering to read any burden or proof or doctor's correspondence.

It's tough to understand why a woman whose husband owns several companies, has several hundred thousand in assets, and a $30,000 USD medical bill (no discounts) can be denied under 214b with a VO not asking to read or view any of the bank statements or doctors correspondence. If someone like that can't get a visa, where's the hope for the rest of us?

What scenario in general may cause a VO to not bother viewing any documents or burden or proof, then proceed to deny under 214b?

Sometimes relevant information becomes available to the adjudicating officer after your interview has concluded. If the officer requires anything further from you, they will let you know on the 221g slip or at the time of your interview.

There is an enormous amount of relevant available to the adjudicating officer via your DS-160. If the officer does not want to view your documentation, it means they already have enough information from the DS-160, your interview answers, and any prior applications to make their decision. We very rarely look at documentation for any kind of visa class.

Every applicant and every application is different. We are not looking for only one kind of background story, one kind of bank statement, etc. What we are looking for are people who can demonstrate that their use of the visa has been or will be consistent with the visa class and the purpose of travel that they applied for, and for people who are forthcoming and honest about their intentions and ability to fund their stated travel plans. Applicants can demonstrate these qualities in several ways; documents are only one way, and they can be unreliable.

However, I did send mails before and no definitive answer was given. The response I got after my query is attached herein.

And while this inability to get a date for the follow up interview is still on, a few others have been able to book appointments both for fresh interviews and follow ups as per 221g refusal.

This now makes me want to ask if truly interview dates are released to applicants on individual basis and if the insinuations that the dates are deliberately blocked from some of us is correct.

I did Dropbox stated I was going to Houston for childbirth, now plans have changed and my interview is getting close, since It looks like Houston has a bad record for discounts, I want to change to another state on my ds160 before my interview. Please is this in anyway a problem

I have a friend who is a refugee in a country where uscis has an office. He has lived for over 2years there. He got married to an American a year ago. Can he successfully apply for a spouse visa to move to the states with the wife? If yes what’s required of him to facilitate this, any guidelines as he is still a Nigerian over there which is why I make this inquiry here

As long as you were forthcoming about your purpose of travel and pay your bills appropriately, the change in location will not necessarily be a problem. You may be asked why your plans changed so significantly, but deciding to visit a different destination within the United States is not against the law.

It is also important to remember that while the Department of State issues visas, the Department of Homeland Security is responsible for deciding whom to admit to the United States. Receiving a visa does not mean that you are guaranteed entry to the United States. Here on Nairaland, we can only clarify the Department of State's processes and standards, not those of the Department of Homeland Security.

In the instance of medical tourism, you must demonstrate that you have both the ability to pay for your intended treatment and the intent to pay for the treatment you receive. Our officers see dozens of cases like this each day and are capable of determining on their own how best to elicit the necessary information. There is no specific format that we look for or utilize.
