We (4 agents) gave out a 3 bedroom apartment to someone ( woman), and the transaction is now a problem.

I am the principal agent to the house but there are other two agents behind the person that link me with them. The last agent brought the client. The first day she came for inspection was the same day she met the landlord and the wife. But the husband attended or interviewed the woman while we were there. The woman told the landlord all he needs to know to the extend that she told the land that there is a redeemed church in that community and pastor is like a father to her, that she can give them the pastor's phone number so that they contact him to ask anything about her. She said this because the landlord and the wife are redeemed pastors as well. Then the landlord said no need that while his wife was driving out now he told him that the woman has a good spirit and she will like to give the house to her that their spirit work together. Then we all laugh and that is good then.

They ( the landlord and woman ) exchange phone numbers and the woman said the man should send account details so that she can pay the money next week. The meeting happened on Friday. On Monday evening the landlord called me that he has not see the woman alert that what is happening but I told him that the woman promised to pay on Tuesday not Monday.

On Tuesday, the paid around 10 am in the morning because the agent that linked us called me immediately to inform me that the woman had paid. I called the landlord immediately and he confirmed it that his wife had seen it. The woman paid into his wife account. Then I told him what about our commission then I sent him my account details he sent the money to us around 5pm in the evening. Immediately he called that his wife had sent the money, I check my account and it has dropped. Immediately, sent the other agent share to them. As a matter of fact the agent that linked me with other agent was in my office telling me that the man should have sent the money. That he needs money to settle family issues, especially his daughter whom they just gave admission at OAU.

After 30 to 45mins when we have shared the money and spent, the landlord called that they will not give the woman the house again. I should send the money back. I told I have shared they money and it had been spent. He said he care less. Then I asked if the woman is a Muslim or any problem. Because I know he does not want to give his house to Muslim. I said should I come and see him so that we can discuss it. He said he is in the church that he will call me when he is thru so that we can discuss it.

It was around to 8 pm yesterday the wife called me that I should make the money (#40000) available this morning that they need to complete the woman's refund. But I told her that there is no money, other agent had taken their share, even myself have spent mine too. She said she will bring police.

What is our fault here as agent. Are we to be blamed. Till now, I didn't known the reason behind the backing out.

Please, are we the agent at fault here?

You did nothing wrong. He made the agreement. Don’t send him any dime even if you have. What was he thinking before? Was he jazzed?

You and the landlord had a contract, he showed sufficient consideration to the contract when he paid agency fees to you.
Reneging on he agreement has caused you and the woman some discomfort, I suppose.
Meet the woman (tenant) and guage her feelings, if she is pained by the landlord's actions, suggest legal action against landlord.
join forces with tenant, get a lawyer to serve landlord with a warning and, intention to go to court over his breach of terms.

The truth is the woman is very pained according to the agent that brought her. She is not my direct client. The fourth agent brought her. They only came for inspection not knowing things will work out the same day.

You have been tolf what you need to know already...you got no fault on this the transaction was a fast one anf everyone involved was happy to.colllect his or her share and disband Asap but the landlord going back on his agreement due to a percieved problem is uncalled for and you guys cant be held responsible for breach of trust...so much hate crazy landlords like this...i pray we all have this money to build our own house in peace..

Go to the police first and report yourself incase he comes with a police and tell them just as you said here.

Option 2 is to contact your lawyer and narrate to him.

You did nothing wrong, he sent you your share, meaning he agreed to rent already, changing his mind later is his own problem and not that of you, the woman nor the other 3 agents.
